It has come to my attention and to the City Manager's office that the Trash Refuse Company located in the Ponto area has expanded it's storage yard by paving approximately 3 acres of previous vacant land. This storage area is being used for the parking of their equipment. The property is zoned res- idential and the existing uses in the Ponto area for the most part are considered lawfully existing non-conforming. This means that the uses may remain as presently operating, but no intensification or expansion is permitted. Would you please investigate this alleged violation - you will need to determine the area that has been converted to the use, what has been done, what it is being used for, and if the site has any special approvals such as a conditional use permit, etc. After your investigation, please report to me so that we can determine the proper avenue to eliminate any zoning problems. Bud recently talked to the owner of the operation about a request to build a new structure on the site. Bud explained that it would be an expansion of a non-conforming use and therefore would be permitted, therefore the operator is aware of the non-conforming situation of his operation. Nevertheless, I believe this will be a difficult violation to regulate since there are no provisions that would prohibit the asphalting of the field that I know of. You may wish to check this out further through the building and subdivision codes as well as our zoning code. In addition, we have always had a problem with the Chappee Auto Wrecking Yard in the vicinity. I would suggest that in your investigation you also note current problems with the Chappee operation, specifically the storage of vehicles outside of the walls. This ponto area has always been a problem to the City, there are quite a few rather obnoxious businesses conducted in this area. These businesses' have been a particular thorn to ~ people living in the mobile home park to the east who have voiced their concerns to the Council and City Manager 1 many times. j i BP/ar
