SUBJECT: CUP 1%Cs) xl - CARLSBAD VILLAGE CHILDREN‘S CENTER - Request for an
extension of CUP 196(B) allowing the continued operation of a preschool and
daycare center at 3062 and 3070 Madison in the Village Redevelopment (VR) zone
and in Local Facilities Management Zone 1.
I. RECOMMENDATION
That the Design Review Board ADOPT Design Review Board Resolution No. 162 APPROVING a five-
year extension of CUP 196(B) based on the findings and subject to the conditions contained
therein.
11. PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting the extension of a Conditional Use Permit allowing a preschool and
daycare center at 3062 and 3070 Madison Avenue in the Village Redevelopment (VR) zone. The
Conditional Use Permit, last amended on November 13, 1985, was conditioned to expire in five
years unless an extension is approved by the Planning Commission.
Although the project is located in the Redevelopment area, the original Conditional Use Permit, as
well as two subsequent amendments, have been heard by the Planning Commission. Since the
Design Review Board is now the decision-making body responsible for hearing redevelopment
projects, staff is bringing this request for extension before the Design Review Board.
Some changes have occurred to the project during the past five years. The last amendment, CUP
196(B), allowed one of the existing structures to be utilized as a residence for the caretaker or
administrator of the preschool. This residential structure was originally designated for use as a
preschool office. The current preschool and daycare owner does not wish to use the structure for
a residence or office, and it is now being utilized as an infant center for 11 children aged zero to
two years. Maximum enrollment is currently 44 children including the 11 children occupying the
infant center. The original permit specified a maximum of 64 children, however, the current
preschool operators are licensed for only 60 children.
The preschool owners and operators have changed since the last CUP amendment in November
1985, and the facility is now called Carlsbad Village Children’s Center. The previous schools were
Montessori; the Carlsbad Village Children’s Center is not.

m. ANALYSIS
The current preschool and daycare center, Carlsbad Village Children's Center, has continued to
operate as conditioned with minor changes mentioned above since September, 1989. The current
operators have transformed the facility into a professional preschool and daycare center which is
sanitary, freshly painted, fenced, and landscaped as required by the Conditional Use Permit.
Although the structure at 3062 Madison was approved by CUP 196(B) as a school caretaker or
administrator's residence, its use as a residence has not been diligently pursued as required by the
amendment; consequently, the approved use for 3062 Madison reverts back to a school ofice. The
current use as an infant center is consistent with the conditional use permit since it is not an
expansion of the preschool and daycare facility and will not increase the faciliiy's enrollment above
the maximum of 64 children allowed by CUP 196(B).
SUMMARY
Staff concludes that the use continues to be desirable for the development of the community and
is not detrimental to surrounding residential and commercial uses. The preschool and daycare
center continues to be adequate in size and shape to accommodate the use, and the street system
serving the proposed use continues to be adequate to properly handle all traffic generated by the
use. Based on the above, staff recommends that the Design Review Board extend CUP 196(B) for
five years through November 13, 1995.
Iv. ENVIRONMENTALREVIEW
The Planning Director has determined that the environmental impacts of the project have already
been considered in the issuance of a Negative Declaration dated February 13, 1981.
