CONDITIONAL USE PERMIT AMENDMENT - CUP 260 (E)
PROJECT DESCRIPTION
Palomar Transfer Station, Inc. is requesting a Conditional Use Permit Amendment to modify
Condition #3.b.lil of City Council Resolution No. 2005-029, which approved CUP 260 (C)
regarding the time for public access to the transfer station and Condition #8 of CUP 260 (D)
regarding the time frame for obtaining building permits forthe approved expansion ofthe
green waste bay.
CUP 260 (C) - Condition S.b.iii of City Council Resolution No. 2005-029
In February 2005, CUP 260 (C) and EIR 03-04 were approved by the City Council to allovtf for an
increase of Municipal Solid Waste tonnage, the addition of a transfer ioad out bay,
improvements to the interior circulation, and improvements to the adjacent roadway at the
Palomar Transfer Station located at 5960 El Camino Real in the City of Carlsbad. The EIR
analyzed the traffic impacts for the project based on the increased tonnage amounts along with
the proposed Monday through Friday 7:00 am to 4:00 pm operational times for public access to
the project site. The traffic impact analysis resulted in a number of roadway Improvements
adjacent to the project site. The Planning Commission recommended that the City Council
approve CUP 260 (C) and EIR 03-04 with the operational times as proposed and analyzed in the
EIR. However, the City Council approved a resolution that decreased the hours of public access
to the transfer station from Monday through Friday 7:00 am to 4:00 pm to 9:00 am to 4:00 pm.
The applicant accepted this change and the project was approved.
This currently proposed CUP Amendment requests an amendment to condition #3.b.iii of City
Council Resolution No. 2005-029 to allow for public access Monday through Friday from 7:00
am to 4:00 pm. Since EIR 03-04 examined traffic impacts based on the Monday through Friday
public access at a 7:00 a.m. - 4:00 p.m. operating timeframe and the roadway improvements
that were completed by the applicant mitigated for impacts that occurred throughout that
timeframe, the applicant feels that the restricted hours are not necessary and actually may
confuse the public because the gates are open for commercial haulers at 7:00 am. Therefore,
the applicant requests a change to this condition to allow for public access Monday through
Friday between 7:00 am to 4:00 pm.
CUP 260 (D) - Condition 8
CUP 260 (D) approved a 10 year extension of the facility's original Conditional Use Permit, and
allowed for the expansion of the tipping bay structure for green waste and
construction/demolition material, the collection of universal waste, and the collection of home-
generated sharps needles.
At this time, the applicant requests an amendment to Condition #8 of Planning Commission
Resolution 6907 for CUP 260 (D) to allow for an additional 24 months in order to obtain building
permits. The approved condition required building permits for the expansion to be issued by
November 6,1014. Due to funding constraints, Palomar Transfer Station cannot move forward
with the building permit process until early 2015. The applicant requests that the condition be
amended to grant a 24 month extension thus requiring the issuance of building permits before
November 6,2016.

To address post-development pollutants that may be generated from development projects, the City requires that new development and
significant redevelopment priority projects incorporate Permanent Storm Water Best Management Practices (BMP's) into the project
design per the City's Standard Urban Stormwater Management Plan (SUSMP). To view the SUSMP, refer to the Engineering Standards
(Volume 4, Chapter 2).
Initially this questionnaire must be completed by the applicant in advance of submitting for a development application (subdivision,
discretionary permits and/or construction permits). The results of the questionnaire determine the level of storm water standards that
must be applied to a proposed development or redevelopment project. Depending on the outcome, your project will either be subject to
'Standard Stormwater Requirements' or be subject to additional criteria called 'Priority Development Project Requirements'. Many
aspects of project site design are dependent upon the storm water standards applied to a project.
Your responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts. City staff has
responsibility for making the final assessment after submission of the development application. If staff determines that the questionnaire
was incorrectly filled out and is subject to more stringent stonn water standards than initially assessed by you, this will result in the return
of the development application as incomplete. In this case, please make the changes to the questionnaire and resubmit to the City.
If you are unsure about the meaning of a question or need help in determining how to respond to one or more of the questions, please
seek assistance from Land Development Engineering staff.
A separate completed and signed questionnaire must be submitted for each new deveiopment application submission. Only one
completed and signed questionnaire is required when multiple development applications for the same project are submitted concurrently.
In addition to this questionnaire, you must also complete, sign and submit a Project Threat Assessment Form with construction pennits
for the project.
Please start by completing Step 1 and follow the instructions. When completed, sign the form at the end and submit this with your
application to the city.

