WITNESSETH: WHEREAS, Developer is the owner of the real property described on Exhibit "A:, attached hereto and made a part of this agreement, hereinafter referred to as "Property"; and WHEREAS, The Property lies within the boundaries of City; and WHEREAS, Developer proposes a development project as follows: REV 4-2-82 on said Property, wh^^ development carries the ^^jposed name of /^ro /rfefrok) kutAW and is hereafter referreds..*'o as "Development"; and WHEREAS, Developer filed on the 19 0^, with the City a request for l^tPt^ cJ*4iOf^-^ [J'^CL hereinafter referred to as "Request"; and WHEREAS, the Public Facilities Element of the City General Plan requires that the City Council find that all public facilities necessary to serve a development will be available concurrent with iteed or such development shall not be approved (said element is on file with the City Clerk and is incorporated by this reference); and WHEREAS, Developer and City recognize the correctness of Council Policy No. 17, dated April 2, 1982, in file with the City Clerk and incorporated by this reference, and that the City's public facilities and services are at capacity and will not be available to accommodate the additional need for public facilities and services resulting from the proposed Development; and WHEREAS, Developer has asked the City to find that public facilities and services will be available to meet the future needs of the Development as it is presently proposed; but the Developer is aware that the City cannot and will not be able to make any such finding without financial assistance to pay for such services and facilities; and therefore, Developer proposes to help satisfy the General Plan as implemented by Council Policy No. 17 by payment of a public facilities fee. -2- REV 4-2-82 NOW, THEREFORE, in consideration of the recTtals and the covenants contained herein, the parties agree as follows: 1. The Developer shall pay to the City a public facilities fee in an amount not to exceed 2% of the building permit valuation of the building or structures to be constructed in the Development pursuant to the Request. The fee shall be paid prior to the issuance of building or other construction permits for the development and shall be based on the valuation at that time. This fee shall be in addition to any fees, dedications or improvements required pursuant to Titles 18, 20 or 21 of the Carlsbad Municipal Code. Developer shall pay a fee for conversion o f existing building or structures into condominiums in an amount not to exceed 2% of the building permit valuation at the time of conversion. The fee for a condominium conversion shall be paid prior to the issuance of a condominium conversion permit as provided in Chapter 21.47 of the Carlsbad Municipal Code. Condominium shall include community apartment or stock cooperative. The terms "other construction permits", "other construction permit" and "entitlement for use" as used in this agreement, except in reference to mobilehome sites or projects, shall not refer to grading permits or other permits for the construction of underground or street improvements unless no other permit is necessary prior to the use or occupancy for which the development is intended. Developer shall pay to City a public facilities fee in the sum of $1,150 for each mobilehome space to be constructed pursuant to the Request. The fee shall be paid prior to the issuance of building or other construction permits for the development. This fee shall be in addition to any fees, dedications or improvements required according to Titles 18, 20 or 21 of the Carlsbad Municipal Code. -3- REV 4-2-82 2. The Developer may offer to donate a site or sites for public facilities in .lieu of all or part of the financial obligation agreed upon in Paragraph 1 above. If Developer offers to donate a site or sites for public facilities, the City shall consider, but is not obligated to accept the offer. The time for donation and amount of credit against the fee shall be determined by City prior to the issuance of any building or other permits. Such determination, when made, shall become a part of this agreement. Sites donated under this paragraph shall not include improvements required pursuant to Titles 18 or 20 of the Carlsbad Municipal Code. 3. This agreement and the fee paid pursuant hereto are required to ensure the consistency of the Development with the City's General Plan. If the fee is not paid as provided herein, the City will not have the funds to provide public facilities and services, and the development will not be consistent with the General Plan and any approval or permit for the Development shall be void. No building or other construction permit or entitlement for use shall be issued until the public facilities fee required by this agreement is paid. 4. City agrees to deposit the fees paid pursuant to this agreement in a public facilities fund for the financing of public facilities when the City Council determines the need exists to provide the facilities and sufficient funds from the payment of this and similar public facilities fees are available. 