HomeMy WebLinkAboutCUP 217A; Tyler Court Apartments; Conditional Use Permit (CUP) (2)MEMO Date: MARCH 4, 1992 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: CUP217fA)xl - TYLER COURT - Request for an extension of CUP 217(A) allowing a senior housing project at 3363 Tyler Street in the RDM Zone. The Planning Department recommends that Condition No. 2 of Resolution No. 3297 be changed to include a statement requiring that the applicant submit an annual report showing compliance with all conditions of approval imposed by Resolutions 6985, 7474, and 3297. Condition No. 2 is changed as follows: This conditional use permit is extended for a period of 8 years one and one-half months from the date of expiration or from January 17, 1989 through March 4, 1997. This conditional use permit shall be reviewed by the Planning Director on a yearly basis to determine if all conditions of this permit have been met and that the use does not have a significant detrimental impact on surrounding properties or the public health and welfare. To assist the Planning Director with this annual review, the applicant shall submit an annual report showing compliance with conditions imposed by Resolutions 6985, 7474, and 3297. If the Planning Director determines that the use has such significant adverse impacts, the Planning Director shall recommend that the Planning Commission, after providing the permittee the opportunity to be heard, add additional conditions to mitigate the significant adverse impacts. This permit map be revoked at any time after a public hearing, if it is found that the use has a significant detrimental affect on surrounding land uses and the public's health and welfare, or the conditions imposed herein have not been met. This permit may be extended for a reasonable period of time not to exceed five years upon written application of the permittee made no less than 90 days prior to the expiration date. In granting such extension, the Planning Commission shall find that no substantial adverse affect on surrounding land uses or the public's health and welfare will result because of the continuation of the permitted use. If a substantial adverse affect on surrounding land uses or the public's health and welfare is found, the extension shall be considered as an original application for a conditional use permit. If you would like an extension of this permit, please send us your request and a check for $375.00 ($100.00 for non-profit organizations), to City of Carlsbad, 2075 Las Palmas Drive, Carlsbad, CA 92009. Your request for an extension must be received no later than February 12, 1991 to allow adequate time to process your application and schedule a hearing before the Planning Commission. If you do not request an extension by this date, the permit will be considered invalid and to continue operating, you will have to submit an application for a new permit, along with a check for $2,000.00 ($100.00 for non-profit organizations).