In response to the application for a policy of title insurance referenced herein, Chicago Title Company
hereby reports that it is prepared to issue, or cause to be issued, as of the date hereof, a policy or policies
of Title Insurance describing the land and the estate or interest therein hereinafter set forth, insuring
against loss which may be sustained by reason of any defect, lien or encumbrance not shown or referred
to as an Exception herein or not excluded from coverage pursuant to the printed Schedules, Conditions
and Stipulations or Conditions of said Policy forms.
The printed Exceptions and Exclusion from the coverage and Limitations on Covered Risks of said Policy
or Policies are set forth in Attachment One. The policy to be issued may contain an arbitration clause.
When the Amount of Insurance is less than that se forth in the arbitration clause, all arbitrable matters
shall be arbitrated at the option of either the Company or the Insured as the exclusive remedy of the
parties. Limitations on Covered Risks applicable to the CLTA and ALTA Homeowner's Policies of Title
Insurance which establish a Deductible Amount and a Maximum Dollar Limit of Liability for certain
coverages are also set forth in Attachment One. Copies of the policy forms should be read. They are
available from the office which issued this report.
This report (and any supplements or amendments hereto) is issued solely for the purpose of facilitating the
issuance of a policy of title insurance and no liability is assumed hereby. If it is desired that liability be
assumed prior to the issuance of a policy of title insurance, a Binder or Commitment should be requested.

This early public notice is to let you know that an application requesting to modify Conditions of approval
for a Conditional Use Pernnit (CUP) have been submitted to the City of Carlsbad on November 4, 2014.
The project application is undergoing its initial review by the City.
LOCATION: The project site is located 5960 El Camino Real, east of South Orion Street and south of
Faraday Avenue.
PROJECT DESCRIPTION: The applicant is requesting to modify Condition No. 8 of Planning Commission
Resolution No. 6907 to allow an additional 24 months for the applicant to receive building permits for
previously approved structures, and to modify Condition S.b.iii. of City Council Resolution No. 2005-029
to change the public access hours to 7:00 a.m. to 4:00 p.m. Monday through Friday.
Please keep in mind that this is an early public notice and that the project design could change as a result
of further staff and public review. A future public hearing notice will be mailed to you when this project
is scheduled for public hearing before the Planning Commission.

CONDITIONS
Land Development Engineering has completed its review of the above referenced project for
application completeness and has determined that the application and plans submitted for this
project are complete and suitable for continued review. Engineering staff does not have any
comments to add to the project. Please add the following conditions to the approving
resolution/letter:
1. Developer shall comply with the City's Stormwater Regulations, latest version, and shall
implement best management practices at all times. Best management practices include
but are not limited to pollution treatment practices or devices, erosion control to
prevent silt runoff during construction, general housekeeping practices, pollution
prevention and educational practices, maintenance procedures, and other management
practices or devices to prevent or reduce the discharge of pollutants to stormwater,
receiving water or stormwater conveyance system to the maximum extent practicable.
Developer shall notify prospective owners and tenants ofthe above requirements.