5. City agrees to provide upon request reasonable assurances to enable Developer to comply with any requirements of other public agencies as evidence of adequate public facilities and services sufficient to accommodate the needs of the Development herein described. -4- REV 4-2-82 6. All obligations hereunder shall terminate in the event the Requests made by Developer are not approved. 7. Any notice from one party to the other shall be in writing, and shall be dated and signed by the party giving such notice or by a duly authorized representative of such party. Any such notice shall not be effective for any purpose whatsoever unless served in one of the following manners: 7.1 If notice is given to the City of personal delivery thereof to the City or by depositing same in the United States Mail, addressed to the City at the address set forth herein, enclosed in a sealed envelope, addressed to the City for attention of the City Manager, postage prepaid and certified. 7.2 If notice is given to Developer by personal delivery thereof to Developer or by depositing the same in the United States Mail, enclosed in a sealed envelope, addressed to Developer at the address as may have been designated, postage prepaid and certified. 8. This agreement shall be binding upon and shall inure to the benefit of, and shall apply to, the respective successors and assigns of Developer and the City, and references to Developer or City herein shall be deemed to be reference to and include their respective successors and assigns without specific mention of such successors and assigns. If Developer should cease to have any interest in the Property, all obligations of Developer hereunder shall terminate; provided, however, that any successor of Developer's interest in the property shall have first assumed in writing the Developer's obligations hereunder. 9. This agreement shall be recorded but shall not create a lien or security interest in the Property. When the obligations of this agreement have been satisfied. Developer proposes to help satisfy the General Plan as implemented by Council Policy No. 17 by payment of a public facilities fee. NOW, THEREFORE, in consideration of the recitals and the covenants contained herein, the parties agree as follows: REV 4-22-86 t 1. The Developer shall pay to the City a public facilities fee in an amount not to exceed 2.5% of the building permit valuation of the building or structures to be constructed in the Development pursuant to the Request. The fee Shall be paid prior to the issuance of building or other construction permits for the development and shall be based on the valuation at that time. This fee snail be in addition to any fees, dedications or improvements required pursuant to Titles 18, 20 or 21 of the Carlsbad Municipal Code. Developer shall pay a fee for conversion of existing building or structures into condominiums in an amount not to exceed 2.5% of the building permit valuation at the time of conversion. The fee for a condominium conversion shall be paid prior to the issuance of a condominium conversion permit as provided in Chapter 21.47 of the Carlsbad Municipal Code. Condominium shall include community apartment or stock it cooperative. The terms "other construction permits", "other construction permit" and "entitlement for use" as used in this agreement, except in reference to mobilehome sites or projects, snail not refer to grading permits or other permits for the construction of underground or street improvements unless no other permit is necessary prior to the use or occupancy for which the development is intended. Developer shall pay the City a public facilities fee in the sum of $1,150 for each mobilehome space to be constructed pursuant to the Request. The fee shall be paid prior to tne issuance of building or other construction permits for the development. This fee shall be in addition to any fees, dedications or improvements required according to Titles 18, 20 or 21 of the Carlsbad. Municipal Code. 2. The Developer may offer to donate a site or sites for public facilities in lieu of all or part of the financial obligation agreed upon in Paragraph 1 above. If Developer offers to donate a site or sites for public -3- REV 4-22-86 f facilities, the City shall consider, but is not obligated to accept the offer. The time for donation and anount of credit against the fee shall be determined by City prior to the issuance of any building or other permits. Such determination, when made, shall become a part of this agreement. Sites donated under this paragraph snail not include improvements required pursuant to Titles 18 or 20 of the Carlsbad Municipal Code. 3. This agreement and the fee paid pursuant hereto are required to ensure the consistency of the Development with the City's General Plan. If the fee is not paid as provided herein, the City will not have the funds to provide public facilities and services, and the development will not be consistent with the General Plan and any approval or permit for the Development shall be void. No building or other construction permit or entitlement for use shall be issued until the public facilities fee required by this agreement is paid. 4. City agrees to deposit the fees paid pursuant to this agreement in a public facilities fund for the financing of public facilities when the City Council determines the need exists to provide the facilities and sufficient funds from the payment of this and similar public facilities fees are available. 