Dear Mr. Crozier:
You are in violation of Carlsbad Municipal Code section
21.42.010 (5) (E) , which requires you to secure a conditional use permit to store automobiles on your property. On August 30, 1993, the code enforcement officer sent you another letter ordering you to comply by September 17, 1993. You have ignored this notice and the matter has been referred to me for prosecution.
A violation of Carlsbad Municipal Code section 21.42.010(5)(E) is a criminal offense. It is an infraction punishable by a fine up to
$100 for the first violation. The penalty for a second violation within one year is $200 and a third violation may result in a fine up to $500. The fourth and each additional violation of the same ordinance within one year is a misdemeanor and is punishable by a
fine up to $1,000 or imprisonment up to six months, or both.
Each and every day during which a violation of the municipal code
is committed, continued or permitted is a separate offense,
punishable by a separate fine. These fines are in addition to each
other and can add up to a significant amount if the violation is
continued.
The policy of the city is to seek voluntary compliance with the municipal code whenever possible. However, when a person continues to ignore the law, the policy is to file a criminal complaint. If
I do not hear from you within 10 days, I will be forced to file a
complaint with the court. I urge you to voluntarily comply with
the city ordinance.
