SUBJECT: CUP 194 - Request for Finding of Conformity with
the Existing Conditional Use Permit for the
Aquaculture Facility located adjacent to the SDG t
E power plant.
Dear Charlie:
At the request of my client, Dr. David Leighton, I have prepared a brief summary of the history of the actions that
have taken place regarding the aquaculture conditional use
permit located as described above. At our meeting with you two weeks ago, it was requested that Dr. Leighton's
proposed aquaculture use be found to be in conformity with
the existing CUP presently valid on the site. The status
of the existing CUP and how it related with the proposed
use was not known at this meeting so you indicated that the
files would have to be researched to determine conformity.
At my client's request, I have researched the files and the following is a brief summary of the past approvals:
CUP 194 - This Conditional Use Permit was approved on
March 11, 1981 for a series of fish culture tanks with
the purpose of harvesting sea bass. The tanks were to be located within the area between the existing research laboratory and the parking area to the north (see attached exhibit).

This permit was given a 7 year expiration date with the
ability to be extended by the Planning Commission. The expiration date was March 11, 1988.
CUP 194(A) - This was an amendment to CUP 194 to
expand the research laboratory that was constructed on the site. This CUP was approved on July 28, 1982. Although it superceded the earlier conditions of approval of CUP 194 (see attached CUP 194(A)

Resolution, Condition of the fish culture 2) it intended the continued use tanks and sea bass operation by
placing screening conditions along Carlsbad Blvd (see
Condition 8).
This permit was granted for a 5 year period and had an expiration date of July 28, 1987.
CUP 194tB) - This amendment approved a roadside stand
as part of the aquaculture use now existing on the site. This CUP was agprovedon-May__d, 1987 and
extended the earlier permits for the aquaculture
operation on the property. The intent of the permit
was to allow the roadside sale of products being grown
by the existing operation.
This CUP was granted for a 3 year period and is due to
expire on May 6, 1990.
One other bit of history: Seafarms West, the applicant for
CUP 194(B), changed the original sea bass operation to a
shellfish operation (muscles, oysters and clams). I made a
request to the Planning Department on Seafarms West's behalf to allow this change of product type under the
existing CUP. This was approved at a staff level.
Seafarms West later initiated a Zone Code Amendment to
allow the sale of aquacultural products grown on the site
within the OS zone. After approval of the Zone Code
Amendment, Seafarms West applied for an amendment to the
CUP to allow the roadside stand.
From my research, I believe Dr. bighton's request is in conformity with the existing CUP and that the permit is
valid until May 6, 1990. I also believe, however, that the
modifications he is proposing need review and approval by
the Planning Department as a minor revision and possibly review by the Planning Commission as an informational item. I do not believe, however, that an amendment to the
existing Conditional Use Permit is necessary.
I hope this summary is of help to you and that you concur with my findings. Please call me if you need any
