Firstly,as described in the Receptacles Generally section of the ordnance. Residential trash cans should be stowed in the side or rear yards of the home. Without fail these individuals leave their uncovered trash cans in full view and on the road at the above address. Secondly, the residents at 3781 Adams Street, continue to have trash and bulk items covering the front and back yard. Surely, the piece of metal out front is not in compliance with the city codes for a fence. Thirdly, the 6 - 7 people in the 2 bedroom house are running at least two illegal operations out of this property. One is as an unlicensed daycare, where she will have up to 5 children playing. Another business being run at this address is a yard/tree service. The income they make is neither reported to the IRS or City, nor is the activity licensed or bonded. If needed I can supply you with at least two addresses of individuals who use the about residents and can support my claim, of course, it would be under duress. I believe the above address and St. Patrick's Parish should be investigated for the above reasons as well as the church's continued financial support of the illegal yard/tree business. You made it appear that it was a legal franchise. Now, February 8, 2008, a full 3 months after my inquiry, the neighborhood receives a Notice of Public Hearing to include the approval of the Saint Patrick's Ye Olde Garage Sale under the Conditional Use Permit Amendment of the Saint Patrick Parish and School uses. Obviously, the City of Carlsbad only cares about what it wants in Carlsbad, not what the residents want. The resale store continues to attract some green card holders but mostly illegal aliens to our neighborhoods where they use our yards as their bathroom and trash cans and stealing items from our yards and vandalize cars. I have not visited the site and do not know whether the complaint is valid. The complaint states that a small day care business and a landscape maintenance business are being operated at the site. If this is true, it is a violation of State of California requirements for licensing day care facilities and of CMC 21.10.040A which regulates home-based businesses, and I need to ask you to require your tenants to obtain a county day care license and a city business license by no later than March 3, 2008. On or after that date one of our staff will visit the property to determine whether the complaint was ever valid and, if so, whether the violation has been corrected. I am aware that, on occasion, a resident will file a complaint and give the wrong address for the alleged violation or may not fully understand the applicable ordinances. Please accept my apologies for any inconvenience or concern this letter has caused if, in fact, a violation does not exist. This letter, based on an unsubstantiated allegation, is intended to give you the earliest possible notice and to give you ample time to voluntarily correct any violation(s) that exist(s). It is also intended to efficiently provide the public, including yourself, with the best service possible. The project was approved by the City of Carlsbad on April 3, 2002. The engineering conditions of approval require that the project identify and treat existing and post-developed on-site pollutants to meet San Diego Regional Water Quality Control Board and National Pollutant Discharge Elimination System criteria. To that end, existing and post-developed pollutants are identified in this report and mitigation measures are recommended to treat the pollutants, in accordance with Best Management Practices (BMP's), to prevent the pollutants from entering into the public storm drain system. Anticipated Pollutants 1. Sediments: Landscaped areas on site erode small amonts of soils onto the parking lots and into storm drain system. 2. Nutrients: Landscaped areas are fertilized twice a year. 3. Trash and Debris: Debris from lunch bags and other misc. waste. 4. Oxegen-Demanding Substances: Landscaped areas adjacent to parking areas. 4. Oil and grease: Parking lots on the site get regular use. 5. Pesticides: Landscaped areas receive pesticide treatment twice a year. Best Managemant Practices (BMP's) Existing and post-developed on-site pollutants were identified in the "Anticipated Pollutants" section above. Measures to control these pollutants are as follows: A. To treat Sediments, Oil and Grease, drainage inserts will be installed to on-site catch basins by Downstream Services in Escondido, CA. These inserts will be maintained by on-site staff four times per year in accordance with the manufacturers specifications. See attachment "A" for manufacturers information for the drainage inserts. Downstream Services will train in-site staff maintenance practices. B. To treat Trash and Debris, as well as Sediments, on-site staff will conduct a maintenance/sweeping program which shall include sweeping the parking lots 2 times per week. On-site trash and debris will also be manually collected 2 times per week and disposed of in enclosed trash areas in trash containers with attached lids. C. To treat Sediments, Nutrients and Pesticides, landscape irrigation systems shall be on timers to minimize excessive irrigation runoff into the public storm drain system. On-site staff will monitor and immediately adjust and/or repair the irrigation system should excess runoff occur. By decreasing excessive runoff, the amount of pollutants held by suspended solids within the runoff will also be decreased. St Patrick School is planning to build an entire new campus at the school's current location. The development committee has established an anticipated completion date of July 2011 and is in the process of choosing a company for the fundraising to build the campus. The school buildings are currently located along Pio Pico and will be profoundly impacted by the widening of Interstate 5, which is due to begin in 2010. The Development Committee is in contact with Cal Trans, waiting for word on the final design of the freeway expansion in order to coordinate the design of the new school. In order to complete the application for processing, the City of Carlsbad Engineering Department requires the Storm Water Requirements Applicability Checklist to be filled out. Please see attached checklist. No construction has been done since the CUP was completed in 10/16/01. As a requirement of the CUP, St. Patrick School submitted the required SWMP and BMPs. These were brand new requirements at the time and the City had no guidelines in place for their completion. Nonetheless, St. Patrick School worked with the Engineering Department to develop the SWMP and BMPs. These were submitted, approved and installed per City requirements. In light of the extensive upcoming construction and the impending impact of the widening of Interstate 5, we ask that any permanent storm water requirements be put off until the new construction is completed in 2011. Storm Water Requirements Applicability Checklist ISSUES OF CONCERN Planning: 1. The modular buildings located on the Saint Patrick Parish School site which are utilized as temporary educational classrooms are now referred to as "mobile buildings" per Section 21.04.265 of the Carlsbad Municipal Code. Provided below is a definition of a mobile building: 21.04.265 Mobile building.* "Mobile building" means a structure constructed on a permanent chassis, transportable in one or more sections, designed and equipped for human occupancy for industrial, professional, commercial, educational, or temporary housing (e.g., farmworker or transitional housing) purposes to be used primarily with a temporary foundation system. A "mobile building" requires vehicle registration from the state Department of Transportation pursuant to the state Vehicle Code and requires registration and title from the state Department of Housing and Community Development pursuant to the state Health and Safety Code. "Mobile building" does not include a recreational trailer, mobile homes, manufactured home, or prefabricated home but may include a commercial coach or trailer coach. (Ord. NS-746 § 2, 2005) The occupancy of a mobile building is limited to a five-year term unless extended by the Planning Commission per Section 21.42.140(90)b of the Carlsbad Municipal Code. Considering that the municipal code now limits the occupancy of a "mobile building" to a five-year term, and the placement of the school's mobile buildings have exceeded this time period, please provide the school's plan to either remove or replace these buildings with permanent structures consistent with the Carlsbad Municipal Code. The school's plan to replace the mobile buildings with permanent structures and/or the reason(s) why this can not be accomplished must be addressed prior to staffs recommendation for this permit. Engineering: 2. Per Condition No. 18 of Planning Commission Resolution No. 5149 approving Conditional Use Permit CUP 204(D) on April 3, 2002, the applicant was required to submit a Storm Water Pollution Prevention Plan (SWPPP) for review and approval by the Engineering Department. To date, the City has not received a SWPPP.
