APN 205-270-1 2 &14 EXECUTIVE DIRECTOR'S DETERMINATION: The findings for this determination, and for any special conditions, are discussed on subsequent pages. NOTE: The Commission's Regulations provide that this permit shall be reported to the Commission at its next meeting. If one-third or more of the appointed membership of the Commission so request, a permit will not be issued for this permit application. Instead, the application will be removed from the administrative calendar and set for public hearing at a subsequent Commission meeting. Our office will notify you if such removal occurs. Notice of Receiptand Acknowledgement. The permit is net valid and development shall not commence until a copy of the permit, signed by the permittee or authorized agent, acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to the Commission off ice. Expiration. If development has not commenced, the permit will expire two years from the date on which the Commission voted on the application. Development shall be pursued in a diligent manner and completed in a reasonable period of time. be made prior to the expiration date. Application for extension of the permit must Compliance. All development must occur in strict compliance with the proposal as set forth below. Any deviation from the approved plans must be reviewed and approved by the staff and may require Commission approval. Interpretation. Any questions of intent or interpretation of any condition will be resolved by the Executive Director or the Commission. Inspections. The Commission staff shall be allowed to inspect the site and the development during construction, subject to 24-hour advance notice. These terms and conditions shall be perpetual, and it is the intention of the Commission and the permittee to bind all future owners and possessors of the subject property to the terms and conditions. EXECUTIVE DIRECTOR'S DETERMINATION (continuedl: Pursuant to Public Resources Code Section 30624, the Executive Director hereby determines that the proposed development, subject to Standard and Special Conditions as attached, is in Conformity with the provisions of Chapter 3 of the Coastal Act of 1976, will not prejudice the ability of the local government to prepare a Local Coastal Program that is in conformity with the provisions of Chapter 3, and will not have any significant impacts on the environment within the meaning of the California Environmental Quality Act. Any development located between the nearest public road and the sea is in conformity with the public access and public recreation policies of Chapter 3. Proposed is the construction of a 12,400 sq.ft. parking lot addition to St. Pdtrick's Church parking lot. The project proposes twenty-seven parking spaces; total church parking would be 169 parking spaces. Approximately 100 cubic yards of cut grading and 140 cubic yards of fill are proposed to construct the parking lot pad. 7he church is located on Adams Street in Carlsbad, between lamarack Avenue and Magnolia Avenue in an existing developed clrea of primdrily residentid1 development. While the site is designated and /wed for residcrrtial uses, the Church i\ existing arid the pdrkirig lot t-xpdns ion ir permitted in the R 1 zone upon Jj)provd1 of J coridi 1 iona 1 ure permit, which the project hd\ received from the City of Carlsbad. 6 -91 -203 Page 3 Section 30251 of the Coastal Act provides that new development must be designed to not adversely affect identified scenic resources. Adams Street is identified in the certified Aqua Hedionda Land Use Plan (CUP) as a "Scenic Highway". While Agua Hedionda Lagoon would not be visible from this location, the visual impact of the parking lot addition from Adams Street must be reduced according to the visual resource policies of the LUP. In its Conditional Use Permit (CUP), the City has required the project to provide a landscaping plan. The CUP requires that the parking lot shall be landscaped with minimum 15 gallon canopy trees spaced at a ratio of one tree for every three parking stalls. Additionally, the plan must provide that minimum 5 gallon shrubs of Escallonia Exoniensis are planted along the eastern parking lot boundary, that landscaping be drought-tolerant, and that lawns and other ornamental plantings must be limited to areas of special visual imFortance or high use. The Executive Director determines that by incorporating these requirements into the landscaping plan, the project can be found consistent with Section 30251 of the Coastal Act and the visual resource policies of the Agua Hedionda Land Use Plan. Section 30604 (a) requires that a coastal development permit shall be issued only if the Commission finds that the permitted development will not prejudice the ability of the local government to prepare a Local Coastal Program (LCP) in conformity with the provisions of Chapter 3 of the Coastal Act. In this case such a finding can be made. As stated above, the subject proposal, as conditioned, is consistent with the applicable Chapter 3 policies of the Coastal Act and is consistent with the intent of the applicable Agua Hedionda Land Use Plan policies. The Commission therefore finds that the subject proposal will not prejudice the ability of the City of Carlsbad to prepare and implement a fully certifiable Local Coastal Program for the area. SPECIAL CONDITIONS: 1. Landscaping Plan. Prior to the authorization to proceed with development, the applicant shall submit a detailed landscape plan, approved by the City of Carlsbad, indicating the type, size, extent and location of all plant materials, the proposed irrigation system and other landscape features. Drought tolerant native or naturalizing plant materials shall be utilized to the maximum extent feasible. Special emphasis shall be placed on screening the parking lot with minimum 15 gallon canopy trees spaced at a ratio of one tree for every three parking stalls. Additionally, the plan must provide that minimum 5 gallon shrubs of Escallonia Exoniensis are planted along the eastern parking lot boundary, that landscaping be drought-tolerant, and that lawns and other ornamental plantings must be limited to areas of special visual importance or high use.
