SUBJECT: CUP-277 - CALIFORNIA SPEEDWAY, INC. - Request for
approval of a conditional use permit to allow the sale
of beer and wine coolers at Sunday evening events from
April to November at Carlsbad Raceway.
I. RECOMMENDATION
That the Planning Commission APPROVE the Negative Declaration
issued by the Land Use Planning Manager and ADOPT Resolution No.
2505 APPROVING CUP-277, based on the findings and conditions
contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
California Speedway, Inc., the applicant, presently leases the
"speedway track" from Carlsbad Raceway to conduct racing events
on Sunday evenings. The applicant is requesting approval of a
conditional use permit to allow the sale of beer and wine coolers
at Sunday evening events which are held every Sunday from April
through November, from 7:30 to 9:30 p.m. The beverages would be
sold from a stand to be located near the existing food stand and
bathrooms.
This request is not related to the existing conditional use
permit which allows Carlsbad Raceway Corporation to sell beer at
five events throughout the year. The applicant was advised by
the Police Chief to keep the permits separate since they pertain
to separate organizations.
The applicant also will have to obtain a permit from the
Alcoholic Beverage Control (ABC) Board. Carlsbad Raceway's
concessionaire currently has the license for the entire raceway
area. That concessionaire would have to concede the speedway
area from their licensed area before a permit would be issued to
another concessionaire, i.e. California Speedway, Inc.
III. ANALYSIS
Planning Issue
1. Will the requested sale of beer and wine coolers at Sunday
evening events be detrimental to the public safety?
DISCUSSION
Probably the major problems associated with the sale of
alcoholic beverages at public events are the possibility of
patrons driving home from the site in an intoxicated condition
and possible unruly behavior.
Staff believes that the proposed conditional use permit, as
conditioned, will assure adequate protection of public safety.
The Police Chief will have the ability to revoke permission to
sell the beverages if he determines that the continued sale of
the beer and wine coolers would be detrimental to the public
safety of the spectators, participants, or members of the
surrounding community. The Police Chief also will have final
authority over the level of security provided each week, and will
be advised 45 days in advance of the first event. In addition,
serving of the alcoholic beverages will end at 9:30 P.M. or at a
certain point in the evenings event, whichever is sooner. This
point is specifically defined in the conditions of approval.
Finally, the conditional use permit will be issued for a period
of only one year. Staff feels this is a prudent condition since
the applicant is a new concessionaire to the raceway.
Since the Police Department believes that these conditions will
result in adequate crowd control and subsequent public safety,
staff is recommending approval of CUP-277.
IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not have a significant impact on the environment and,
therefore, has issued a Negative Declaration on October 5, 1985.

On the basis of this initial evaluation:
I find the proposed project COULD NOT have a significant effect on
"the environment, and a NEGATIVE DECLARATION will be prepared.
I find that although the proposed project could have a significant

sheet have been added to the project. A Conditional Negative

California Speedway, Inc., the applicant herein, leases a small portion
of the Carlsbad Raceway, known as the "speedway track". Carlsbad
Raceway has an existing conditional Use Permit, together with numerous
amendments thereto. Carlsbad Raceway is permitted to sell beer at
b special events per year, subject to restrictions.
Environmental Impact Assessments for grading permits must be accompanied
with a qradina plan and grading profile.
2. Describe the activity area, including distiguishing natural and man-
made characteristics; also provide precise slope analysis when
appropriate. See sitemap. The "area" is the speedway racing track at
the Carlsbad Raceway. It is a small, oval dirt track with a crashwall
surrounding it. A second fence surrounds the crashwall. A grandstand
and a grassy amphi-theater area surrounds the track. (For a more

ELEMENT OF THE GENERAL PLAN
In a desire to assist the City of Carlsbad to
expeditiously review the Land Use Element of the General Plan and
to ensure full and adequate review of the application for this
development project the undersigned agrees that the time limits
imposed by law to approve or disapprove this application shall be
extended. If a negative declaration is adopted for this project
the undersigned agrees that the time period for approval or
disapproval is extended for 90 days. If the project requires an

STATEMENT OF AGREEMENT
TENTATIVE SUBDIVISION MAP
CITY OF CARLSBAD
The Subdivision Map Act and the Carlsbad Municipal Code sets a
fifty (50) day time restriction on Planning Commission processing
of Tentative Maps and a thirty (30) day time limit for City
Council action. These time limits can only be extended by the
mutual concurrence of the applicant and the City. By accepting
applications for Tentative Maps concurrently with applications
for other approvals which are prerequisites to the map; i.e..
Environmental Assessment, Environmental Impact Report, Condominium
Plan, Planned Unit Development, etc., the fifty (50) day time
limits and the thirty (30) day time limits are often exceeded.
If you wish to have your application processed concurrently,
this agreement must be signed by the applicant or his agent. If
you choose not to sign the statement, the City will not accept
your application for the Tentative Map until all prior necessary
entitlements have been processed and approved.

