SUBJECT; CUP-269 - FINNEY - Request for approval to allow a

At the meeting of March 13, 1985 the Planning Commission
conceptually approved CUP-269 (Finney) and directed staff to
return with documents of approval and conditions on this
project. This resolution is attached for your review and
adoption.

SUBJECT: CUP-269 - FINNEY - Request for approval to allow a
temporary automobile sales office trailer on property
located at 5445 Paseo Del Norte in Car Country.
I. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No. 2418 DENYING CUP-269 based on the findings
contained therein.
II. PROJECT DESCRIPTION
The applicant requests approval for the use of a trailer as a
temporary automobile sales office on property located as
described above. The subject property is relatively flat and is
presently vacant. The applicant owns the automobile dealership
to the south, while other automobile dealerships are located to
the east and north. The freeway is located to the west.
III. ANALYSIS
Planning Issues
Can the necessary requirements for a conditional use permit be
made? Specifically:
a) The requested use is necessary or desirable for the
development of the community, is essentially in harmony
with the various elements and objectives of the general
plan, and is not detrimental to existing uses or to uses
specifically permitted in the zone in which the proposed
use is to be located;
b) The site for the intended use is adequate in size and shape
to accommodate the use;
c) All of the yards, setbacks, walls, fences, landscaping, and
other features necessary to adjust the requested use to
existing or permitted future uses in the neighborhood will
be provided and maintained;
d) The street system serving the proposed use is adequate to
properly handle all traffic generated by the proposed use.
Discussion
The applicant requests approval for the use of a trailer as a
temporary automobile sales office on property located as
described above. The trailer will be located near the south east
corner of the lot. The zoning ordinance allows a temporary sales
office as part of an overall development plan with the issuance
of a conditional use permit. Staff in the past has recommended
approval of such uses when accompanied by a development plan; but
in this case the applicant has not submitted a plan. The intent
of the plan submitted is to ensure the beginning of construction
of a permanent facility. The ordinance indicates that no
extension of a conditional use permit can be granted after one
year unless construction of a permanent facility is underway.
The applicant has informed staff that it is not possible to
provide a site development plan because they do not know what
type of dealership will be located on this site. A prestiqious
domestic dealership may possibly locate on this site. If this
dealership is not located on this site, the adjacent Pontiac-GMC
Truck-Mazda dealership will be split-up and a portion of it will
be relocated to this site. Each of these uses would require a
substantially different site plan. The applicant has indicated
that no matter which dealership is located on this site a
temporary sales office in a trailer will be required.
Staff has no problems allowing the use of a trailer as a
temporary sales office and could probably make the necessary
findings for the conditional use permit if this application was
accompanied with a site development plan. However, without a
site development plan, staff cannot adequately review this
proposal. Staff believes it would be premature to approve a
trailer as a temporary sales office on this site development
plan. Staff, therefore, reommends denial of Conditional Use
Permit 269.
IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not have a significant impact on the environment and,
therefore, issued a Neqative Declaration dated February 23,
1985.

I am the owner of Jim Finney Inc., one of the original developers
of Carlsbad Car Country, currently selling new Pontiacs, Mazdas, and
G.M.C. Trucks at 5445 Paseo Del Norte. I have an undeveloped parcel of
land (approximately 1^ acres) between my current facility and Weseloh
Chevrolet. I am desirous of splitting up my current car lines, leaving
Mazda in my current facility, and building a new facility for my domestic
car lines - Pontiac and G.M.C. Truck. I also have reason to believe that
I am under serious consideration for another, very prestigious, domestic
car franchise that when secured would be a distinct addition to the
Carlsbad Car Country.
Our past Pontiac and G.M.C. selling performance is the only weakness
in the overall master plan. In this regard, I have hired additional new
management (4), and salesmen (8), to concentrate exclusively on domestic
car sales but have a very definite need, because of inadequate space in
my current facility, to separate the domestic sales effort from the
foreign. My immediate problem is to provide minimal, but reasonable,
office facilities to shelter these employees as well as our prospective
customers. It is also impossible for us at this time to submit adequate
or accurate building plans since the addition of the third car line must
be considered in meeting General Motors space guide requirements for
showroom, service stalls, office etc.
We are therefore requesting a "Conditional Use Permit" for an office
trailer to temporarily serve as sales management office space for the
domestic operation, prior to finalization of our building and construction
plans. We feel quite confident that we are no further than 30 days from
a General Motors commitment re: the third car line, and would anticipate
another three (3) months to submit building and development plans. Thus,
to show our good faith, we would be pleased to accept a "Conditional Use
Permit" with a three (3) or four (4) month review clause.
Thank you for your time and consideration of this request. I
sincerely feel that this request warrants strong consideration because of
the long term benefits to the Car Center development, additional revenue
to the city as well as allowing me to finalize a long time goal of devel-

