Background The Palomar Transfer Station is located at 5960 El Camino Real on I 0.98 acres in the City of Carlsbad. On November 6, 2012, the Carlsbad City Council approved CUP 260(0) to allow for an increase in the tipping floor area by 3,960 square feet. This increase was intended to be used for green waste in order to decrease/eliminate comingling with the standard MSW. On March 10, 2015, the City Council approved CUP 260(E) which allowed for an increase to hours that the transfer station was open to the public and provided a condition which required building permits to be obtained by November 6, 2016. On November I, 2016, the Palomar Transfer Station obtained the approval of CUP 260($'fx 1 which required building permits to be obtain by November 6, 2018. Since construction documents have not been submitted, Republic Services is requesting a time extension to November 6, 2020 in order to meet the timeframe for the issuance of building permits. Justification for Request Over the course this past year, Republic Services has been working with Waste Management on strategies regarding how best to construct the tipping floor expansion while creating the least impact to the current operations. Simultaneously, Republic Services has been putting together a team and securing contracts for the preparation of construction documents. LAND USE PLANNIIIB AND ENGINEERING These efforts have taken considerably longer than anticipated, however, this team is currently in the process of preparing the construction documents which are anticipated to be submitted before the end of November 2018. By working diligently with the City of Carlsbad through the review process, it is the intent of the team to complete the construction of the tipping floor expansion before the end of the first quarter of 2020. With the significant effort that has been put forth over the course of the last year, the funds that have been expended to get the construction documents underway, and the aggressive internal timeframe proposed by Republic Services for the construction and ultimate utilization of the new tipping floor area, we believe there is substantial evidence that demonstrates a clear intent to complete the expansion without further delay. Additionally, as originally intended, the tipping floor expansion will greatly improve the operations, efficiency and public safety at the Palomar Transfer Station. Please accept the proposed application of the request for a time extension of 24 months p (November 6, 2020) to obtain building permits pursuant to Condition #I of CUP 260(t)xl dated November 1, 2016. Pursuant to this letter and associated application, the applicant continues to accept all conditions contained in Planning Commission Resolution No. 7080 dated January 21, 2015 and City Council Resolution No. 2015-063 dated March 10, 2015 for CUP(E). Description/Explanation: See Attached Project Description P-1(B) Page 1 of 1 RECEIVED OCT 1 0 2018 CITY OF CARLSBAD PLANNING DIVISIOM Revised 07/10 •• PALOMAR TRANSFER STATION D CONDITIONAL USE PERMIT EXTENSION -CUP 260 ~xl ~rz:( ~-lu\61"'n1 PROJECT DESCRIPTION Palomar Transfer Station, Inc. is requesting a Conditional Use Permit Extension to allow for an additional 24 months in order to obtain building permits. The approved Condition #1 of CUP 260 (E)xl (attached) required building permits for the expansion of the tipping floor to be issued by November 6, 2018. Due to various internal constraints, Palomar Transfer Station was not able to move forward with the building permit process until recently. The applicant requests a 24-month time extension to Condition #1 of CUP 260(E)xl thus requiring the issuance of building permits before November 6, 2020. Republic Services has commissioned the preparation of construction documents. Those documents are well underway and are anticipated to be submitted to the Building Department in November 2018. It is expected that with their diligent pursuit for securing the permits, construction could start immediately upon issuance of the building and grading permit. The construction timeframe would be approximately five months. The efficient operation of the transfer station is critical to waste management for the City of Carlsbad. The construction of the additional tipping floor area approved under CUP 260(D) and the timeframe extended as a part of CUP 260(E), will greatly improve the management and movement of materials on the tipping floor. By creating the additional tipping floor space, any comingling of the various materials will be significantly reduced, thus saving time, energy and cost for the operation of the transfer station. The Palomar Transfer Station continues to maintain compliance with the requirements of CUP 260(E) and the findings in Municipal Code Section 21.58.040(b)(3) A-F. Additionally, the request for a time extension is also in compliance with the findings in Section 21.58.040(b)(3) A-F.