SUBJECT: CUP 260(E) - PALOMAR TRANSFER STATION
The preliminary staff report for the above referenced project will be sent to you via email on Wednesday,
January 7, 2015. This preliminary report will be discussed by staff at the Development Coordinating Committee
(DCC) meeting which will be held on January 12, 2015. A twenty (20) minute appointment has been set aside for
you at 9:30. If you have any questions concerning your project you should attend the DCC meeting.
It is necessary that you bring the following required information with you to this meeting or provide it to your
planner prior to the meeting in order for your project to go forward to the Planning Commission:
1. Unmounted colored exhibit(s) of your site plan and elevations. For residential projects of 2 or more
homes a typical street scene of the elevations shall be provided. The corresponding rear elevations
for the homes shown for the typical street scene shall also be provided; and
2. A PDF of your colored site plan and elevations.
The colored exhibits must be submitted at this time to ensure review by the Planning Commission at their
briefings. If the colored exhibits are not available for their review, your proiect could be rescheduled to a later
time. The PDF of your colored site plan and elevations will be used in the presentation to the Planning
Commission and the public at the Planning Commission Hearing. If you do not plan to attend this meeting,
please make arrangements to have your colored exhibit(s) and the PDF here by the scheduled time above.
Should you wish to use visual materials in your presentation to the Planning Commission, they should be
submitted to the Planning Division no later than 12:00 p.m. on the day of a Regular Planning Commission
Meeting. Digital materials will be placed on a computer in Council Chambers for public presentations. Please
label all materials with the agenda item number you are representing. Items submitted for viewing, including
presentations/digital materials, will be included in the time limit maximum for speakers. All materials exhibited
to the Planning Commission during the meeting (slides, maps, photos, etc.) are part of the public record and
must be kept by the Planning Division for at least 60 days after final action on the matter. Your materials will be
returned upon written request.

SUBJECT: CUP 260(D)xl - PALOMAR TRANSFER STATION
The Planning Division has completed a review of your application for a Conditional Use Permit Extension,
CUP 260(D)xl - Palomar Transfer Station, located at 5960 El Camino Real on 10.98 acres of land. The
project was approved on November 6, 2012 and expired on November 6, 2014 (the request for an
extension was submitted prior to the permit expiring on November 4,2014). After careful consideration
of the circumstances surrounding this request, it has been determined that (1) the project is still in
compliance with the Conditional Use Permit regulations Carlsbad Municipal Code (CMC) Chapter 21.42,
and (2) that the findings required for granting a Conditional Use Permit extension can be made; therefore,
the City Planner APPROVES Conditional Use Permit Extension No. CUP 260(D)xl for two (2) years
(retroactively from November 6, 2014 to November 6, 2016), based on the following findings and
conditions.
Findings:
1. All of the findings contained in the Planning Commission Resolution No. 6907 dated October 3,2012
and City Coundl Resolution No. 2012-243 dated November 6, 2012 for CUP 260(D) apply to this
extension and are incorporated herein by reference and remain in effect.
2. That the two (2)-year extension (retroactively from November 6, 2014 to November 6, 2016) is
appropriate because the owner/applicant is diligently pursuing finalizing all necessary permits, the
project is still consistent with the Conditional Use Permit regulations, and the extension would allow
the owner/applicant to preserve existing property entitlements while satisfying the conditions for the
construction of a green waste bay (CUP 260(D)).
3. That such permits and approvals as extended are consistent with the requirements of Title 21 of this
code at the time of their extension.
4. The project is exempt from the California Environmental Quality Act (CEQA) per CEQA Guidelines
Section 15303 - new construction of small structures. A Notice of Exemption was filed with the San
Diego County Clerk on November 9, 2012.

Conditions:
1. This Conditional Use Permit extension is granted retroactively from November 6, 2014 to November
6, 2016. If building permits for this project are not obtained within this time period, the Conditional
Use Permit extension will expire on November 6,2016, unless extended per Section 21.58.040 ofthe
Carlsbad Municipal Code.
2. All of the conditions contained in Planning Commission Resolution No. 6907 dated October 3, 2012
and City Council Resolution No. 2012-243 dated November 6, 2012 for CUP 260(D) apply to this
extension and are incorporated herein by reference and remain in effect except for Planning
Condition No. 8 in Planning Commission Resolution No. 6907 which is superseded by Condition No.
1 of this approval letter.
