Sirs:
We the undersigned concur with the Staff's findings in that the two
uses. Residential and Day Care, are not compatible. It should be noted
as an inforraation item that the property at 3062 Madison Street is occupied
by the daughter of the owners and a non-related male adult. It has also
been observed that Mr. and Mrs. Fred Parker have resided on the property
during the Del Mar racing season.
The proposition that the daughter assume a caretaker position would
make an impossible task of enforcing the moral and legal residency requirements
even If the Commission chose to enact regulations. If the daughter was to
assume a caretaker position there would be no way to set standards and have
them apply to future tenants.
The current situation is made even more precarious in as much as the
Parkers are able to sell either property to any individual without any
change required of the CUP. A required lot consolidation could insure
both parcels remain together.
It Is our opinion that the Planning Commission should impose the
following:
1. The Parkers are immediately to adhere to the current requirements
of the existing CUP 196-A, this to Include:
a. The vacating of 3062 Madison Street as a residence - Item 6.
b. Construct the trash receptacle - Item 13.
c. Obtain Planning, Building and Fire Department clearance
before occupancy - Item 7.
d. The Day Care occupant is to obtain a Business License before
further use of the facility.
e. Remove all debris from property - Item 9.
f. Removal of large RV unit and car storage on property..
2. The Parkers are to perfonn a lot consolidation to insure both
parcels will remain together as long as the CUP is in force.
It is our hope that these items will be accomplished as soon as
possible in order to protect the few children who now occupy the Day Care.
Our reason for this correspondence is not to force the day care tenant
out but to preserve the existing CUP in its present status as we have a
lawsuit pending to acquire the two parcels in question.

Costa Real Municipal Water District
Gentlemen:
The subject development project has been reviewed by the Costa Real
Municipal Water District to determine if there will be any transmission
facilities necessary to be constructed as a direct result of the
proposed development project. Additionally, the evaluation has
included the necessity for any relocation of existing transmission
facilities.
We have determined that there are no transmission facilities involved
so that the City of Carlsbad will be responsible for the design,
construction and inspection of the water system facilities within
the subject development project in accordance with the applicable
standard plans and specifications.
We recommend that the water demand for domestic, irrigational, and
fire needs for this project be reviewed in detail to insure that
sizing of new and existing systems will provide adequate supply.
The project has two existing l-inch water services and meters which
presently serve the existing dwellings.