The subject project has been reviewed by the Costa Real Municipal
Water District to determine if there will be any transmission
facilities necessary to be constructed as a direct result of the
proposed project. Additionally, the evaluation has included the
necessity for any relocation of existing transmission facilities.
We have determined that there are no transmission facilities involved
so that the City of Carlsbad will be responsible for the design,
construction and inspection of the water system facilities within
the subject project in accordance with the applicable standard
plans and specifications.

Mr. Finney is the owner of Jim Finney Pontiac, Mazda
and GMC in Car Country Carlsbad. Mr. Finney has an undevel-
oped parcel of land between his current facility and Weseloh
Chevrolet. Mr. Finney is desirous of splitting his current
car lines up, leaving Mazda in his present facility and
building a new facility for is two domestic franchises,
Pontiac and GMC Truck. Mr. Finney also believes that he
is under serious consideration for another prestigious
domestic car line franchise, that when secured would be a
distinct addition to the Carlsbad Car Center.
A serious current need to Mr. Finney is to accelerate
his GM (Pontiac and GMC) selling job. In this regard, he
has just recently hired additional management and sales
talent to work exclusively on domestic car sales. Finding
adequate temporary quarters for this new group is critical
since the current facility (showroom and office) is really
only adequate enough to accomadate the Mazda organization.
We are therefore requesting a "conditional use permit"
for an office trailer, which will be either: 10' x 52' or
12' X 60' to temporarily serve the domistic operation needs.
Sales management offices will be in the trailer.

licensed surveyor, landscape architect or land planner
who prepared the maps;
(3) North point;
(4) Scale; vicinity map;
(5) Date ot preparation;
(6) The location, width and proposed names of all
streets within the boundaries of the proposed
subdivision and approximate grades thereof;
(7) Location and width of alleys;
(8) Name, location and width of adjacent streets;
(9) Lot lines and approximate dimensions and
numbers of each lot;
(10) Approximate location and width of watercourses or
areas subject to inundation from floods, and location
of structures, irrigation ditches and other permanent
physical features;
(11) Approximate contours at 1' intervals for slopes
less than 5%, 2' interva:|.s for slopes between 5% and
10%, and 5* intervals for slopes over 10%. (both
existing and proposed). Existing and proposed topographic
contours within a 100 foot perimeter of the boundaries of
the site. Existing on-site trees; those to be removed and
those to be saved;

The list shall include the San Diego County Assessor's
parcel number from the latest assessment rolls. 2) Two
separate sets of legal size (#10), addressed stamped
envelopes (four sets for condominium conversions) of the
property owners and occupants within a 300-foot radius of
subject property. For any address other than single family
residence, apartment or suite number must be included, DO
NOT TYPE ASSESSOR'S PARCEL NUMBER ON ENVELOPES AND LEAVE
RETURN OF ADDRESS BLANK. 3) For Condominium Conversions,
two separate sets of addressed, stamped envelopes of all
existing tenants is required.
K. 300 Foot Radius Map
(Not needed for Site Development Plan, Planning Commission
Determination and Special Use Permit). A map to scale not
less than 1" = 200' showing each lot within 300 feet of the
exterior boundaries of the subject property. Each of these
lots shall be consecutively numbered and correspond with the
property owner's list. The scale of the map may be reduced
to a scale acceptable to the Land Use Planning Manager if
the required scale is impractical.
L. For residential projects within Vista, Encinitas or San
Dieguito School Districts, the applicant shall indicate
whether he prefers to dedicate land for school facilities,
to pay a fee in lieu thereof, or do a combination of these.
If the applicant prefers to dedicate land, he shall suggest
the Specific land.
For residential projects within the Carlsbad Unified School
District and the San Marco Unified School District, the
applicant shall submit written confirmation that school
facilities will be available and serve the project at time
of need.

In order to assist the members of the Planning Commission and
City Council to avoid possible conflicts of interest, all appli-
cants are required to complete this disclosure form at the time
of submitting their application. When this form has been com-
pleted and signed, the information will be relied upon by them in
