Annual Review
Due to changes to city storm water regulations, condition No. 5 and 6 of PC
Resolution No. 5862 are no longer applicable. Therefore, we have no
objections to removing these conditions from future entitlements. Condition
No. 5 of PC Resolution No. 5862 requires submittal and approval of a
Storm Water Management Plan (SWMP) within 6 months of approval of the
CUP extension. Condition No. 6 requires that the Best Management
Practices (BMPs) be in place before the next annual review. Resolution
No. 5862 was approved on April 20, 2005.

SUBJECT: CUP 213x4 - VILLAGE KITCHEN AND PIE SHOPPE
The Carlsbad Municipal Code was amended in May, 2006, to no longer require a Conditional
Use Permit (CUP) for the sale of alcoholic beverages in a bona fide public eating establishment
(restaurant). Accordingly, this letter is to inform you that the existing (CUP 213x4) for the sale of
alcoholic beverages at the Village Kitchen and Pie Shoppe is no longer required and is hereby
repealed.