5. City agrees to provide upon request reasonable assurances to enable Developer to comply with any requirements of other public agencies as evidence of adequate public facilities and services sufficient to accommodate the needs of the Development herein described. 6. All obligations hereunder snail terminate in the event the Requests made by Developer are not approved. REV 4-22-86 t 7. Any notice from one party to the other shall be in writing, and shall be dated and signed by the party giving such notice or by a duly authorized representative of such party. Any such notice shall not be effective for any purpose whatsoever unless served in one of the following manners: 7.1 If notice is given to the City of personal delivery thereof to the City or by depositing same in the United States Mail, addressed to the City at the address set forth herein, enclosed in a sealed envelope, addressed to the City for attention of the City Manager, postage prepaid and certified. 7.2 If notice is given to Developer by personal delivery thereof to Developer or by depositing the same in the United States Mail, enclosed in a sealed envelope, addressed to Developer at the address as may have been designated, postage prepaid and certified. 8. This agreement snail be binding upon and shall ensure to the benefit of, and snail apply to, the respective successors and assigns of Developer and the City, and references to Developer or City herein shall be deemed to be reference to and include their respective successors and assigns without specific mention of such successors and assigns. If Developer should cease to have any interest in tne Property, all obligations of Developer hereunder shall terminate; provided, however, that any successor of Developer's interest in the property shall have first assumed in writing the Developer's obligations hereunder. 9. This agreement shall be recorded but shall not create a lien or security interest in the Property. When the obligations of this agreement have been satisfied. The basic gasoline storage, dispensing, and vapor recovery equipment is to consist of: One (1) 10,000 gallon storage tank (new) for Premium gasoline with one (1) dispensing nozzles, One (1) 10,000 gallon storage tank (new) for Regular gasoline with three (3) dispensing nozzles. One (1) 10,000 gallon storage tank (new) for Unleaded gasoline with four (4) dispensing nozzles, a two point Phase I gasoline storage tank vapor control system and an OPW Balance Phase II vehicle fueling gasoline vapor control system. This Authority to Construct is issued subject to the following conditions: 1. A copy of this Authority to Construct letter shall be posted or kept readily available at the above specified facility until the District issues the Permit to Operate. 2. The applicant shall notify the District (Walt Geudtner, 565-5419) within ten working days following the vapor recovery installation that construc- tion has been completed. Failure to notify the District automatically cancels the temporary authorization to operate that is incorporated into this Authority to Construct letter. The Phase I system shall be constructed in accordance with the "Two-Point Stage 1 Vapor Recovery System" drawing and shall use components specified in ARB Executive Order (E.O.) G-70-97-A. Each submerged fillpipe shall have the highest point of its discharge opening no more than six inches from the tank bottom. 4. The-Pfiase II vapor control system shall be constructed and installed in accordance with ARB E.O. G-70-36-AB. An alternative high hose arrangement of E.O. G-70-^-AH, Exhibit 5 is required. 5. 7-Eleven'Food Store's vapor plumbing and tank location drawings G-1 and G-4 received on October 28, 1986, represent and describe the vapor recovery system at the above specified facility, except as modified by conditions herein. 6. Each OPW gasoline nozzle shall limit the dispensing flow rate to 10.0 gal/min (maximum). 7. The OPW gasoline dispensing nozzle(s) shall be either the UV-C coaxial nozzle with an Emco Wheaton A92 or A93 coaxial island swivel, or the IIV-F coaxial nozzle with the OPW 119-A flow valve and the 119-B vapor valve. 8. Dispenser vapor pipe risers connected to receive vapor from two nozzles shall be one (1) inch inside diameter (minimum). 9. The gasoline product and vapor return hoses shall all be coaxial. 10. Upon request of the District the applicant shall provide access, facilities, utilities, and any necessary safety equipment, for vapor control system testing and inspection. 