Dear Sir:
During 1982 the Presbytery of San Diego purchased 3.57 acres of land
at the south end of Centella Street for a new church development. The
church was to be known as Christ Presbyterian Church of Rancho La Costa.
Macy, Henderson, and Cole, AIA were retained as architects to develop a
master plan for the church and to process a conditional use permit through
your department. Conditional Use Permit #229 was approved by the City of
Carlsbad on June 8, 1983.
The same architects prepared plans for our first phase of construc-
tion consisting of a Fellowship Hall and a Day Nursery School/Sunday
school. Permits were issued, contracts let and work was completed and
approved by the city. The first service was held in the Fellowship Hall
in July, 1985. Growth has been steady but slower than we expected and we
had no reason to contact your offices. We now need to consider expansion
of our Sunday School and a member of the church came to your office only
to find our C.U.P. had expired. (Macy, Henderson and Cole, AIA., who
processed our master plan, C.U.P., and first phase of construction
retired and closed their offices in the Spring, 1986).
We understand a five year extension would be granted but the request
should be before the expiration date. By our own lack of knowledge we
failed to make such a request.
Please consider this letter as a request for the five year extension.
We still intend to follow the original master plan that was used in our
original request for C.U.P. #229. Thank you.

1 have reviewed the billings that you have received, for work per-
formed by City forces in supplying signing and safety barricading
,for the subject project between June 21, and June 26, 1974. Be-
cause of some communications problems between the City and your
subcontractor on the job site, it appears that a modification is
in orde:c on the billings for signing and barricade placement.
Please disregard the two (2) billings dated July 19, 1974 (one
for $416.65; the other for $266.65). ..
Attached is a new revised billing in the amount of $266.65. I
apologize for the delay and inconvenience to you on this matter.
The City will be in a position to accept -the work and release the
bonds on this project when this bill has been paid.
Please make your check payable to the City of Carlsbad and return
it directly to me and I will do what I -can to expedite' the release
of your bonds.

ly Prior to the issuance of building permits, complete building plans
to and approved by the Fire Department.
2y Additional public and/or on site fire hydrants shall be required if deemed necessary
by the Fire Marshall.
3)J The applicant shall submit two (2) copies of a site plan showing locations of existing
and proposed fire hydrants and on site roads and drives subject to the approval of
the Fire Marshall.
4) An all weather access road shall be maintained throughout construction.
All required fire hydrants, water mains and appurtenances shall be operational prior
to combustible building materials being located on the project site.
6) Adequate emergency vehicle turn-arounds shall be provided by a cul-de-sac or a
hammerhead when driveway is more than 150 feet deep from property line at street.
7) All driveways shall be extended to within 150 feet of all portions of.the exterior
walls of the first story of any building.
8) Proposed security gate systems shall be provided with "Knox" key operated override
switch, as specified by the Fire Department.
9) All private driveways shall be kept clear of parked vehicles at all times, and shall
have posted "No Parking/Fire Lane Tow Away Zone" pursuant to Section 17.04.040,
Carlsbad Municipal Code.
10) Fire retardant roofs shall be required on all structures.'
11) Brush clearance shall be maintained within a minimum distance of 30 feet to each
residence. *
12) All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers,
and other systems pertinent to the project shall be submitted to the Fire Department
for approval prior to construction.
13) All roof-top appurtenances shall be architecturally integrated into the design of
the building and shielding to prevent noise and visual impacts, subject to approval
before issuance of permit.
Building exceeding 10,000 sq. ft. aggregate floor area shall be sprinklered or have
four-hour fire walls with no openings therein which shall split the building into
10,000 sq. ft. (or less) areas.

C) Radius Map - A map to scale, not less than 1" = 200', showing all lots
entirely and partially within 600 feet of the exterior boundaries of the
subject property. Each of these lots should be consecutively numbered and
correspond with the property owner's list. The scale of the map may be
reduced to a scale acceptable to the Planning Director if the required scale
is impractical.

