Box 1540 Carlsbad, CA 92008 Cear Dr. Glenn: Your application, received January 2, 1990 (Enclosure l), for a Shellfish Grow- Area Certificate to plant and hamest oysters, clams, and mussels from prepared beds in Agua Hedionda Lagoon, San Diego County, has been considered by the Department of Health Services, Environmental MaMgement Branch. The location of your shellfish- allotment in the €!qua Hedionda Lagoon is shawn in Enclosure 2. Information pertaining to water and shellfish quality from the Agua Hedionda Lagoon is on file at the Shellfish program Office in Impoc. Based on this information, your shellfish grcwing area in Agua Hedionda lagoon is classified %mditionally approvd" . our shellfish Specialist, Mr. Patrick E. Wells, would be pleased to discuss this information with you if you have any questions about your shellfish growing area or the prwisions of this pefinit. Your shellfishhg operation in the Aqua Hdo& Lagoon me- the requirements of Sections 7706 to 7733, inclusive, Title 17, California code of Regulations, pertaining to the culture and harvesting of shellfish for human consumption. Therefore, the enclosed Shellfish Grow- Area certificate Ncrmber 18 (Enclamre 3), is hereby granted to Seafanns West subject to the following pmvisions. 1. Seafams West shall not supply to the plblic any shellfish ham- from waters adversely affected by human sewage, sewage effluent, animdl wastes, toxic chdcdls, oil, or other pollutants. 2. Seafams West shall supply to the public only shellfish harvested fm growing waters that meet state requFrements on bacteriological quality. 3. Seafams West shall not supply to the plblic any shellfish containing a mst probable fnrmber (W) of fecal coliform bacteria greater than 230 per 100 grams of shellfish meat, as determix& by laboratory analysis. 4. Seafarms west shall not hamest shellfish from ~gua Hedionda Lagoon for four (4) wnsecutive days following a rainfall of 1/2-inch or greater during any 24-hour period, as detexmmed ' by the costa Redl Municipal Water District. 5. Seafarms West shall provide for mutine bacteriological analyses of water and shellfish meat samples from the shellfish grcr;rbq wa& and the holding/display trays at weekly htervals durw all periods of htrvest and sale to the public. Water samples shall be tested for total d fecal coliform levels. Seafanns West shall arrange with the testing laboratory to have copia of all analytical results sent directl y to: Mr. RitrickE. Seafarms West shall Sutxnit one shellfish sample per week durjng all hamest periods to the Departnmt's sanitation and Radiation Laboratory, Berkeley, to be tested for paralytic shellfish poison. 7. Seafarms West shall not hold shellfish harvested fm the designated beds in any uncertified waters, or in any watercfilled tanks or trays, except in such areas or containers inspected and approved for such prpse by the Dewt. 8. Seafans West shall hold ham- shellfish in an apruved wet-storage facility for a period of not less than 48 hams, before &pent to market. Shellfish lots held in wet storage shall be separated and clearly labeled based upon date of hamest fm the grmirg area. 9. Seafams West shall particimte in an emergency notification plan, as dkected by the -t, to ensure hamesting closures in the event of sewage mhent plant malfunctions or other pollution events which might affect the quality of shellfish fruin the certified beds in the Agua Hedion3a Tagcmn. 10. seafarms west shall notify the Shellfish program office, -, immediately by tel@one at 805/733-1696, if it has received any report or lawwledge of any contamma ' tion of the shellfish beds or of swpectd illness fran the consmption of-shellfish fram the Agua Hedionda fagoan.