11. The applicant shall have the following tests performed in accordance with recommended District procedures and provide this office with the results: a. a liquid blockage test of all vapor piping from each dispenser's plumbing to the underground tank to ensure adequate line slope and liquid drainage, including verification by listening or other means that the test liquid returns to the correct product tank (per Test Procedure TP-79-2-A). b. a pressure drop vs. flow test from each nozzle to its associated underground tank. This test is to include nozzle, hose, associated fittings, piping and storage tanks and shall be performed with only the same product's tank vapor dry break valve open and all vent pipes temporarily closed during this test (per Test Procedure TP-79-3-B). c. a pressure decay/leak test of the entire vapor control system includ- ing nozzles and underground tanks (per Test Procedure TP-79-4-B). • ' -The Southland CorpoW^( The Southland Corpo^Rion October 30, 1986 Application No. 860375 d. a maximum dispensing flow rate determination for at least one nozzle, to be selected by the District, for each gasoline product. The District may select additional nozzles for testing if flow rates are near the maximum allowable. If the tests listed above reveal system problems or inadequacies, correc- tive repairs shall be made. Repeat testing or additional diagnostic test- ing may be required by the District to assure that the system is function- ing properly. Contact the District by telephone (Walt Geudtner, 565-5419) at least 24 hours prior to conducting these tests so that they may be witnessed by a District representative. 12. Upon installation of the Phase II system authorized herein. The Southland Corporation or its agent shall have the installer demonstrate to the site operator that the system/nozzles will dispense gasoline without diffi- culty, shall instruct the site operator and employees in the proper opera- tion and maintenance of the Phase I and Phase II control equipment, and shall inform the site operator where repair and replacement parts may be readily obtained. This Authority to Construct does not relieve the holder from obtaining permits or authorizations which may be required by other governmental agencies. Con- tact the appropriate building inspection department (city or county) and fire district prior to installation of the vapor control equipment, for permit and/or inspection requirements. Within ten days after receipt of this Authority to Construct, the applicant may petition the Hearing Board, in accordance with Rule 25, for a hearing on any conditions imposed herein. This is not the Permit to Operate document. Operation of this equipment without written authority (District Permit to Operate, Startup Authorization, Authority to Construct or Hearing Board Variance, etc.) will be in violation of Rule 10(b) and will be subject to civil and criminal penalties. This Authority to Construct document authorizes temporary operation of the above specified facility, to commence upon receipt by the District of notifi- cation of completion of construction. This authorization will be in effect, unless cancelled, until the facility is inspected by the District for a Permit to Operate. If the facility passes inspection, written authorization will be given for continued operation and will be followed by issuance of the Permit to Operate document. If during a Permit to Operate inspection there are obvious deficiencies such as torn nozzle bellows, flattened vapor return hoses, etc., the District may deny the Permit to Operate or, depending on the extent of the deficiencies, require you to make repairs within a specified period of time. If the repairs are not made by the date of the reinspection, your Permit to Operate may be denied. PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting a conditional use permit to remove an existing gas station from the southeast corner of Palomar Airport Road and Paseo Del Norte and to replace it with a new 7-Eleven Pood Store which includes a drive-through gas island. The proposed 7-Eleven Food Store is allowed on the subject property by right. However, the drive through gas island requires a conditional use permit. The project applicant is also proposing a lot line adjustment as part of the application. As shown on Exhibit "A", this lot line adjustment would reduce the size of Parcel 2 (the parcel upon which the new 7-Eleven and gas island are proposed) from .67 acre to .56 acre. The adjoining parcel to the south (Parcel A) upon which an existing 7-Eleven is located, would be increased in size from .34 acre to .45 acre. The 7- Eleven Food store currently located upon Parcel A would be closed down and at a later date the parcel would be developed with some other use, such as a restaurant. Implementation of this proposed project would also reduce the number of driveways from Paseo Del Norte onto the property from three to one, and would realign the single existing driveway to the property from Palomar Airport Road. These changes will reduce conflicting traffic movements associated with access to the property. The new 7-Eleven store proposed would be a single story structure, 3,072 square feet in area. The architecture for the proposed 7- Eleven store will be composed of light colored stucco with a red tile roof. The appearance of the structure has been enhanced through the incorporation of raised facade and tiled planter architectural features along the north and west elevations. The proposed gas