On June 10,i9S6, the Encina Water Poilution Control Facility was contacted and asked to consider allowing Borroughs Corporation to discharge groundwater con- taminated with chlorinated hydrocarbons into the municipal sewerage collection system operated by the City of Carlsbad which ultimately discharges to Encina. The groundwater had a reported hydrocarbon content greater then 1.5 mg/1. After a review of appropriate regulations, and contact with the City of Carlsbad it has been determined that Encina is unable to accept the groundwater in queston due to its level of contamination. Specifically, Ordinance 7060, Title 13, Chapter 13.0'f.050 of the Carlsbad Municipal Code prohibits the discharge into municipal sewers of wastes containing in excess of .02 mg/1 total iden- tifiable chlorinated hydrocarbons. Aside from the discharge limitations imposed by the City of Carlsbad, there are several other issues that were considered in the decision to not accept waste flows resulting from Industrial accidents or spills. Among these were: 1. EPA Restrictions on Publically owned Treatment Works (POTW's) - wastes resulting from the clean-up of toxic material spills are not listed as allowable disharges under the "GENERAL PRE-TREATMENT REGULATIONS" (40 CFR 403). 2. Impacts on Facility/Member Agencies Flow Capacity - the stated discharge rate of 25 gallons per minute is a flow equivalent to that from 170 domestic households. 3. The tank was removed in 19 82, but residual amounts of chlorine remain. Burroughs asked to dispose of pumped ground water through the sewer system which has been refused. The sample was analyzed for volatile organic contaminants using combined gas chroma- tography-mass spectrometry according to EPA Method 624, purge and trap. Results for compounds on the EPA Hazardous Substances List are given on the enclosed sum- mary sheets. The sample was also digested with acid and analyzed by Atomic Absorption Spectros- copy. The results are listed in Table I. Also the sample was analyred for PCB's on a Varian 3700 gas chromatograph equipped with an electron capture detector. The liquid sample was prepared by extracting approxi- mately 1 gram of the sample with lO.Omls of pesticide quality hexane and shaken for 30 minutes. The liquid e^tr-act was purified several times with a sulfuric acid and mercury pro- cedure. No Florisil clean-up was necessary. Fatalities following severe acute exposur to various chlorinated solvents have been attributed to ventricular fibrillation. Eye/Skln: Liquid splashed in the eye can result in discomfort, pain and irritation. Prolonged or repeated contact with liquid on the skin can cause irritation and dermatitis. The problem may be accentuated by liquid becoming trapped against the skin by contaminated clothing and shoes, and skin absorption can occur. Attached are copies of the Burroughs (Memorex) Westlake groundwater clean- up APCD, NPDES and Building permits. Only an Electrical Permit was required by the County of Los Angeles to construct the Westlake solvent stripping tower system. No notices or conditions of any kind were required on the Building permit due to the very low amounts of solvents which would be discharged to the atmosphere (approximately 1 pound/day). The San Diego APCD has approved Burroughs Carlsbad groundwater clean-up procedure and has granted Authority to Construct (Please see attached copy). The APCD Permit allows for daily emissions up to 1.22 pounds/day of purgeable halocarbons. This would be a worst case scenario and the average daily emissions are not expected to exceed 0.6 pounds/day. Again, these are extremely low concentration emissions whicn will have no adverse effect on the surrounding community. Burroughs existing APCD permits for its manufacturing operations allow daily solvent emissions up to 100 pounds/day and actual 1985 emissions averaged approximately 86 pounds/day. With recent reductions in Burroughs Carlsbad manufacturing operations, solvent usage and emissions have been reduced by approximately fifty percent. Operation of tne solvent stripping tower will have no significant impact on total emissions from the Burroughs facility and will not pose any undue health risks to the surrounding community. Chapman College classes at the Carlsbad location would begin at 5:30 p.m. and end at 10:45 p.m. during the week. Occasional Sat- urday classes would be held beginning at 9 a.m. and ending at 5 p.m. The maximum number of occupants in the facility per evening would be 64 occupants ( 60 students, maximum 20 per class, three professors and one staff member). It should be noted, however, that the average Chapman College class size is 10-12 students, so that a more typical number of occupants each evening would be about 40 . We believe the numbers of students can be readily accommodated by the facility, and that parking and access would not be negatively impacted given the hours our programs operate and the numbers of students involved. A localized groundwater contamination problem associated with diemical solvents (TCE, DCE and freon) was identified during a site investiga- tion. Hie source of the solvents is attributed to leaking underground storage tanks. « . 