STATEMENT OF AGREEMENT
TENTATIVE SUBDIVISION MAP
CITY OF CARLSBAD
The Subdivision Map Act and the Carlsbad Municipal Code sets a
fifty (50) day time restriction on Planning Commission processing
of Tentative Maps and a thirty (30) day time limit for City
Council action. These time limits can only be. extended by the
mutual concurrence of the applicant and the City. By accepting
applications for Tentative Maps concurrently with applications
for other approvals which are prerequisites to the map; i.e./
Environmental Assessment, Environmental Impact Report, Condominium
Plan, Planned Unit Development, etc., the fifty (50) day time
limits and the thirty (30) day time limits are often exceeded.
If you wish to have your application processed concurrently,
this agreement must be signed by the applicant or his agent. If
you choose not to sign the statement, the City will not accept
.your application for the Tentative Map until all prior necessary
entitlements have been processed and approved,
The undersigned understands that the processing time required by
the City ~~y exceed the time limits, therefore the undersigned
agrees tc extend the time limits for Planning Commission and
City Council action and fully concurs with any extensions of
time up to one year from the date the application was accepted
as compla-e to properly review all of the applications.

SUBJECT: CUP-212, LA JOLLA BANK AND TRUST - Request for
approval of a Conditional Use Permit to construct a
savings and loan office with a drive-thru facility
on the northwest corner of Elm Avenue and Jefferson
Street in the C-2 Zone.
I. PROJECT DESCRIPTION
The applicant is proposing to construct a 5,597 square foot, two
story bank with a drive-thru facility on a .36 acre lot located
as described above. The site consists of two parcels one of
which is occupied by an older single family dwelling while the
other is occupied by a temporary bank building. The single
family residence and the existing temporary building will be
removed from the site to allow for the construction of the pro-
posed permanent facility. The applicant proposes to place
another temporary building on the eastern portion of the site
during the construction of the permanent building. This tempo-
rary building will have to be removed from the site prior to the
occupancy of the permanent building to allow for the construction
of the parking lot. The site is located within the Redevelopment
Area and is surrounded by commercial uses.
This project was reviewed and approved by the Housing and
Redevelopment Advisory Committee at their meeting of March 8,
1982. The Committee felt that this project was in conformance
with the goals and the design and land use criteria established
for the Redevelopment Area.
II. ANALYSIS
Planning Issues
1. Can the four findings, required for approval of a Conditional
Use Permit be made?
a) That the requested use is necessary or desirable for the
development of the community; is essentially in harmony
with the various elements and objectives of the general
plan, and is not detrimental to existing uses or to uses
specifically permitted in the zone in which the proposed
use is to be located;
b) That the site for the intended use is adequate in size
and shape to acommodate the use;
c) That all of the yards, setbacks, walls, fences, land-
scaping, and other features necessary to adjust the
requested use to existing or permitted future uses in the
neighborhood will be provided and maintained.
d) That the street system serving the proposed use is ade-
quate to properly handle all traffic generated by the
proposed use.
Discussion
As proposed this project is in conformance with the goals of the
general plan and would not be detrimental to the existing uses in
the area. The subject propety is located along the Elm Avenue
corridor and according to the redevelopment plan for the Carlsbad
Village area, the goal of the Elm Avenue corridor is to create a
strong financial and commercial center. The major urban design
feature of this special treatment area is to encourage and
improve general circulation and utilize a high degree of land-
scaping and pedestrian orientation. As proposed this project
complies with these objectives.
The site is adequate in size and shape to accommodate the pro-
posed project. As shown on the attached exhibits, all of the
yards, setbacks, landscaping and other features necessary to
adjust the requested use to existing and permitted future uses in
the neighborhood will be provided and maintained. Some of the
proposed parking spaces consist of compact spaces. When this
item was reviewed and approved by the Housing and Redevelopment
Advisory Committee they allowed the applicant to provide up to
40% of his parking as compact spaces. The number of vehicle
stacking spaces in the drive-thru lane appears to be adequate for
a banking facility.
It appears that the street system serving the proposed bank will
be adequate to properly handle all traffic generated by this
project. The Commission should be aware that the alley at the
rear of the site will also be utilized by traffic exiting the
drive-thru window of the Home Savings and Loan facility. As
mentioned in the staff report for that project, staff feels that
at busy times this may cause some minor congestion in the alley,
but this should not be a significant problem. Staff recommends
that a "No Left Turn" sign be located so that it is visible to
people exiting the alley into Elm Avenue. Although this would be
difficult to enforce, it would help to discourage people from
making a left turn onto Elm Avenue. Eventually, when a median
island is constructed along Elm Avenue, this problem will be
eliminated.

Overall, staff believes all the required findings for approval of
a Conditional Use Permit can be made for this project. Staff is
therefore recommending approval of CUP-212.
IV. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not
have a significant impact on the environment and therefore has
issued a Negative Declaration on April 12, 1982.
V. RECOMMENDATION
It is recommended that the Planning Commission Approve the Nega-
tive Declaration issued by the Planning Director, and adopt Reso-
lution No. 1941, APPROVING CUP-212, based on the findings and
subject to the conditions contained therein.
