The following comment has not been reviewed by the SANDAG Board of Directors as the Airport Land Use Commission. The parcel is north of amd adjacent to McClellan-Palomar Airport. The building in which the day care center would be located is about 140-150 feet from the airport boundary. At least part of the site (closest to the airport) lies within the C2 Limited Crash Hazard, Moderate Noise Impact Area of the existing CLUP. No new school would be permitted. One crash has occurred within the vicinity of the site. Additionally, the current (1984) noise contours show that the area lies within the 60-65+ CNEL. It will be within the 70 CNEL in the future (est. 2000) whether the jet mix is 3% or 5%. Johnson, Jr, NorthUlMCrest Ms. Lynn Fitzgerald January 30. 1986 City of Carlsbad Planning Board Carlsbad, California Dear Ms. Fitzgerald, It was very nice of you to spend so much time with us concerning our proposal for a new pre school-day care center at Allenbach Industries in the Carlsbad Research Center. We have enclosed several things to share with you. Our North Crest Preschool brochure outlines our philosophy of education. We are not only hoping to provide the very best of care for children ages 2 to 5 "but also an extremely fine program in readiness and pre school curriculum. We plan to exceed the requirements of the State Licensing regarding teacher=student ratio and equipment. We have addressed several of the issues that you presented to us. We have definitely agreed to preserve the turning curve and exclude that from our proposed playground area. We have a sketch of the proposed playground area to show you. Regarding the amountfl; of parking places, we have worked out the formula which you gave us. Allenbach Industries has ^5»000 square feet in their building. Using your formula, 6ofo of the building would be assessed industrial and this would be 27*000 square feet, with 1 parking space for every ^00 square feet. This would be 67 parking spaces. There would be kOfo of the building assessed as business, with 1 parking space for every 3OO square feet. This would be 18,000 square feet and would need 60 parking spaces. In other words, the 60% industrial would need 67 spaces and the ^0% business would need 60 spaces. This totals 127 spaces. Allenbach Industries presently has 16^ parking spaces. If we were to have our pre school playground, we would be using 6 parking spaces. This would leave 158 for Allenbach Industries, well within the regulations. We would also designate the two or three parking spaces close to the playground gate as "Reserved for Pre School Parents". This would be where the parents would park to drop off and picS: up their children. It is the regulations of the State and our school that all children must be signed in and out and so parents must accompany their children across the fenced playground and into the schoolroom. We also discussed landscaping. Presently there is an area whihh has in it four eucalyptus trees and many bushes. The State Evaluator was uncertain about these bushes as they may be poisonous. We agreed to take out the bushes and plant grass so that the children could have picnic and playing areas, under the trees. The landscaping, complete with raised planting beds, would remain the same. We are enclosing a photo of the playground structure and a similar picture of it. This was already installed in the proposed playground at the time when we thought all clearances had already been obtained from the City of Carlsbad, as we had been told by Kathleen Allenbach. The structure is not in use at the present time because there is no sand under it since we do not have the fence yet. We are awaiting your decision before putting in a fence or doing anything further. The actual playground structure has three toddler seat swings. It is very high quality, very attractive and made by Playtime, Inc. We are really eqgerly anticipating any imput from all the planners and truly appreciate your presenting our project at your weekly meeting. I. RECOMMENDATION That the Planning Commission ADOPT Resolution No. 2559 DENYING CUP-287 based on the findings contained therein. II. PROJECT DESCRIPTION The applicant is requesting approval of a conditional use permit to allow a 2,200 square foot day care center within the southeast corner, along the ground floor of the 44,904 square foot Allenbach Industries building located as described above. The day care center is currently operating at this location without a permit. The project includes 2,200 square feet of indoor classroom area and an outdoor playground which is located east of the classroom and within the Allenbach Industries parking lot. The outdoor playground includes a high quality, wooden playground structure with swings and slide. This playground is currently unfenced and is illegally located within the required parking area for Allenbach Industries. The applicant has indicated that the playground facility is not in use at the present time, but that if this conditional use permit were approved, the playground would be fenced and the existing blacktop within the play area would be removed and replaced with sand. The subject property is designated Planned Industrial (PI) and zoned Heavy Commercial/Limited Industrial (CM). Existing or proposed industrial uses are located to the north, east and west of the property and Palomar Airport is located immediately south of the site and within 140 feet of the proposed use. III. ANALYSIS 1) Can the required findings for approval of a conditional use permit be made? Specifically: a) That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the General Plan and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. b) That the site for the intended use is adequate in size and shape to accommodate the use. c) That all of the yards, setbacks, walls, fences, landscaping and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained. d) That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. DISCUSSION As discussed earlier in this report, the proposed day care center is already operating within the Carlsbad Research Center without permit approval. According to the applicant, and representatives of Allenbach Industries, the day care center provides a convenient and necessary service for employees with children who work within this industrial park. Staff agrees that day care centers are desirable uses within or near major employment projects. But, it is also staff's opinion that not all employment centers, and in particular, industrial parks are acceptable locations for day care centers due to potential health and safety concerns. Staff has serious concerns about locating a day care center in this industrial area. One of the purposes of zoning is to separate incompatible land uses, thereby, ensuring the preservation of public health and safety. The CM zone and the Koll Specific Plan allow for industrial uses. Locating a day care center at this particular site, where potential industrial processes are in operation is contradictory to this goal and to the intent of the General Plan regarding industrial uses. The General Plan states as a policy that we should "protect areas designated for industrial uses from encroachment by nonindustrial uses". The Carlsbad Fire Department is recommending denial of the proposed day care center because of the close proximity of this sensitive use to industrial processes (see Memo dated, March 12, 1986). The presence of a day care facility among structures -2- housing industrial or manufacturing processes raises concern associated with the exposure of children to the hazards of fires, chemical spills and gas releases, all of which might be expected to occur in such an industrial setting. (Several major occurrences have taken place in San Diego Industrial parks within the last year. One recent explosion/fire caused eight deaths in California). In addition to this concern expressed by staff, the San Diego Association of Governments Special Projects Director has reviewed the proposed project and is recommending denial of this proposal by the SANDAG Airport Land Use Commission, based upon the fact that the project site is partially located within a Limited Crash Hazard and Moderate Noise Impact Area of Palomar Airport. Per the Palomar Airport Land Use Plan, the proposed use would not be permitted at this location (see letter dated, March 21, 1986). As noted in this letter, one crash has already occurred within the vicinity of the site. Overall, staff believes that the proposed project would not be a compatible use within this light industrial setting because of potential safety reasons associated with industrial uses allowed within the CM zone and because of the site's location within crash and noise hazard influence areas of Palomar Airport. The following comment has not been reviewed by the SANDAG Boaurd of Directors as the Airport Lcmd Use Commission. The peircel is north of and adjacent to McClellam-Palomar Airport. The building in which the day care center would be located is about 140-150 feet from the airport boundary. At least part of the site (closest to the airport) lies within the C2 Limited Crash Heuzard, Moderate Noise Impact Area of the existing CLUP. No new school would be permitted. One crash has occurred within the vicinity of the site. Additionally, the current (1984) noise contours show that the area lies within the 60-65+ CNEL. It will be within the 70 CNEL in the future (est. 2000) whether the jet mix is 3% or 5%.