5. The contaminated ground water will be treated for the removal of volatile organic compounds using a Counter-current, pacted tower, air stripping systen. Two towsrs in series have been designed to treat up to 100 gpm of contaminated water from the shallow groundwater aquifer. Federal law stipulates that all NPDES Pennits require the inpleroenta- tion of best available technology economically achievable. Should contaminated levels in treated wastewater exceed permit specifications, altemative disposal or a modified treatment system with substantiating effluent analysis will be required. 7. Wastewater frem this facility-will be discharged to a lined stonn drain adjacent to Ventura Freeway on the South Side of the property. The wastewater will then flow to Lindero Canyon Qiannel and thence to Wtestlake Lake, a water of the United States. Ifestlake Lake is tribu- tary to Pacific Ocean via Malibu Creek. 8. Hie Board adopted a Revised Water Quality Control Plan for the los Angeles River Basin on November 27, 1978. The plan contains water quality objectives for surface waters of los Angeles River Basin, including Malibu Creek. The requirements contained in this Order, as they are met, will be in conformance with the goals of the Water Quality Control Plan. 9. L RECOMMENDATION That the Planning Commission ^OPT Planning Commission Resolution 3288 APPROVING a four year extension of CUP 299 based on the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION AND BACKGROUND On March 4, 1987, the Planning Commission approved a Conditional Use Permit allowing a Chapman College extension facility to conduct evening classes in an existing office building located at 5411 Avenida Encinas in the PM Zone. The Conditional Use Permit was conditioned to expire in three years unless an extension was requested and approved by the Planning Commission. Over the past months, the Planning Department has created a monitoring program to track projects conditioned v^dth expiration dates. This program has identified a number of expired conditional use pemiits. In order to allow the extension of those conditional uses still in operation or existence, the Planning Department has given property owners the opportunity to request extensions of the expired conditional use permits. After notification by Staff, the applicant has requested a three (3) year extension which is the maximum time allowed by the Conditional Use Permit. III. ANALYSIS Planning Issues Can the findings required for a Conditional Use Permit still be made? Namely, 1. Is the evening college necessary and desirable for the development of the community, essentially in harmony with the various elements and objectives of the General Plan, and not detrimental to existing uses specifically permitted in the area? Can all yards, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood be provided and maintained; 4. That the street system serving the proposed use continues to be adequate to properly handle all traffic generated by the proposed use. DISCUSSION Chapman Evening College is necessary and desirable for the development of the community by offering evening college courses to local residents and is compatible with other uses in the area since classes are held during evening hours to avoid any traffic or parking conflicts with permitted uses operating during the day. No complaints have been received by the Planning Department or Code Enforcement during the past four years. The site is adequate in size and shape to accommodate the evening college which utilizes an existing office building and requires no physical changes to the site or structure. No changes to the use or facility have occurred and all conditions imposed by the Conditional Use Permit to adjust and use to existing or permitted future uses have been implemented. The street system serving the project, which operates at acceptable levels, is adequate to handle the traffic generated by the evening college. Condition No. 3 of Resolution No. 2645 approving CUP 299 states that the Planning Commission may grant extensions not to exceed three years. To extend CUP 299 for three additional years, it is necessary to grant extensions totaling 4 years. The first year extension is retroactive from March 4, 1990 through March 4, 1991, and the second three year extension will allow the subject use to continue through March 4, 1994. SUMMARY The original Conditional Use Permit had an expiration date of March 4, 1990, however, due to the special extension procedure explained above, the Planning