PROJECT DESCRIPTION AND HISTORY The applicant is requesting approval for a conditional use permit to allow two freestanding automobile dealership pole signs within 5 feet of each other on property located as described above. The signs will be located on the northwest corner of the property. Auto dealerships are located to the north, west and south of the subject property. The property to the east is vacant. At the May 9, 1984 Planning Commission meeting the applicant requested a conditional use permit to allow two pole signs to be located on the same lot. At that time the Zoning Ordinance allowed two pole signs on the same lot upon approval of a conditional use permit, but required that the pole signs be at least 200 feet apart. The applicant felt that this created an unfair burden on dealerships that carried more then one make of car and had less than 200 feet of frontage. The applicant voluntarily withdrew his application so that the City could prepare an amendment to the Zoning Ordinance to allow such uses. On October 16, 1984, ZCA-174 was approved by the City Council allowing the Planning Commission authority to reduce the distance between freestanding pole signs to under 200 feet, upon approval of a conditional use permit. Ill. ANALYSIS Planning Issues 1) Can the findings required for approval of a conditional use permit be made? Specifically: a) That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the general plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. b) That the site for the intended use is adequate in size and shape to accommodate the use. c) That all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained. d) That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. 2) Do the signs meet the sign requirements of Specific Plan 19? 3) Do the signs meet the regulations of Section 21.41 (Sign Ordinance) of the Municipal Code? Discussion The applicant proposes two freestanding dealership signs next to one another on property located as described above. The signs will identify the existing Volkswagen and Chrysler, Plymouth dealerships and will be 80.5 sq. ft. and 48 sq. ft. in size. Staff believes the use is desirable for the enhancement of the community because it would provide better identification of these automobile dealerships at Car Country. The size of the property is adequate in size and shape to accommodate the use since the dealerships are already existing. The proposed use will have no impact on the existing setbacks, landscaping and yards since the construction of two pole signs will not effect any of these features. Finally the street system will be adequate to serve the use since the adjacent streets are already improved. The use will not create any additional traffic. -2- The applicant's request does meet the requirements of Specific Plan 19. The Planning Commission has the authority to reduce the distance between the pole signs to under 200 feet with the approval of a conditional use permit. Staff believes the addition of a 48 sq. ft, pole sign will not adversely affect the neighborhood, nor cause any visual impacts. Also, the height of the original pole sign will be reduced from 35 ft. to 20 ft. The applicant's request will meet the requirements of the Sign Ordinance since the proposed sign will be under 55 sq. ft. in size. Overall, staff feels the proposal meets the requirements for a conditional use permit and therefore, recommends approval of CUP- 243. IV. Currently there is an existing 32 foot pole sign on the project site. This will be replaced by two 20 foot signs. III. ANALYSIS Planning Issues 1) Do the signs meet the sign requirements of Specific Plan 19(A)? 2) Do the signs meet the regulations of Section 21.41 (Sign Ordinance) of the Municipal Code? Discussion Approval of the subject CUP will allow one additional freestanding pole sign on a 3.14 acre site occupied by two automobile dealerships. The applicant feels that each dealership should have its own identification sign. Presently, the site has a 105 sq. ft. wall sign, a 160 sq. ft. pole sign (32 feet high) and several small directional signs. The applicant is proposing to remove the 32 foot high pole sign and replace it with two 20 foot high pole signs (55 sq. ft. and 48 sq. ft). The signs will be placed at the northeast corner of the property, 23 feet from the north property line and 15 feet from the west property line. The signs are proposed to be spaced approximately five feet apart. The applicant's request does not meet the requirement of Specific Plan 19 which states that any additional freestanding sign "shall not be erected within 200 feet of another freestanding sign on the same property." The applicant is proposing to place the two signs five feet apart. Staff believes this requirement is important because it will ensure that signs in Car Country will not appear cluttered and create negative visual impacts to the center. As proposed, staff believes the signs are much too close together and would create adverse visual impacts on Paseo del Norte. Also, the applicant's request does not meet the requirement of Section 21.41.075(b)(3) of the Sign Ordinance which states that two freestanding signs on the same property must be spaced at least 200 feet apart. Approval of this conditional use permit would be contrary to the intent of the Specific Plan and since the required findings for a conditional use