island will include an aisle of gasoline pumps, with a 952-square foot canopy. The gas island will be composed of similar architectural materials as the 7-Eleven Store. Thirteen parking spaces will be provided on Parcel 2 in compliance with the City's revised parking standards for retail uses. The parking lot for the adjacent property to the south (Parcel A) will be redesigned to accommodate 24 parking spaces. Although no new use is currently proposed for this parcel, it is felt by staff that this number of parking spaces will be within the realm of adequacy for any future proposed travel service use. The project site is currently developed with an "out of business" Areo Service station (Parcel 2) and a 7-Eleven Food store (Parcel A). The property to the north is vacant and in agricultural use (flower fields). Pea Soup Andersen's is located northwest of the project site. Alfredo's Restaurant is located south of Parcel A. Nurseryland is located east of the property and a Mobil Service Station is located to the west. III. ANALYSIS Planning Issues 1) Is the proposed use compatible with surrounding existing uses? 2) Can the four findings required for the granting of a conditional use permit be made, which are as follows: a) That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the General Plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located; b) That the site for the intended use is adequate in size and shape to accommodate the use; c) That all of the yards, setbacks, walls, fences, landscaping and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained; d) That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use? DISCUSSION The subject property currently is developed with an "out of business" Areo Service Station (Parcel 2) and an existing 7- Eleven (Parcel A). In that the proposed use would be similar and in some ways identical to these existing uses, compatibility with surrounding uses is assured. -2- As proposed, the 7-Eleven Food store with drive-through gas island meets all of the four findings required for the issuance of a conditional use permit. The Land Use Element of the Carlsbad General Plan identifies the need for locating a full range of visitor service commercial uses, including hotels, gas stations, restaurants and convenience stores, within designated Travel Service areas. Not only will this proposed convenience store/gas island service tourists staying at any of the hotel sites within the project vicinity, but it will also provide convenience commercial facilities for (1) residential communities, such as Alta Mira, which is located approximately 3,000 feet south of the site along Paseo Del Norte, and (2) business and industrial areas located along Palomar Airport Road. The requested use is also desirable for the development of the community. The project area already has two gasoline station facilities including the Mobil Station across Paseo Del Norte to the west and the Exxon Station at Pea Soup Andersen's to the northwest. However, in that the project area is one of the most popular, and heavily used visitor serving commercial areas in Carlsbad, it is felt by staff that this proposed use would contribute positively to the community. It is also noted here, that since there are only three gasoline facilities within all of southwest Carlsbad, this proposed facility may satisfy a more regional need. As noted earlier, implementation of this project will reduce the number of driveways from the property onto Paseo Del Norte and Palomar Airport Road. With this consolidation of driveways, conflicting traffic movements will be reduced. Implementation of this project will also result in the removal of the existing debilitated Areo Service Station and a revitalization of the unmaintained property. Based upon these anticipated improvements, it is concluded by staff that the proposed use would not have a detrimental effect, but would instead have a positive effect on existing or proposed future uses. The site appears to be adeguate in size and shape to accommodate the proposed use. As shown on Exhibits "A", - "D", all of the applicable setbacks, walls, landscaping and parking spaces necessary to adjust the requested use to existing and future uses in the neighborhood will be provided and maintained. With the consolidation of the driveways from Paseo Del Norte and Palomar Airport Road onto the property, conflicting turning movements into and out of the site will be reduced. As shown on Exhibit "A", all turning movements to the site along Palomar Airport Road will be right-in and right-out only. The subject property is located within an area of Carlsbad that has fully developed public streets which should be adequate to handle the traffic generated by the proposed use. Overall, staff can make the four findings required to grant a conditional use permit and feels that the proposed project would be compatible with surrounding uses, therefore, recommends approval of Conditional Use Permit 284. -3- IV. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not have a significant impact on the environment and, therefore, has issued a Negative Declaration on June 18, 1986.