Commission has the ability to accept the Conditional Use Permit as valid and extend CUP 299x1 for four and one half (4 1/2) years. Chapman College is a liberal arts college which has a main campus in Orange County, and a regional center at Camp Pendleton. Prom an operational standpoint, the Carlsbad facility would consist of three classrooms and administrative offices. Classes would be held in the evenings and on Saturdays. An average class size is 10 - 12 students. Until a CUP is granted, classes are being held in meeting rooms at the Travelodge. The administrative offices are open at the project location. The Ocean Pointe Tech Center is located next to Burrough's Corporation in the P-M zone. The complex consists of five buildings. Chapman College would locate on the second floor of building "A" (see Exhibit A), which fronts on Avenida Encinas. The Center is presently leased by R & D and general office users. None of the current lease holders use hazardous materials. In a related case, staff and the Planning Commission recommended denial of a church in an industrial zone near the airport, CUP-272. This application was approved by the City Council on appeal. Ill. PLANNING ANALYSIS 1 . Can the findings be made for granting a Conditional Use Permit, that is: (1) That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the general plan, and is not detrimental to existing uses, or to uses specifically permitted in the zone in which the proposed use is to be located; (2) That the site for the intended use is adeguate in size and shape to accommodate the use; (3) That all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained; (4) That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. Discussion; CUP Findings The proposed use, i.e. an evening college, would be desirable in the community. Chapman College would provide a convenient location and an opportunity for local residents to pursue educational goals without traveling to San Diego or to the north. The P-M Zone is intended to serve industrial uses primarily, but does allow for business and professional offices. Typically, staff would not support a school locating in the P-M zone. However, in this case, based on the nature of the school's operation, the existing uses within this complex, and the general location, there are reasons, as discussed below, why staff can support the project. The other uses in Building A are offices that operate on an 8:00 a.m. to 5:00 p.m. schedule, i.e. a commercial real estate firm, mortgage banking, and sales/general offices for computer software and security systems. As mentioned earlier, none of the tenants use toxic chemicals associated with industrial operations. The Pire Departaent has included conditions that will prevent future hazardous occupancies from locating in Building A. Since Chapman College will hold classes in the evenings, (only four people work in the office during the day), no incompatibilities with the other existing uses are expected. Parking and traffic will occur during off-peak hours. In this particular location, with its close proximity to and visibility from the freeway, the proposed use is considered appropriate here rather than in another P-M zone, further inland to the east. School traffic would avoid using Palomar Airport Road. Staff also feels that this application differs from the recommended denial of the church mentioned earlier. No children will be involved in the school and the proposed site is in a much safer office-type location, away from the airport. -2- The existing office complex is adequate in size and shape to accommodate the proposed evening college. As stated earlier, parking needs will be after 5:00 p.m., when most of the other uses have closed. Staff has surveyed the parking lot after 5:00 p.m., and it is virtually empty. In addition, the Engineering Department has imposed a condition that classes can not begin until after 5:30 p.m. to assure that parking and traffic conflicts will be avoided. In terms of other features necessary to "adjust" the proposed use to existing or future uses, the CUP places conditions on the school's operating hours and also on the future uses allowed in Building A as well as within 200 feet of Building A (which is enforceable because the CUP applicant is the developer of the project). The first condition assures parking and traffic compatibility with a school use. The second condition assures that industrial uses will not locate in the vicinity of the school use. As discussed earlier, the incoming traffic will occur generally at an off-peak hour, in terms of cars leaving the business area after 5:00 p.m. Classes will end around 10:00 p.m. with no traffic impacts expected. In summary, the project would be compatible as proposed and conditioned. The findings of the CUP can be made. Therefore staff recommends approval of CUP-299. IV.
