I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 3568
APPROVING CUP 272x1, based on the findings and subject to the conditions contained
therein.
IL PROJECT DESCRIPTION AND BACKGROUND
This application is for an extension of a Conditional Use Permit for an existing church in
an industrial office park development. The temporary church use (CUP 272) was originally
approved in July, 1985, for a two year time period upon appeal to City Council. The
project had been denied by the Planning Commission because of Fire Department concerns
about the need to evacuate children from the building should an emergency occur. The
Fire Department has reviewed the current application for extension of the CUP and is
satisfied that the conditions of approval adequately address any evacuation concerns.
At the time of the original application the suite (Suite D) was owned and used for church
services by La Costa Lutheran Church (now known as Church of New Hope). The Church
of New Hope no longer uses the suite for church services but still owns it and leases it to
Calvary Chapel of Carlsbad. Suite D contains a total of approximately 2760 square feet of
space located on two floors (2040 square feet on the first floor and 720 square feet on the
second floor mezzanine area).
Calvary Chapel of Carlsbad has one office employee and maintains varied office hours from
Tuesday through Friday. Church services are held on Sunday mornings and evenings and
on Wednesday evenings. Approximately 30 people attend evening services and 50 - 60
attend Sunday morning services, well within the number anticipated (125) with the
original application.

In January, 1993, it came to the attention of the Planning Department that a church was
operating at the site without a CUP. Although CUP 272 had expired in 1987, the Planning
Department is treating this request as a CUP extension rather than a new CUP, because the
applicant (tenant) was unaware of the expiration.
III. ANALYSIS
Can the following four findings required for a Conditional Use Permit still be made?
1. That the requested use is still necessary or desirable for the development of the
community, is still essentially in harmony with the various elements and objectives
of the General Plan, and is still not detrimental to existing uses or to uses
specifically permitted in the zone in which the proposed use is to be located;
2. That the site for the intended use is still adequate in size and shape to accommodate
the use;
3. That all of the yards, setbacks, walls, fences, landscaping, and other features
necessary to adjust the requested use to existing or permitted future uses in the
neighborhood have been, and will continue to be, provided and maintained; and,
4. That the street system serving the proposed use is still adequate to properly handle
all traffic generated by the proposed use.
DISCUSSION
1. The requested use is still necessary or desirable for the development of the
community, is still essentially in harmony with the various elements and objectives
of the General Plan, and is still not detrimental to existing uses or to uses
specifically permitted in the zone in which the proposed use is located. When the
CUP application was originally made (in 1985) staff had safety concerns about
locating a church in an industrial area. Of particular concern was the possibility of
having to evacuate a large group of people, particularly children, from the area
should an emergency occur. A condition (Condition No. 10, City Council Resolution
No. 8088, attached) was drafted which alleviated staff concerns about this issue.
This condition ensures that there will be no pre-school or day care services
provided. In the recent past, the City has allowed a number of churches in
industrial office developments without incident.
2. The site for the use is still adequate in size and shape to accommodate the use. The
tenant. Calvary Chapel, occupies the site as it was originally designed with no plans
for expansion or changes. Parking for the use is provided by the existing industrial
office center parking supply. Because church services occur only during the evening
and on Sundays, the parking provided is adequate.

3. All of the yards, setbacks, walls, fences, landscaping, and other features necessary
to adjust the requested use to existing or permitted future uses in the neighborhood
have been, and will continue to be, provided and maintained. The existing structure
is part of an approved condominium industrial office development. No walls,
fences, etc. were required to adjust the requested use to existing or permitted future
uses in the area. The only adjustment necessary was the condition that large
assemblages of people, particularly children, not be allowed to use the facility
during the daytime hours Monday through Friday. This condition will be extended
to the CUP extension approval also. (See Item 1 above.)
4. The street system serving the proposed use is still adequate to properly handle all
traffic generated by the proposed use. The currently approved streets and aisles are
adequate to accommodate the church use.
IV. ENVIRONMENTAL REVIEW
The Planning Director has determined that the potential environmental impacts of this
project have already been considered in conjunction with the Negative Declaration
prepared for CUP 272, therefore no additional environmental review is required.

