SUBJECT: CUP 194(B)x4 - CARLSBAD AQUAFARMS
Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Department
has reviewed your conditional use permit extension, application no. CUP 194(B)x4, as to its
completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information
which must be submitted to complete your application. This list of items must be submitted
directly to your staff planner by appointment. All list items must be submitted
simultaneously and a copy of this list must be included with your submittals, including
five (5) sets of plans. No processing of your application can occur until the application is
determined to be complete. The second list is issues of concern to staff. When all required
materials are submitted the City has 30 days to make a determination of completeness. If the
application is determined to be complete, processing for a decision on the application will be
initiated. In addition, please note that you have six months from the date the application was
initially filed, April IO, 2003, to either resubmit the application or submit the required
information. Failure to resubmit the application or to submit the materials necessary to
determine your application complete shall be deemed to constitute withdrawal of the
application. If an application is withdrawn or deemed withdrawn, a new application must be
submitted.

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION

Planning:
1. The proposed expansion of the Carlsbad Aquafarms facility would require submittal of a
conditional use permit amendment (see Item 1 below). However, no expansion of the
facility could be supported until the Encinas Specific Plan update has been completed.
Additionally, because the proposed expansion is within the boundaries of the Precise
Development Plan being prepared for the proposed Carlsbad Desalination Plant and
Encina Power Plant, it must be included in that plan to enable consideration of a future
CUP amendment to expand the facility.
ISSUES OF CONCERN
Planning:
1. The Planning Commission extended CUP 194(B)x2 and CUP 194(B)x3 as shown on the
approved Exhibit “A for CUP 194(B)x2 dated May 18, 1994 on file in the Planning
Department. The Coastal Permit exhibit submitted with the project application differs
from the approved exhibit and includes areas that are no longer a part of the City issued
CUP. The Carlsbad Aquaculture CUP for the existing facility can be extended; however,
as indicated above, no expansion of the facility could be supported at this time.
2. If the applicant wishes to proceed with a CUP extension for the existing facility, please
provide current certification from the State of California Department of Health Services
for Shellfish Growing Area and Shellfish Handling and Marketing.
Engineering:
The following conditions of approval will be recommended:
3. Within 6 months of approval of this Conditional Use Permit extension, developer shall
submit and receive approval for a Storm Water Management Plan (SWMP) to the City of
Carlsbad Engineering Department. This project qualifies as a “priority project” as defined
by California Regional Water Quality Control Board San Diego Region Order No. 2001-01,
and therefore, the project is required to capture and reduce pollutants to a level of
insignificance. The organization and content of the SWMP shall be prepared in
accordance with the guidelines established by the City of Carlsbad. The SWMP shall
address the anticipated pollutants of concern associated with the project. The SWMP
shall also suggest the type@) of post-construction (structural) Best Management Practices
(BMP’s) required to capture and filter said pollutants of concern.
4. Prior to the next annual review of this Conditional Use Permit, developer shall have
constructed the necessary BMP measures necessary to capture and filter the anticipated
pollutants of concern associated with the project in accordance with the SWMP and the
latest California National Pollutant Discharge Eliminate System (NPDES) permit.
