As part of the process required for obtaining an extension of the Conditional Use Permit,
CUP 230A1, located at 2928 Valley Street in Carlsbad, we at Itsuko Yada Farms are
requesting an extension to this CUP for a duration of 4 to 6 years. We would like to
continue operating our scaled-back vegetable and cut flower operation and are
responding to thy City's one-time grace period, which allows us to retroactively extend
the CUP (from the time when the CUP had expired).
We, as the property owners, request an extension of this permit at this time. Enclosed
with this written request are the following:
1. Completed Disclosure Statement.
2. Land Use Application.
3. A check (number 20356) in the amount of $595.00 for the extension.
It is our understanding that these are the required documents (warrants, fees,
applications, etc.) needed at this time to begin the extension process.

Planning Commission Resolution No. 2861
STATEMENT:
Pursuant to Item 10F of the Engineering Conditions specified in the
executed Planning Commission Resolution No. 2861, we hereby declare that
the following description presents the true condition of the property on
March 24, 1990:
(1) There are no underground storage tanks in, on, underground,cor
in the path of the portion of property identified in Item 10A
of the Resolution 2861's section of Engineering Conditions.
(2) There are no other stored materials or facilities that lay
within the proposed and existing right-of-way of McCauley Lane.
(3) We do not intend to, nor anticipate, using this strip of property
for storing any materials or for placing facilities on it as of
this date for the normal operations of our farming activity.
We understand that being in compliance with Item 10F of the Engineering
Conditions is required and hope that this statement is acceptable and sat-
isfactory with the City Engineer.

As part of the ongoing effort to satisfy all conditions specified for
the completion of the issuance of Building Permit CB 891349, we are
submitting the following items:
(1) A Statement that presents the existing cleared condition of
the right-of-way proposed for McCauley Lane (especially in
regard to dedication of land as McCauley Lane right-of-way).
(2) A Truck Accessing Plan for the site which operates in accord-
ance with the conditions stated in Conditional Use Permit,
OJP-230(A).
The above items are specifically referenced in CUP-230(A) and a Planning
Commission Resolution Number 2861 executed on May 17, 1989. Please
refer to the Engineering Conditions items 10f and 10d for the respective
requirements in this resolution.
We certainly hope that these items are satisfactory to the City Engineer.

Planning Commission Resolution No. 2861
Pursuant to Item 10D of the Engineering Conditions specified in the executed
Planning Commission Resolution No. 2861, we are hereby submitting the required
Truck Accessing Plan which is currently in use for our agricultural farming
operations. This plan is proposed for continued use to address the following
items, if acceptable to the City Engineer:
(1) Type and Size of trucks serving the site.
(2) Truck parking, loading and turn-around areas.
(3) The specific route for trucks serving the site.
(4) Specific locations for site access.
TRUCK ACCESSING PLAN:
I. Type and Size of Trucks
The existing use of the site for fresh market produce and floral production
requires the general use of light duty farm trucks. The specific type and
size of trucks to be utilized shall be limited to the following:
(a) Two Moderate Duty Three-Quarter Ton, Flatbed Trucks used for
transferring field crates and produce.
(b) Two Light Duty One-Half Ton, General Purpose Trucks used to make
general deliveries of farm equipment and supplies.
II. Truck Parking, Loading and Turn-Around Areas
All of the required truck parking, loading, unloading, and turing around
shall be conducted in the access lanes or areas immediately adjacent to
the growing grounds, entirely within the property boundaries. Adequate
areas will be allotted to handle any related truck deliveries, staging,
manuvering, or parking. The majority of the parking will be directed to
the general Area 1 (see attached).
III. Specific Route for Trucks Serving the Site
The following truck route will be used to serve the subject site:
(a) Entry. All trucks shall approach the site directly from Elm
Avenue to Valley Street and then a right turn into the property
via a gated entry from Valley Street.
(b) Exit. All trucks shall exit the site by exiting the gated entry
and turning left onto Valley Street and then onto Elm Avenue.