PUBLIC FACILITIES FEE REQUIRDIENTS
City Council Polio-y Number 17 requires that all developers requesting a
discretionary action for a project pay a public facilities fee in the
amount of 2.0 percent of the building valuation. The fee is computed by
the Building Department•and paid at the time the building permit is
obtained. In the case of a condominium conversion, the fee is calculated
on the building valuation at the time the fee is paid and the fee must be
paid prior to obtaining a final map on the project.
In addition to the above, a completed, signed, and notarized agreement to
pay the public facilities fee must be submitted with any application for a
discretionary action. This agreement form should be completed by the
applicant and submitted as follows:
1. Select the appropriate form for either (a) the developer and owner are
the same party, or (b) the developer and owner are different.
2. Fill in the date the agreement is completed, the name and address of
the developer (and owner, if appropriate) and state if each is an
individual, partnership, corporation, etc.
3. Fill in the type of project proposed to be constructed, such as "a 12-
unit condominium" or "30,000 square foot shopping center", etc., and
the proposed name (if any).
4. Fill in the date the request will be (or was) submitted and the type of
request, such as a "a tentative map", or a "condominium permit",
"rezoning", etc.
5. Type a short legal description of the property on the last sheet
(Exhibit "A"). Legal must be original, no reproduced copies will be
accepted.
6. Sign the form in the presence of a notary and have the notary attach an

STATEMENT OF- PROPOSED ACTION
FOR WHICH APPROVAL FROM THE
CITY OF CARLSBAD TS' REQUESTED
California Speedway, Inc. is presently promoting motorcycle
speedway races each Sunday night at Carlsbad Raceway, located at
6600 Palomar Airport Road. The racing season runs from mid April
through the end of October. The race each Sunday begins at 7:30
p.m. Concessions are currently being sold at the racing facility
in the form of hot dogs, snacks, sodas and coffee. By virtue
of this proposal, California Speedway, Inc. is requesting author-
ization from the City of Carlsbad to sell beer and wine coolers
along with the other concessions currently sold.
This proposal outlines the proposed action for which approval
is sought, including the collateral issues associated with the
proposed action.

STATEMENT OF OPERATIONS
CALIFORNIA SPEEDWAY
California Speedway, Inc. has recently joined the City of
Carlsbad business community. From January to mid April, 19 84, an
existing dirt oval track at Carlsbad Raceway was completely
renovated to accommodate a form of motorcycle racing known as
speedway racing. Speedway motorcycle racing is a sport where the
riders race around a small dirt oval track. A typical race has
4-6 riders and consists of 4-5 laps around the track. A typical
race lasts approximately 2 minutes. Speedway racing is recognized
at as the safest of motor sports—there has been no fatality in
the history of American speedway.
California Speedway has built the most modern and safe speed-
way racing facility in Southern California—there are presently 6
sanctioned speedway tracks in California. Each major Southland
County has a speedway facility. California Speedway operates the
only speedway track in San Diego County, and is sanctioned by the
American Motorcycle Association.
Since April 14, 1984, California Speedway has conducted speed-
way racing events in the City of Carlsbad. The races take place
each Sunday at 7:30 p.m. and last until 9:30-9:45 p.m. A total
of 25 separate events, or heats, make up a single night of racing.
Compared to other forms of motor racing, speedway racing at
Carlsbad is very quiet and does not disturb the community with
unacceptable noise levels, as all motorcycles are equiped with
mufflers. The racing seasons runs from mid April through the
end of October.

California Speedway has sold concessions at its races since
the track was renovated. Hot dogs, snacks, sodas and coffee are
sold each week while the races are being conducted. As with any
sporting event, the fans attending speedway events have grown to
expect beer sales during the races; but, to date, no beer or any
other alcohol has been sold at the track. California Speedway is,
however, the only speedway track that does not sell beer at the
racing events. In fact, research has revealed that California
Speedway operates the only major sporting event in San Diego County
where no alcohol is sold during the event. Speedway fans are no
more nor less alcohol consumers than the average football, base-
ball or basketball fan. Moderate beer consumption has always
been associated with sporting events. Although in theory it would
be safest to separate alcohol consumption from any spectator event
where the fans have to drive to and from the event, on premises
sales of moderate amounts of "soft li'(3Uor" may better control the
use of alcohol by fans, as it is believed that the average fan
will drink one way or another, if so p.redisposed. By selling beer
and wine coolers at the speedway events, California Speedway
believes that it will discourage fans from bringing alcohol from
their homes and consuming it during the drive to the speedway track,
or during the drive home. It is hoped that the average beer

