Mr. John M. Davis,new managing owner of the subject project called me today. We
discussed the project conditions as laid out in your memo to Planning dated January 29,
1991. A copy of this memo is attached. Mr. Davis had received a copy of the memo from
Ann Hysong, With the management plan requirement deleted.

Mr. Davis questioned Condition No. 3. He feels that setting up three additional test I
stations in addition to the 0ne;required by the Department of Health is burdensome to him.
He also thinks that his project is not generating the need for these three additional test
stations. At this time I can understand and am inclined to agree with his positions in this
matter.
I request your guidance and direction as to what our position should be on those three
additional stations. This project is being tentatively scheduled for hearing in April.
Mr. Davis also questioned Condition No. 4 (responsibility of the project for any further
testing program). I told him that Condition No. 4 was a notice to him of the project’s
responsibility.
Mr. Davis was in agreement to all the other conditions.
