III. PROJECT DESCRIPTION AND BACKGROUND On July 30, 1986, the Planning Commission approved CUP 294 allowing the City of Carlsbad Community Development offices at 2075 Las Palmas in the P-M zone. CUP 294x1 was approved on July 17, 1991 extending the permit for five years through July 17, 1996. Condition No. 2 of the approving CUP Resolution No. 3263 specifies that CUP 294x1 is granted for a period of 5 years but may be extended upon written application of the permittee (City of Carlsbad). The applicant is requesting a 5 year extension of CUP 294x1 to allow the City's Community Development offices to continue to operate at this site. IV. ANALYSIS A. The City of Carlsbad Community Development facility continues to be consistent with all applicable plans, policies and regulations described below: 1. Carlsbad General Plan; 2. PROJECT DESCRIPTION AND BACKGROUND The City is requesting the extension of a Conditional Use Permit allowing the Community Development offices in the Palomar Business Park in the Planned Industrial (PM) Zone. Although Govenmient office uses are permitted by right in the PM Zone, public buildings in any zone require approval of a conditional use permit which allows periodic review by the Planning Commission to ensure the compatibility of the use and facility with surrounding uses. Notable changes in circumstances during the past five years include the City's purchase of Community Development facility and the development of Hawthorne Machinery on the adjacent parcel. Some of the Commumty Development facility's parking is provided on the Hawthorne parcel through a Joint Parking Agreement. Six of the spaces are reserved for Hawthorne employees leaving a total of 119 spaces for City employees and visitors and since the parking standard for offices requires 91 spaces a surplus of 28 spaces exist. in. ANALYSIS Planning Issues Can the findings required for a Conditional Use Pennit still be made? Namely: CUP 294x1 - CITY OF CARLSBAD (LAS PALMAS) JULY 17, 1991 PAGE 2 1. Is the use necessary and desirable for the development of community, essentially in harmony with the various elements and objectives of the General Plan, and not detrimental to existing uses or uses specifically permitted in the area? 2. Is the site adequate in size and shape to accommodate the use? 3. Can all yards, fences, landscaping, and other features necessary to adjust the use to existing or permitted future uses in the neighborhood be provided and maintained? 4. Is the street system serving the use adequate to handle all traffic generated by the use? DISCUSSION The Community Development offices continue to be necessary and desirable for the development of the community since all land use permits are processed by the Planning, Engineering, and Building Departments occupying this facility. The facility is consistent with the General Plan since it is included in the existing inventory of City Administrative facilities which are required by Growth Management. The use continues to be compatible with surrounding office uses since adequate parking is provided onsite to accommodate employees and visitors. The site is adequate in size and shape to accommodate the use. As previously mentioned, some of the required parking is provided on the Hawthorne parcel adjacent to the Community Development facility. In November, 1989, the provision of this parking was formalized through a Joint Parking Agreement between the Hawthorne Family Trust and the City of Carlsbad in which a parking and maintenance easement was granted to the City. This easement remains valid as long as the City occupies the building. The required landscaping around the Community Development facility has been provided and maintained. Outdoor employee eating areas have been proAnded at the front and rear of the building. The Community Development facility is served by Las Palmas Drive, an industrial collector, and Camino Vida Roble, a secondary arterial. These streets continue to operate at acceptable levels and are adequate to handle traffic generated by this use. In summary. Staff concludes that the use continues to be desirable for the development of the community and is not detrimental to sunounding office and/or industrial uses. The site continues to adequately accommodate the Community Development facility, and the street system serving the project continues to adequately handle all of the traffic generated by the use. The existing Building, Engineering, Planning and Utilities and Maintenance facilities are inadequate to serve the City's existing and future population. The proposed facility will be centrally located and large enough to provide adequate service to all four quadrants of the City. The site is adequate in size and shape to accommodate the proposed use. The site is large enough to accommodate all of the required parking onsite and still provide for substantial landscape areas. All of the yards, setbacks, and landscaping necessary to adjust this use to existing or permitted future uses in the area have already been provided as conditions of approval of the existing building. The office use proposed is compatible with surrounding uses. The street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. This facility has direct access onto Las Palmas Drive, an industrial collector. In conclusion, all four findings required for the approval of a conditional use permit can be made, therefore, staff recommends approval of CUP-294. IV. ENVIRONMENTAL REVIEW The Planning Director has determined this project will not have a significant impact on the environment and, therefore, has issued a Negative Declaration on July 12, 1986.