drinking fan, knowing that he or she can buy a beer at the track,
will not feel compelled to stop at the liquor store during the
drive to the track.
Beer is currently being sold at all of the other speedway
tracks throughout California. California Speedway is aware of no
particular alcohol related problems that have arisen as a result
of beer sales at speedway events. A speedway event lasts about
as long as an average baseball game. The practical reality of
selling beer at speedway events, or baseball games, is that the
fans come to see the sproting event—not to stand at the beer stand
all night and consume excessive amounts of alcohol. If some one
wishes to do nothing but consume alcohol, he or she would more
probably go to a bar or nightclub to do so.
California Speedway would like to obtain permission from the
City of Carlsbad to sell beer and wine-coolers during the racing
events each Sunday. The approval is requested, frankly, because
it is believed that the modest attendance records at the Sunday
night events are partially attributed to the fact that beer is not
sold at the track. Questionaires given to the fans each week
regarding California Speedway races are returned with one common
complaint: Why don't they sell beer'&t the races?
In addition to not selling beer at the event each Sunday,
California Speedway has a policy of refusing to allow the fans to
bring alcohol into the track and considerable effort is made to
see that alcohol is not brought into the track. The policy is a
necessity; but, it too, is believed to be adversely affecting
track attendance. It is believed that the fans feel that if no

beer will be sold at the track, they should have the right to
bring beer into the track.
By virtue of this request for authorization to sell beer and
wine coolers at the track, California Speedway is attempting
to strike a happy medium between safety concerns and the requests
of the speedway fans. If authorization is granted, California
Speedway believes that it can safely control both the sale and
use of alcohol at the racing events, while also insuring its
ability to generate sufficient fan interest to keep Speedway
racing viable in the City of Carlsbad. Speedway racing is a safe,
while exciting, form of family entertainment. California Speedway
wishes to continue this tradition by generating fan interest in
the County of San Diego.

SPECIFIC FACTS RELATI'NG TO
THE PROPOSED ACTION •
Service of beer and wine coolers
The kind of beer that would be sold would be the usual 3.2%
alcohol content beer, such as Budweiser or Miller. It would be
served draught style and sold in 16 ounce paper cups. The price
would be $2.00 per cup. No more than 2 beers would be sold to
any one customer at any given time. All potential beer purchasers
would be asked for their identifications. Once an identification
is produced showing that the person is over the age of twenty-one,
the right hand of the person would be stamped with a rubber
stamp—indicating that the person is over 21.
Wine coolers, wine mixed with soda or fruit juices, would also
be sold in the same fashion and under the same procedures indicated
for beer sales. The "California Cooler" brand wine cooler, or
the like, would be sold in paper cups.
The sale of beer and wine would take place between the hours
of 6:30 p.m. and roughly 9:15 to 9:30 p.m., depending upon the
duration of the speedway event. In no event would beer or wine be
cold during the last two scheduled events—approximately 15 minutes
before the conclusion of the event. "No fan would be permitted to
leave the track with alcohol. The policy of forbidding fans from
bringing alcohol into the track would be continued.
An an additional deterrent to consumption of alcohol by
minors, an undercover security person would roam the grandstand
area and check for a hand stamp on people consuming beer or wine
coolers. Any discovered alcohol consvimption by minors would draw

a warning for the first offense and exclusion from the track for
offenses thereafter. California Speedway does not condone the
use of alcohol by minors, nor will it tolerate such use—either
inside or outside the track.
Adequate restroom facilities exist at the speedway track.

SAFETY OF FANS
Track Construction
The speedway track is constructed in such a fashion so as to
completely separate spectators from participants. The fans
are not permitted to get near any of the riders or their motor-
cycles. The riders race on a dirt oval track completely sur-
rounded by a five foot "crashwall" constructed of 4" by 4"
beams and plywood. A rider could not possibly penetrate the
crashwall. In order to keep the spectators away from the crash-
wall, it is surrounded by a six foot high chain link fence.
In addition to the wall and fencing, the track is constructed
so that the spectators are always above the surface of the track,
The grandstand area is a minimum of eight feet above the track
at its lowest level. The "amphi-theater" a sloping grassy area
v/here the fans can watch the race while sitting in beach chairs
or on blankets, is a minimum of two feet above the surface of
the track. The elevation of the spectators is a safety concern
designed to insure that a motorcycle will never crash through
the crashwall and chain link fence and strike spectators, even
though this has never occurred in speedway racing.

