Bobbie,
I prepared three staff reports and three resolutions for this extension. One is for no expiration date, one is
for a 5 year and the last is for a 10 year expiration. Housing and Redevelopment has asked for an unlimited
time period so whatever we decide to give them is fine with me. Chris and I are supportive of no expiration
date given the extensive monitoring that will occur (see staff report).

SUBJECT: CUP 217{A)x2 - TYLER COURT APARTMENTS
Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your conditional use permit extension, application no. CUP
217(A), as to its completeness for processing.
The application is complete, as submitted. Although the initial processing of your
application may have already begun, the technical acceptance date is acknowledged by the
date of this communication. The City may, in the course of processing the application,
request that you clarify, amplify, correct, or otherwise, supplement the basic information
required for the application. In addition, you should also be aware that various design
issues may exist. These issues must be addressed before this application can be scheduled
for a hearing. The Planning Department will begin processing your application as of the
date of this communication.

Condition No. 3a of Planning Commission Resolution 3297 for the extension of CUP
217 requires that the minimum age of at least one person occupying each unit shall
be sixty-two years of age or older. Does the project satisfy this condition. Your
project description indicates that it is a senior apartment project for senior citizens
55 years and older.
According to your project description, the project is now 100% affordable. Is there
need to discuss or address the project's density, i.e., indicate that a density bonus
is granted for the increased density to make it consistent with the RMH General Plan fl

Engineering:
Revise the site plan to identify the type of gate at the proposed entrance. Identify
the hours of operation of the gate (when open and closed). Clarify that this is not a
keypad type gate, which would lead to stacking of vehicles into the public street.
Add arrows to the plans to depict drainage throughout the parking lot.
Clarify how the project discharges storm water from the parking lot to the south on
railroad property (i.e. curb opening, concrete swale, ditch, etc.)
Indicate how National Pollutant Discharge Elimination System (NPDES) criteria will
be met. This could include, but not be limited to, doing one or a combination of the
following: directing surface run-off through vegetated swales prior to discharge to a
storm drain or the public right-of-way, constructing a gravel/sand/fossil filter
system, construction de-pollutant basins, etc.
7. Depict the existing water and sewer service that serve the project.
A red-lined check print is enclosed for your use in making the requested revisions. This
check print should be returned with the application submittal to facilitate continued staff
review.
