HomeMy WebLinkAboutCUP 23; Fox Snug Harbor; Conditional Use Permit (CUP) (6)MEMORANDUM June 11, 1965 TO: CARLSBAD CITY COUNCIL FROM : Planning Commission SUBJECT: Conditional Use Permit at Fox's Snug Harbor. A thorough review of written reports as well as Planning Commission and City Council deliberations has been made. It is not intended that this report repeat the detailed reports of the Planning Director or the Council Committee. Particular attention has been given to the recorded objections to the Planning Commission's April 13, 1965, Resolution. It is felt that this report satisfactorily meets the objections which were felt to have merit and validity and basis for fact. With further regard to the objections, the following two points appear pertinent: 1. It was stated that, "This will set a precedent ...'I The small amount of available and suitable LEVEL land adjoin- ing the lagoon limits such development. Also, the condi- tional use permit gives the Planning Commission and the Council exactly the strong degree of control that is required to judge each situation on its own merits. 2. It would be helpful to concerned residents to have a full and complete understanding of the regulations and restrictions imposed upon the applicant by the State of California's Health and Safety Code and Administrative Code and by the conditions incorporated in the Conditional Use Permit. These regulations and restrictions prohibit many of the activities objected to by complainants. Based upon additional facts and objections brought forth by interested parties since the first hearing the Planning Commission recommends that a conditional use permit be granted allowing over- night parking privileges subject to the following conditions: 1. This permit is granted for a period of three years from date of granting. 2. A maximum of 30 parking bays shall be allowed. Each bay shall be a minimum of twenty feet wide and forty feet long and shall be located within fifty feet of the water's edge. to be parked overnight for sleeping purposes. 3. Self-propelled vehicles shall be the only device allowed Conditional Use Permit June 11 , 1965 Page 2 4. No camping vehicle shall be allowed to remain on subject property on consecutive nights. 5. The Permittee shall be responsible for not allowing boat speeds in excess of 5 miles per hour between 30 minutes past sunset and 8:OO A. M. the next day. Boats shall not be permitted to carry anything in tow during these hours. 6. All applicable State, County and City ordinances, codes and regulations shall be conformed with. 7. All toilet facilities shall be connected to the City sewer within 90 days of the start of operation of the sewer facilities. 8. No clothes lines, washing or bedding shall be allowed outside the vehicles. Personal effects shall be confined to avoid a disorderly appearance. 9. Any Infraction of one or more of the above conditions shall be considered sufficient cause to revoke or suspend the conditional use permi t. The Commission agreed that this report and a minority report from Commissioner Lamb be submitted t6 the Council at their next regular meeting.
