SUBJECT: CUP217fA)xl - TYLER COURT - Request for an extension of CUP 217(A)
allowing a senior housing project at 3363 Tyler Street in the RDM Zone.
The Planning Department recommends that Condition No. 2 of Resolution No. 3297 be
changed to include a statement requiring that the applicant submit an annual report
showing compliance with all conditions of approval imposed by Resolutions 6985, 7474,
and 3297.
Condition No. 2 is changed as follows:
This conditional use permit is extended for a period of 8 years one and one-half months
from the date of expiration or from January 17, 1989 through March 4, 1997. This
conditional use permit shall be reviewed by the Planning Director on a yearly basis to
determine if all conditions of this permit have been met and that the use does not have a
significant detrimental impact on surrounding properties or the public health and welfare.
To assist the Planning Director with this annual review, the applicant shall submit an
annual report showing compliance with conditions imposed by Resolutions 6985, 7474,
and 3297. If the Planning Director determines that the use has such significant adverse
impacts, the Planning Director shall recommend that the Planning Commission, after
providing the permittee the opportunity to be heard, add additional conditions to mitigate
the significant adverse impacts. This permit map be revoked at any time after a public
hearing, if it is found that the use has a significant detrimental affect on surrounding land
uses and the public's health and welfare, or the conditions imposed herein have not been
met. This permit may be extended for a reasonable period of time not to exceed five years
upon written application of the permittee made no less than 90 days prior to the expiration
date. In granting such extension, the Planning Commission shall find that no substantial
adverse affect on surrounding land uses or the public's health and welfare will result
because of the continuation of the permitted use. If a substantial adverse affect on
surrounding land uses or the public's health and welfare is found, the extension shall be
considered as an original application for a conditional use permit. There is no limit to the
number of extensions the Planning Commission may grant.

Enclosed is the Disclosure Statement in connection with
the above-referenced matter.
We respectfully request an extension to prepare the 600'
radius map, list of property owners, and labels in order
that we may have ample time for preparation.
My property manager, Carol Riccitelli, will be contacting you
in order that she may review the radius map that was previously
submitted and approved by the Commission on January 17, 1984.
It is hoped that we may be able to update the previous map,
send it to you promptly in order that we may receive a timely
renewal of the Conditional Use Permit.

SUBJECT: EXTENSION OF CUP 217(A) FOR THE TYLER COURT SENIOR APARTMENTS
Your application has been tentatively scheduled for hearing on July 17, 1991. In order
for us to proceed, we must perform the noticing as required in Section 65091 of the
California Government Code. If the required items are not received by June 14, 1991,
your project will be rescheduled for a later hearing. In the event that the scheduled
hearing date is the last available date for the City to comply with the Permit Streamlining
Act, and the required noticing items have not been submitted, the project will be
scheduled for denial.
Please submit two sets of the required 600' radius map, list of property owners, labels
for each property owner and for the applicant, and postage. Your application will not go
forward until these items have been received. Please sign the attached statement and
return it with your labels.

As a follow-up to your conversation with Ms. Jadel
Shipman of Tyler Court Apartments, the following
should answer the concerns you voiced:
1) all tenants meet the minimum age
requirement of 62 years of age
2) there is a total of 29 tenants presently
receiving HUD assistance
3) there is a total of 40 cars owned by
the tenants
4) as of this date a gate was installed
on the trash area
5) as of this date the 4 ft. x 8 ft. sign,
hanging at the front of the property,
was removed

In a recent audit of our records, we found that CUP No. 217A expired on January 17, 1984.
If you would like an extension of this permit, please send us your request and a check for $375.00
($100.00 for non-profit organizations), to City of Carlsbad, 2075 Las Palmas Drive, Carlsbad, CA
92009.
Your request for an extension must be received no later than February 12, 1991 to allow adequate
time to process your application and schedule a hearing before the Planning Commission.
If you do not request an extension by this date, the permit will be considered invalid and to
continue operating, you will have to submit an application for a new permit, along with a check
for $2,000.00 ($100.00 for non-profit organizations).