Security
California Speedway maintains a security staff of 15 indi-
viduals each and every Sunday. The security company hired to pro-
vide security is known as Event Management, a company that has
handled security for all the major speedway tracks for the last
several years. Event Management is reknown for its ability to
control spectators and crowds at major events.
All security people, save one, are easily identified by their
bright orange windbreakers inscribed with the name Event Manage-
ment. The 15th security person, who is not easily identified
because he works under cover, is an off duty police officer who
walks around the track during each race to evaluate security and
traffic operations. He reports only to the officers of California
Speedway and is not associated with Event Management. He carries
a walkie-^talkie to relay information to others.
The 14 Event Management people basically stay.near the crowd.
When the spectators begin to arrive at the track, the security
people will be located outside the track—near the entrance and
the roads from the parking areas. As the spectators begin to enter
the track the security personnel locate themselves accordingly.
During the racing events, approximately 3 security personnel
remain outside of the track area, while the remaining 11 position
themselves inside the track. A diagram of the track illustrating
the placement of security people is attached.
The security people at the entrance to the track check all
people for icechests and alcohol, both of which are excluded from
the track. Plastics containers are permitted.

The basic policy of Event Management, and the policy followed
at the speedway track, is to avoid confrontation. Unruly fans
would simply be escorted to the track exit and asked to correct
their behavior or leave.
Security supervisors remain in constant contact v;ith other

Traffic Management
Traffic conditions are managed by a group of seven people
supervised by an off-duty fireman by the name of Stephen Logan
who has had years of security and traffic management experience.
The spectators begin to arrive at the track as early as 6:30 p.m.
The races start at 7:30 p.m. However, most of the fans enter the
track between 7:30 p.m. and 3:00 p.m. Spectators driving into
the Carlsbad Raceway facility must drive towards the speedway
track on a dirt access road, where they are greeted by the traffic
people. Cars are directed to parking areas, and parking spaces,
by the traffic people—who wear orange reflective vests and have
flashlights. Drivers are cautioned to drive safely through the
parking areas.
The traffic flow into the speedway facility is easily manage-
able due to the varied arrival times of spectators. Traffic person-
nel remain outside the race track at all times during the races,
remaining near the parking areas. The parking areas are patrolled
during the actual racing events. A constant surveilance is main-
tained over traffic conditions between the hours of 6:00 and 10:30
from a vantage point located above the speedway track. From the
vantage point, the traffic look out has a panoramic view of the
entire speedway track, the access road and the parking areas. Any
viewed problems or problem areas are relayed to other track person-
nel vis CB radio. The supervisor of traffic personnel also has
a DB radio link-up with towing companies, the fire department and
the police.

Tov;ards the conclusion of each Sunday race, the traffic
people assume positions so that the exiting crowd can be managed.
Flares and flashlights are used to guide spectators from the
parking areas out to Palomar Airport road, where 3 traffic people
safely direct cars to their easterly or westerly destination.

CONCLUSION
California Speedway requests approval from the City of
Carlsbad to sell beer and wine coolers at its Sunday evening
events. It is believed that the sale of alcohol at the speed-
way track can be adequately and safely controlled and regulated.
California Speedway operates a safe and professionally conducted
form of entertainment which people of all ages can enjoy. By
offering beer and wine coolers it can better compete with other
speedway tracks—and other sporting events for that matter.
With proper restrictions imposed, California Speedway would like
to join the ranks of other sporting events which serve beer along
with the other concessions offered to the people in attendance of
the events. Right or wrong, beer consumption at sporting events
is something that sporting fans have come to expect.

AO foot wide straightaways and banked turns.
The increased track width should allow for easier passing and
the banked turns should increase speed. Everyone agrees this track
is capable of producing some spectacular racing.
The season will open on April 14, at 7:30 p.m. and run for a full
twenty-six weeks. Caping off with what Rick and Paul hopes to become
the premier event in American Speedway the Grand Prix.

Bio of Rick Salvino and Paul Heffernan
Rick Salvino and Paul Heffernan are bringing the exciting sport
of speedway to Carlsbad California this year with the opening of the
fabulous new speedway track at the Carlsbad raceway.
Rick Salvino is the son of Ralph Salvino, one of racing's premier
f igureheads.
For the past fifteen years, Rick has worked for a number of major
sponsors on both the NASCAR and CART racing circuits.
He has been responsible for their contingency programs, developing
racing programs and taking care of racing teams product needs.
He recently spent a very successful racing season as Al Unser Jr.'s
press agent.
Rick brings with him to the sport of speedway, the professionalism
of auto racing, which he feels will enable California Speedway Inc.
to corner a large portion of the media's attention.
Paul Heffernan's involement with speedway has been throughout his
entire lifetime. As a rider, promoter, writer and personal manager
for many of the world's finest riders, his association with sponsors
draws many letters of recommendation.