I . RECOMMENDATION
It is recommended that the Planning Commission ADOPT Resolution
No. 2436 DENYING CUP-272 based on the findings contained
therein.
II. PROJECT DESCRIPTION
The applicant is requesting a conditional use permit to allow a
church to temporarily locate in Unit D of Building No. 5731 at
the Faraday Business Park in the M-Q zone. The Faraday Business
Park is a recently constructed industrial condominium complex
located at the intersection of Palmer Way and Faraday Road. At
the present time approximately half of the units in this project
have been sold. Many of the units that have already been sold
are being occupied by warehouse-office type of uses. These are
uses intended by the M zone.
Unit D, the location of the proposed church has a first floor
area of 2040 square feet and second story mezzanine floor area
of 720 square feet for a combined area of 2760 square feet. The
applicant has informed staff that they expect to have up to 125
people attending Sunday Services at the proposed location.
III. ANALYSIS
Planning Issues
1) Can the required findings, for approval of a conditional
use permit, be made? Specifically:
a) That the requested use is necessary or desirable for
the development of the community, is essentially in
harmony with the various elements and objectives of
the general plan, and is not detrimental to existing
uses or to uses specifically permitted in the zone
in which the proposed use is to be located.
b) That the site for the intended use is adequate in
size and shape to accommodate the use.
c) That all of the yards, setbacks, walls, fences,
landscaping, and other features necessary to adjust
the requested use to existing or permitted future
uses in the neighborhood will be provided and
maintained.
d) That the street system serving the proposed use is
adequate to properly handle all traffic generated
by the proposed use.
Discussion
Staff has concerns about locating a church in an industrial
area. One of the purposes of zoning is to separate incompatible
land uses. The purpose of the M zone is to create an area where
potentially offensive industrial uses can be located away from
residential areas and large assemblages of people. Locating a
church in this type of area is contradictory to this goal and to
the intent of the General Plan regarding industrial uses. The
general plan states as a policy that we should "protect areas
designated for industrial use from encroachment by non-
industrial uses."
The applicant believes that the proposed use will not cause any
problems because the church use will occur on Sunday when most
of the industrial uses in the building would be inactive. Some
cities agree with this philosophy and have allowed uses such as
churches and schools to locate in their industrial areas on
a temporary basis.
However, the Land Use planning staff along with the Police and
Fire Departments (see attached Memo) have safety concerns about
locating a church in an industrial area. Of particular concern
is the possibility of the exposure of a large group of people to
flammable or toxic fumes. It is impossible for the City to know
exactly what chemicals will be processed or stored within the
same building or adjacent buildings. Several months ago a fire
occurred in a paint storage room of an industrial building in
San Diego causing the release of toxic fumes. Two schools which
the City of San Diego had permitted near the site had to be
evacuated. If this type of accident occurred during a church
service, there is the potential for a large number of people to
be immediately exposed to flames or toxic fumes with little or
no warning.
Staff realizes the need for a church to have a temporary meeting
place until a permanent facility can be financed and
constructed. However, staff believes that an industrial area is
not the appropriate location for a church or a school even on
a temporary basis. The most appropriate location for a church
is in or immediately adjacent to residential areas where they
will be in close proximity to the people they serve. If a
church must locate somewhere on a temporary basis staff believes
it would be more appropriate to locate in a commercial or
straight office building rather then an industrial area. There

would be less chance of being exposed to an industrial type
accident and most commercial and office areas are in closer
proximity to residential areas.
Staff believes that the uses specifically allowed in the
industrial zone could potentially be detrimental to the proposed
church. Since staff can not make all of the findings required
to approve a conditional use permit, staff must recommend denial
of CUP-272.

meeting. At that time staff was recommending denial of the
proposed conditional use permit. The Commission believed that
the proposed use could be conditioned so that it would be an
acceptable use in the industrial area. Staff was directed to
meet with the applicant and return with a resolution containing
conditions of approval for the Planning Commission to review.

CHURCH USE IN INDUSTRIAL PARK
There are some potential conflicts with placing a church use within an industrial
park. A church is classified as an assembly occupancy, or a place where
relatively large numbers of people congregate. The greatest potential conflict
is placing large numbers of people in close proximity to buildings or portions
of buildings which might contain hazardous matenals.
While the church usage will be classified as an A-3 occupancy, the remainder
of the building would be a B-2. Non-flammable and non-explosive hazardous
materials are permitted in B-2 occupancies, as long as required protective steps
are taken. The inclusion of protective measures does not preclude the possibility
of an emergency incident occurring involving the hazardous materials.
A typical incident involving hazardous materials will usually involve the
evacuation of people in the immediate area and the possibility of providing
emergency medical treatment. The introduction of more people into the area only
compounds the degree of the emergency. We might very well expect that the
number of people in one assembly occupancy would equal or exceed the total
number of employees in a typical small industrial building or complex.
Please take this information into consideration when reviewing the proposed use.

(La Costa Lutheran Church)
This is a formal request that the City Council review
the decision of the Planning Coiranission to deny CUP 272.
There was not a full Planning Commission in attendance
the night this item was heard and apparently there was
some confusion regarding the possibility of industrual
accidents occuring in the building where the church is
proposed. For these reasons, I feel further consideration
is necessary.

TO ALLOW REVIEW OF THE LAND USE
ELEMENT OF THE GENERAL PLAN
In a desire to assist the City of Carlsbad to
expeditiously review the Land Use Element of the General Plan and
to ensure full and adequate review of the application for this
development project the undersigned agrees that the time limits
imposed by law to approve or disapprove this application shall be
extended. If a negative declaration is adopted for this project
the undersigned agrees that the time period for approval or
disapproval is extended for 90 days. If the project requires an
environmental impact report the undersigned agrees that the time
limit imposed by Section 21151.5 of the Public Resources Code is
extended for six months and that the project shall be approved or
disapproved within 90 days after the certification of the
environmental impact report. The undersigned understands that the
City will process this application according to City Council
Resolution No. 7872 and consents to processing the application
according} to that resolution.