SUBSTANTIAL CONFORMANCE REVIEW
The Planning Director has completed a review of your application for a preliminary
review to determine substantial conformance. Your application proposes to expand
the Christ Presbyterian Church north parking lot located at 7807 Centella Street
(APN 215-062-25). Atier careful consideration of the circumstances surrounding
this request, the Planning Director has determined the application does not qualify
for substantial conformance with the approved permit (Conditional Use Permit CUP-
229). According to Planning Director Administrative Policy No. 35, projects may
qualify for substantial conformance if they do not create changes of greater than
ten percent. Your proposal would add at least 30 new parking spaces to the 115
parking spaces approved for the church, a proposed change of more than 25
percent. To expand the parking lot as your application proposes requires an
amendment to your conditional use permit.
Recently, planning staff met with Mr. Mac McCarter, a church representative.
Discussed was the completion of the north parking lot as approved, but with
internal realignment of some of the stalls and planters to readily accommodate a
future parking lot expansion. These changes seem in substantial conformance with
the approved permit and could be processed under your current application. To do
so, you will need to submit and receive approval of a plan that otherwise shows the
parking lot will be completed as approved (that is, with required landscaping,
paving, and striping) and with paved temporary turnarounds.
Since the City will not hold inactive applications indefinitely, please contact the
Planning Department by August 27, 1 999, to advise whether or not you will revise
plans as Mr. McCarter has proposed and submit them under the current application.
If you decide not to proceed at this time, the City will deny the current application
for the reasons described above.

Preliminary review of your project was conducted on August 3, 1995. Listed below are the
issues raised by staff. Please note that the purpose of a preliminary review is to provide you
with direction and comments on the overall concept of your project. The preliminary review
does not represent an in-depth analysis of your project. Additional issues of concern may
be raised after your application is submitted and processed for a more specific and detaiied
review.
1. A Hillside Development Permit (HDP) will be required for the proposed 4 foot high
retaining wall if the general slope is 15 feet or greater in height. If the slope is
greater than 15 feet high, a retaining wall, not to exceed 3 feet in height, can be
constructed without a HDP. It appears that the higher retaining wall is necessary to
create a larger building pad area to accommodate the expanded building foot print
of the proposed new building. Creating a larger building pad area is not considered
to be in substantial conformance with the previously approved Conditional Use
Permit (CUP 229).
2. The original project was approved with 115 parking spaces. The proposed project
would reduce the parking by 5 spaces for a total of 110 parking spaces. The
reduction of total parking provided for the project is not considered to be in
substantial conformance with the original Conditional Use Permit (CUP) and would
require a formal CUP amendment. By redesigning the parking layout and/or using
compact parking stalls as allowed in Chapter 21.44 of the Carlsbad Municipal Code,
115 parking may be realized within the designated parking area. The five parking
spaces are proposed to be removed to provide additional play area for the day care
center. If additional play area is needed, a permanent solution must be designed
into the project.
3. Drainage on the site must comply with adopted City standards as depicted on the
attached sheet.

4. In determining substantial conformance on a project, several factors are considered
including changes in building floor area, changes in building foot print size, and
general changes in building appearance. Although the proposed building would
contain the same floor area as the two buildings it would replace, the building foot
print and building appearance would change significantly enough to require an
amendment to the original Conditional Use Permit. The proposed building does not
meet the criteria for a substantial conformance determination and a formal
amendment to CUP 229 is required.
5. The proposed landscaping changes are not consistent with the parking area that has
been constructed near the existing fellowship hall. New plans should show the actual
landscaping that would be installed at the end of the cul-de-sac.
6. Should you decide to amend CUP 229, staff recommends that a formal phasing plan
be integrated as part of your proposal. An amendment should also include either the
concurrent submittal of architectural drawings or the incorporation of a procedure
to allow delayed architectural review at a later date. Addressing these two issues
through the amendment procedure would allow development of the church site to
occur over a period of years as funds become available.