IV. Specific Locations for Site Access
All of the trucks shall enter and exit the site through the gated entry
accessable by way of Valley Street directly. The entry currently exists
at a location approximately 200 feet south from the corner of Valley
Street and Buena Vista Avenue. This access is planned to be the only
entrance for all vehicles serving the site since this is presently more
than adequate for facilitating the operations at the location.

BUILDING PERMIT CB 891349/CUP 230(A)
We have received your letter requesting an amendment to the conditions of CUP 230 (A). Mr.
Orenyak has asked me to reply to your main concern of the Future Improvement Agreement. We
do agree that the street improvements do not need to be required with the construction of the
single family home. We further agree that those improvements should be deferred to some later
date. As called for in the Conditions of Approval, a Future Improvement Agreement is required
prior to issuance of any building permit. Even if the Planning Commission did delete that
Condition for a Future Improvement Agreement, City Code 18.40.040 requires the improvements
with any building on the property. Those improvements may again be deferred with a Future
Improvement Agreement. In other words, changing the Conditions of Approval on the CUP does
not relieve you of the requirement to sign a Future Improvement Agreement with construction of
any building on that property.
I have researched the various City codes to see if there is any type of variance allowed to this
situation and I have found none.
I have informed Mr. Orenyak of these finding and also verified his recollection of the meeting to
discuss your sale to Daniels Cablevision. His recollection of that meeting was that the street
improvements would not be required with the construction of your single family residence but
would be deferred. That reference to deferral in City terms automatically means a Future
Improvement Agreement.
I'm sorry if there were any misunderstandings regarding this issue. I assure you none was
intended. For your reference, I have included with this letter the Planning Commission Resolution
for CUP 230 (A) which contains the condition requiring the Future Improvement Agreement on
Page 3, Condition No. 10. I have also included a copy of City Code 18.40.040, "Public
Improvements Required", for your information. I have also discussed all of these items with Mrs.
Bibi Grosse. If you have any further questions regarding this matter, please call me at 438-1161.

Request for Amendment to Conditions CUP230(A)
Dear Mr. Orenyak:
This letter is a request for amendment to the conditions which
were placed on my 4.5 acre property when the Conditional Use
Permit was processed allowing me to build greenhouses at that
location. A Contract for Future Public Improvements in the
amount of approximately $260,000 was made a condition of the
extension of that CUP(A). When we met in your office prior to
selling our El Camino Real property to the Daniels Cablevision
Company, we discussed this particular issue and that $260,000
street improvements would be an unfair burden on the property for
one single family residence, and signing the Lien Contract for
those improvements would be postponed until we processed a
subdivision map.
We respectfully request that an amendment to the conditions of
Conditional Use Permit 230(A) be made in order to allow issuance
of Building Permit # CB 891349 for our single family residence at
1835 Buena Vista Way, Carlsbad.

The preliminary staff report for the above referenced project will be available
for you to pick up on Friday, May 5, 1989, after 8 a.m. This preliminary report
will be discussed by staff at the Development Coordinating Committee (D.C.C.)
meeting which will be held on Monday, May 8, 1989. A twenty (20) minute
appointment has been set aside for you at 10:30 a.m. If you have any questions
concerning your project, you should attend the D.C.C. meeting.
It is necessary that you bring your required unmounted colored exhibit(s) with
you to this meeting in order for your project to go forward to the Planning

Dear Sir:
I would like to take this opportunity to request an extension
to the Conditional Use Permit-230 by the Planning Commission.
It is my understanding that the permit may be extended for a
reasonable period of time not to exceed five years upon my
written application made not less than 90 days prior to the ex-
piration date.
I am requesting such an extension at this time. If appropriate,
please incorporate CUP-230(A) and CUP-230(B) at this time.
The current use of the land is for the growing of flowers and
other agricultural produce. I am planning to continue growing
flowers for a period of approximately five years.
We, at Yada Farms hope that the Planning Commission finds no
substantial adverse affect on the surrounding land uses or the
public's health and welfare resulting from the continuation
of the permitted use, and hope that an extension to the permit
will be granted.
