Beauchamp PO Box 5498 San Clemente, CA 92674-5498 RE: CUP 220 Dear Mr. Beauchamp: This letter is in response to your request for the City of Carlsbad to change the deed restriction, related to the minimum age requirement for senior citizen housing, for property located at 1003-1011 Chinquapin Avenue. Since the age restriction for senior housing was changed to meet state and federal regulations, the City's prior conditions of minimum age limits on senior projects has now been preempted by the state and federal regulations. The City will no longer enforce the 62 year old minimum age requirement for senior projects, as stared in condition number 12(a) of Conditional Use Permit 220, Planning Commission Resolution Number 7079. The City has decided not to change all of the deed restrictions of senior facilities because the state and federal regulations preempt the old conditions. If you still want to change the deed restriction, the City will be a party to the change, but will not initiate the change to the deed restriction. Box 5498 San Clemente, CA. 92674 SUBJECT: CUP 220 - CARLSBAD SUNSET Dear Mr. and Mrs. Beauchamp: As you may recall, a review of the Conditional Use Permit for Carlsbad Sunset was conducted on January 24, 1991. The site was found to be in violation of a condition that required the trash receptacle to be in an enclosure with gates. I recall talking to you about the gate and understood that you would work towards replacing the missing gate. I drove by on the week of April 29, 1991, and saw that there was no gate on the enclosure. Please let me know what you plan to do about this situation. I would like to take care of this before having to take the Conditional Use Permit back to the Planning Commission to revoke or modify the permit. As a result of this review it has been determined that you are in violation of Condition No. 9 in Planning Commission Resolution No. 7079. Condition No. 9 states that: Trash receptacle areas shall be enclosed by a six foot high masonry wall with gates pursuant to City standards. Please be advised that a public hearing before the Planning Commission will be scheduled if compliance with the conditions of approval of your permit cannot be documented within 30 days of the date of this letter. The Planning Commission may, after a public hearing held in the manner prescribed in Chapter 21.50 of the City's Municipal Code governing Conditional Use Permits, "revoke or modify any permit if the permit granted is being, or recently has been, exercised contrary to the terms or conditions of such approval." Chinquapin The plan submitted, indicates seventeen units would remain after conversion. This would exceed the normally allowed density on this .71 Acre property. However, this conversion plan allows for a density bonus for affordable housing. If the city indicates there is no longer such a need, these additional units could be used for a manager's office, or recreation room, or even be removed as has been approved on another senior housing conversion plan. I am of the opinion, that senior housing will have no impact on schools and the school .. district is "out of line" in their request.
