COMPLETENESS REVIEW
PROJECT ID: CUP 213X4 VILLAGE KITCHEN AND PIE SHOPPE
The Engineering Department has completed its review of the above referenced project for
application completeness and has determined that the application and plans submitted for this
project are complete and suitable for continued review. Engineering staff does not have any
comments to add to the project. Please add the following conditions to the approving
resolution/letter:
1. Within 6 months of approval of this Conditional Use Permit extension, developer
shall submit and receive approval for a Storm Water Management Plan (SWMP)
to the City of Carlsbad Engineering Department. This project qualifies as a
"priority project" as defined by California Regional Water Quality Control Board
San Diego Region Order No. 2001-01 and the City Standard Urban Storm Water
Mitigation Plan, and therefore, the project is required to capture and reduce
pollutants to a level of insignificance. The organization and content of the
SWMP shall be prepared in accordance with the guidelines established by the
City of Carlsbad. The SWMP shall address the anticipated pollutants of concern
associated with the Project. The SWMP shall also suggest the type(s) of post-
construction (structural) Best Management Practices (BMP's) required to
capture and filter said pollutants of concern.
2. Prior to the next annual review of this Conditional Use Permit, developer shall
have constructed the necessary BMP measures necessary to capture and filter
the anticipated pollutants of concern associated with the project in accordance
with the SWMP and the latest California National Pollutant Discharge Eliminate
System (NPDES) permit.

CAPITAL LETTERS, left justified, void of any punctuation. For any address
other than a single-family residence, an apartment or suite number must be
included but the Apartment, Suite and/or Building Number must NOT appear in
the street address line. DO NOT type assessor's parcel number on labels. DO
NOT provide addressed envelopes - PROVIDE LABELS ONLY. Acceptable
fonts are: Arial 11 pt, Arial Rounded MT Bold 9 pt, Courier 14 pt, Courier New 11

NOTICE IS HEREBY GIVEN to you, because your interest may be affected, that the Planning
Commission of the City of Carlsbad will hold a public hearing at the Council Chambers, 1200
Carlsbad Village Drive, Carlsbad, California, at 6:00 p.m. on Wednesday, April 20, 2005, to

SUBJECT: CUP 213x4 - VILLAGE KITCHEN & PIE SHOPPE - Request for an
extension of Conditional Use Permit CUP 213x3 to continue allowing the on-
premise sale of alcoholic beverages at an existing restaurant at 950 Tamarack
Avenue in Local Facilities Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5862
APPROVING a five-year extension of Conditional Use Permit CUP 213x3 based upon the
findings and subject to the conditions contained therein.
II. INTRODUCTION
This proposed five-year extension of Conditional Use Permit CUP 213x3 will allow the
continuation of the on-premise sale of alcoholic beverages at an existing restaurant at 950
Tamarack Avenue from April 28, 2005 through April 27, 2010.
III. PROJECT DESCRIPTION AND BACKGROUND
On April 28, 1982, the Planning Commission approved a five-year Conditional Use Permit
(CUP) for CUP 213. On June 20, 1990, the applicant was granted the first extension for eight
years for the CUP. On August 7, 1996, the applicant requested and was granted another
extension for five years. On November 1, 2000, the Planning Commission approved CUP 213x3
to continue allowing the on-premise sale of alcoholic beverages (beer and wine) at 950 Tamarack
Avenue. Condition No. 3 of the approving CUP Resolution No. 4850 specifies that CUP 213x3
is granted for a period of five years but may be extended upon written application of the
permittee (Annette Bradley). The owner, Forest Fisher, is requesting a five-year extension of
CUP 213x3 to continue allowing the on-premise sale of alcoholic beverages at this site for five
years from April 28, 2005 to April 27 2010.
IV. ANALYSIS
A. The on-premise sale of alcoholic beverages at an existing restaurant continues to be
consistent with all applicable plans, policies and regulations described below:
1. Carlsbad General Plan;

2. Local Facilities Management Plan for Zone 1;
3. Local Coastal Plan Mello II Segment; and
4. Title 21 of the Carlsbad Municipal Code.
B. The adopted project findings for CUP 213x3, which are contained in Planning
Commission Resolution No. 4850 still apply to this project (CUP 213x4).
C. The adopted project conditions for CUP 213x3, which are contained in Planning
Commission Resolution No. 4850 still apply to this project (CUP 213x4) with the
exception of Condition No. 3 which is amended by Condition No. 4 in Planning
Commission Resolution No. 5862 to extend CUP 213x3 for 5 years from April 28, 2005
through April 27, 2010, and new Conditions No. 5 and 6 which require the submittal,
approval, and implementation of a Storm Water Management Plan.
D. No formal written complaints regarding CUP 213x3 have been submitted to the City.
E. Annual reviews have been conducted for CUP 213x3 and the project is in compliance
with all conditions of approval.
F. The extended CUP is exempt from environmental review per Section 15301, Existing
Facilities, of CEQA.
V. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the
State CEQA Guidelines and will not have any adverse significant impact on the environment.