permit cannot be made and the request does not comply with the City's Sign Ordinance, it is recommended that this application be denied. ZC 98-08/LCPA 98-04/CT 98-14 PUD 98-05/CP 00-02/SDP 99-06/HDP 98-15/CDP 98-68 - THOMPSON/TABATA - Request for recommendation of approval of a Mitigated Negative Declaration, Mitigation Monitoring and Reporting Program; a Zone Change and Local Coastal Program Amendment to change 40.41 acres of the subdivision from Limited Control (L-C) to Residential Multiple-Density with a Qualified Development Overlay Zone (RD-M-Q) and to change 37.62 acres from Limited Control (L-C) to One Family Residential with a Qualified Development Overlay Zone (R-1-Q); and a Tentative Tract Map, Planned Unit Development Permit, Site Development Plan, Condominium Permit, Hillside Development Permit and Coastal Development Permit to subdivide, grade, and develop 82.20 acres, creating 238 single family lots, two open space lots, four recreation lots, one recreational vehicle storage lot and a 24 unit, for-sale condominium project, affordable to lower-income households, on property generally located north and south of Poinsettia Lane, between Aviara Parkway and Snapdragon Drive in Local Facilities Management Zone 20. Mr. Wayne introduced the next agenda item; a continued public hearing for the project entitled Thompson/Tabata, which has a number of legislative and quasi-judicial actions to allow the development of a subdivision located at Poinsettia and west of Aviara Parkway. Chairperson Segall reminded the audience that public testimony was heard on this item at the last hearing and it would not continue at this meeting. Mr. Grim, Mr. Wickham, and consultants would respond to questions that were raised during public testimony at the last meeting and then the applicant would respond. Michael Grim, Senior Planner, stated they grouped the comments into two categories and divided the Staff presentation into two parts. He would respond to those appropriate to the Planning Department and Mr. Wickham would address the other issues. Mr. Grim addressed the following seven issues that were raised at the last Planning Commission hearing: Level of Environmental Review - Mr. Grim stated that Staff feels all potential environmental impacts have been mitigated to a level of significance. He said the document attached to the staff report was circulated for the standard public comment period and they received four comments from residents in the neighborhood regarding traffic concerns, but did not receive any comments from the state agencies. All statements within the Environmental Impact Assessment are supported by documentation prepared by experts in various fields from hydrology to biology to geology. He said Staff felt there was no need to do an Environmental Impact Report since all potential impacts could be mitigated to a level of insignificance. They prepared a Mitigated Negative Declaration which they feel contains all the justifications. Types and numbers of permits - Mr. Grim stated the types of permits required for this project are determined by the zoning designation, by site location, and configuration of the site and proposed product type. He said the zoning designation is Limited Control which requires a Zone Change and a Local Coastal Program Amendment to develop anything. The site location requires a Coastal Development Permit and a Hillside Development Permit. The proposed product type created the need for a Subdivision Map, a Condominium Permit, Planned Unit Development Permit, and a Site Development Plan for the affordable housing. He noted that these are the typical numbers and types of permits required for other developments in the Zone 20 area and added that no variances to standards or special permits were requested. Department of Real Estate Subdivision Report - Mr. Grim noted that the Subdivision Report is reviewed by the State Department of Real Estate and has no relation to any of the City permits or notices. He said the City cannot address that document because it is not theirs, they do not have an opportunity to approve it, and has no control over it. Link to the Aviara Master Plan Trail - Mr. Grim stated Staff did not require this as part of the project because it is not part of the citywide trail system. He said it is not required for coastal zone pedestrian access. PROJECT DESCRIPTION AND BACKGROUND On March 27, 1985, the Planning Commission approved CUP 243 to allow the placement of two freestanding automobile dealership pole signs within 5 feet of each other at 5500 Paseo Del Norte in Car Country Carlsbad. Condition No. 4 of the approving CUP Resolution No. 2424 specifies that CUP 243 is granted for a period of 10 years but may be extended upon written' application of the permittee (Bob Baker Volkswagen). The applicant. Bob Baker Volkswagen, Inc., is requesting a 5 year extension of CUP 243 to allow the two pole signs to remain in place at this site for another five years. While the ten year approval period has elapsed, the applicant did make a timely request for the extension. IV. ANALYSIS A. The two pole signs continue to be consistent with all applicable plans, policies and regulations described below: 1. Carlsbad General Plan; 2. Conditional Uses regulations (Chapter 21.42 of the Carlsbad Mimicipal Code); 3. Local Facilities Management Zone 3 regulations; and 4. Specific Plan 19(B). B.
