I occupy the structure immediately south of the Mizera Deli and I have no objections to the request of the applicant, however, ray support of the request is conditioned upon the following: 1. The management of the video games operation be personally supervised by Mr. Mizera. I request that, if the Mizera Deli should change ownership, CUP-211 be supended until such time as the new owner can give myself and the city adequate assurances that the video game operation would not be a nuisance to my business. 2. Should the video game operation become a nuisance, I request that CUP-211 be condi- tioned with adequate provisions for swift suspension and/or revocation of the priv- ileges contained therein. I.PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting approval to install additional video games at an existing delicatessen (Mizera's Deli) located at the northwest corner of Roosevelt Street and Grand Avenue and addressed as 595 Grand Avenue. The delicatessen presently has four games in the rear portion of the building. The applicant desires to convert this area into a larger game room area and install approximately eight additional games for a total of approximately twelve. No physical changes to the existing structure are proposed in conjunction with this request. Section 21.42.010(U) of the Zoning Ordinance states that all coin-operated arcades require a conditional use permit and are subject to the following conditions: 1) No alcoholic beverages shall be permitted on premises. 2) All activities shall be conducted within the confines of a structure designed to contain the noise created by such operation. 3) Construction shall be such as to permit unobstructed view of the interior from the street upon which the business fronts. The subject property is located in the Village Redevelopment Area. The Redevelopment Advisory Committee considered this re- quest at it's meeting of January 25, 1982 and recommended approval since the game room was part of an existing business and the applicant submitted a petition from surrounding businesses indicating that they did not object to the applicant's request. The Redevelopment Committee conditioned it's recommendation for approval on the condition that no separate signing for the game room area would be installed by the applicant. II. ANALYSIS The applicant is requesting to have a game room in conjunction with his existing delicatessen business. The business presently has four video games which are used on an incidental basis by the delicatessen customers. The applicant wishes to increase the number of games to approximately twelve. Because of the increased number of machines, the applicant was informed that the approval of a conditional use permit would be required. As the Planning Commission may recall, two previous requests for game rooms in the Redevelopment Area have been denied by the Com- mission. These requests were denied primarily because of incom- patibility with surrounding uses and potential policing and security problems. Staff believes that this present request differs from the pre- vious ones in several respects. Most importantly, the requested game room will be an adjunct to an existing, established bus- iness. It will not be operated as a separate business but will be available in conjunction with the existing business. The operator of the delicatessen will provide the supervision for the game room area and if any problems arise, they will affect his existing, primary business. This provides a much more sub- stantial incentive for the applicant to maintain a greater degree of supervision and control. The previous requests for game rooms in the Redevelopment Area were for separate, large-scale arcade businesses. All of the surrounding properties are occupied by commercial bus- inesses and the applicant indicated at the Redevelopment Advisory Committee meeting on this item that he had contacted these busi- nesses and that there were no objections to his request. There- fore, it appears that the requested use at this proposed location will be compatible with surrounding properties and uses. The public hearing process, however, should be utilized by the Plan- ning Commission to obtain input from surrounding property owners and determine compatibility. Although staff still has strong concerns about this type of use locating in the Redevelopment Area, given the fact that the use will be operated as an adjunct to an existing, established business, staff is recommending approval. III. ENVIRONMENTAL REVIEW The Planning Director has determined that this project is cate- gorically exempt from environmental review according to Section 19.04.070(6)(e) of the Carlsbad Environmental Protection Ordinance. -2- IV.
