Hernandez Property Management Representative San Diego Gas & Electric Company 101 Ash Street San Diego, CA 921 12-4150 February 23, 1994 Dear John, This letter is to clarify to you and the land management department our company’s plans and intentions for future operations of our marine pharmaceutical research facility at the Encina Power Generating Station in Carlsbad. Our facility is housed within a 600 sq. ft. wooden greenhouse- type temporary structure, itself located within the shoreside area licensed to Carlsbad Aquafarm, Inc. by your company. As I’m sure you will remember, the arrangement which allowed for our construction of the greenhouse lab and for our temporary occupancy and use was made possible through the cooperative efforts of Carlsbad Aquafarm, Inc. and your office, after we vacated our previous wet-lab space within the San Diego State Marine laboratory building early in 1993. Within the laboratory, we are conducting scientific research on the feasibility and potential for aquacultural production of an important new marine chemical compound, under terms of a contract with the National Institutes of Health, National Cancer Institute. We anticipate continued work on this project using the present facility until approximately April, 1995, when our intention is to vacate the present facility, and move all of our tankage and supporting equipment across the outer Agua Hedionda Lagoon to space within the proposed Sea World Research Institute’s OREHP marine fish mitigation hatchery slated for completion in the spring of 1995. In discussions with Mr. Donald B. Kent, Senior Vice President of Sea World Research Institute, I was told that the tankage and research presently being conducted within the greenhouse wet-lab could be accommodated within the wet-lab space of the Sea World hatchery, and that we were welcomed to become co-habitants of that facility along with Sea World and San Diego State University upon its completion. Although no formal arrangement has been made with Sea World, we are acting on Mr. Kent’s word that we will be welcomed, and on the suggestion of Mr. Paul O’Neal of SDG&E that our company’s research projects would be in concert with the intended purpose of the Sea World facility, and that, if space was not limiting, SDG&E would like for our research to be accommodated within Sea World facility (as an alternative to us building a separate facility on the same property, as per our previous proposal to SDG&E and the City of Carlsbad. I trust that this information will serve your purpose for recording our intentions with respect to present and future facilities required to continue our research projects on SDG&E properties.
