There are unusual onsite circulation problems and I have no problem with the way they have been solved, except for the driveway only 130 feet from El Camino Real. Following are my reasons for objecting to the proposed driveway. 1) It is not needed. The dally generation of 747 trips (324 vehicles) can easily be accommodated through a single driveway. 2) Faraday Avenue at the location is projected to carry 19,000 dally vehicles at General Plan buildout. Such a volume, with left turn movements for El Camino Real, this project, Cablevision, and Palmer Way will tax the ability of Faraday to carry such traffic efficiently. We must eliminate side friction (driveways) wherever possible. 3) The intersection of Faraday Avenue and El Camino Real Is projected to carry 98,000 daily vehicles at General Plan buildout. Sight-distance between the driveway and the intersection is poor. Vehicles turning easterly off of El Camino Real onto Faraday Avenue will be subjected to rear-end collision risk, even if the driveway could be enforced as an entrance only. 4) Under the proposed parking layout, drivers are faced with a "left" or "right" decision immediately upon entering the driveway from the street. That's bad traffic engineering. Traffic can be predicted to back into the street. 5) Angle stalls off of a parking aisle should all be angled the same way. The present design would be confusing, and would promote wrongway movements. 6) There are virtually no disbenefits to the businesses as a result of closing the driveway and angling all the parking the same way; i.e., a westbound aisle, away from the main single (easterly) driveway. Condition No. 4 of the approving CUP Resolution No. 3094 specifies that CUP 300x1 is extended for a period of 5 years but may be additionally extended upon written application of the permittee (Federal Express). While the five year extension period has elapsed, the applicant. Federal Express, did make a timely request for the extension of CUP 300x1 that would allow continued operation of the drive thm kiosk at this site for another five years. IV. ANALYSIS The Federal Express drive thm kiosk continues to be consistent with all applicable plans, policies and regulations described below: 1. Carlsbad General Plan; 2. Local Facilities Management Plan 5; 4. Palomar Airport CLUP; and 5. Title 21 of the Carlsbad Municipal Code. CUP 300x2 - FEDERAL EXPRESS AUGUST 7,1996 PAGE 2 B. PROJECT DESCRIPTION AND BACKGROUND On May 20, 1987, the Planning Commission adopted Planning Cominission Resolution No. 2658 allowing the installation and operation of a Federal Express drive-thm kiosk in the parking lot behind the office/commercial development for a three year period, on the southwest comer of Faraday Avenue and El Camino Real. This facility acts as a drop off location for those customers of Federal Express who need to send packages after the hours of pick-up. The kiosk houses one employee in the aftemoon hours to provide customer service as well as to check-in packages bound for ovemight delivery. The hours of operation are from 1:30 p.m. to 4:45 p.m., Monday through Friday. III. ANALYSIS DISCUSSION The kiosk is desirable for the office and industrial uses nearby because it provides for extended ovemight package delivery service. Its location provides adequate circulation and is proximate to several large industrial parks such as Carlsbad Research Center and Gateway Center. The drive-thm kiosk is also consistent with the general plan since it "performs functions necessary and desirable in the overall operation of the industrial area". The original conditional use pennit required that the parking lot be redesigned to better accommodate the traffic flow. The existing redesigned circulation has been adequate to accommodate the conditional use and all features and conditions required to adjust the kiosk to existing or pennitted uses have been maintained. Both El Camino Real and Faraday Avenue remain adequate to handle all traffic generated by the drive-thxu kiosk. CUP 300x1 - FEDERAL EXPllK SEPTEMBER 19, 1990 PAGE 2 In summary, because all conditions of approval of CUP 300 have been met and maintained and because all findings required for a Conditional Use Permit can still be made, staff recommends an extension of CUP 300 for three years from the date of this action. Since the Conditional Use Pennit expired on March 31, 1990, the acmal extension time is three years plus the time elapsed since expiration, totalling three years and six and one half months wdth a new expiration date of September 19, 1993. IV. This drive-up kiosk service actually is supplemental and secondary to Federal Express' typical operation of picking up packages at businesses. The facility would provide a service for those customers who call in after the cut-off time for Federal Express pick-up. The kiosk would be placed in the parking lot of an existing office building located on the southeast corner of El Camino Real and Faraday Avenue. Set back approximately 200 feet from both streets, the kiosk generally would be visible to customers and centrally located within the industrial area. There is an existing approved CUP for a bank drive-through facility on this lot. It expires in May 1989. Approval of the Federal Express CUP would invalidate the bank CUP. III. ANALYSIS 1. Can the findings be made for granting a Conditional Use Permit? That is: (1) That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the general plan, and is not detrimental to existing uses, or to uses specifically permitted in the zone in which the proposed use it to be located; (2) That the site for the intended use is adequate in size and shape to accommodate the use; (3) That all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained; (4) That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. Discussion CUP Findings The first finding to be made is whether or not the proposed kiosk would be desirable for the community and would not be in conflict with the General Plan or existing land uses. As mentioned earlier, the Federal Express kiosk would serve businesses in the industrial area who need to send packages after the cut-off time for Federal Express pick-up. While there are six drop-off boxes in the Carlsbad/Oceanside area, a manned kiosk would provide customers with more personal service, help with packaging, receipts, etc. The proposed use is compatible with the existing land uses in the vicinity, is allowed within the zone, and is centrally located within the industrial park to serve its customer base. Therefore, staff can make the first f inding. The site is adequate in size and shape to accommodate the use. The 60 square foot kiosk will be situated in the back of a partially improved parking lot. Vehicles will be able to pull up to both sides of the kiosk without interfering with the parking or circulation in the parking lot. The kiosk will not eliminate any required parking spaces -- at a ratio of 1:250, the lot will provide seven more spaces than required. The remainder of the parking lot improvements will be made before a business license is issued for Federal Express. Thus, staff is able to make the second finding. The third finding relates to any improvements necessary to allow the requested use to fit in with existing or future uses, such as setbacks, fences, etc. As part of the parking lot and other tenant improvements on the subject property, the owner has proposed closing an existing driveway near the intersection of Faraday and El Camino Real which will improve both on and off- -2- site circulation. The second driveway also has been conditioned for closure for traffic safety reasons to improve future circulation (See attached memorandum). Without this condition, staff could not support the project. Landscaping will be required as part of the parking lot improvements. Setbacks, walls, or fences are not applicable. Staff finds that adequate measures have been taken to assure compliance with this finding. The last finding is that the street system serving the proposed use is adequate to handle the traffic generated by the use. At this point, a worse-case estimate would be 300 trips a day. The only other kiosk in California is in La Habre, and since it opened in July 1986, it has averaged 12 packages/day. As a comparison. Las Vegas averages 60 packages/day, Memphis, 140 packages/day, and Atlanta averages 100 packages/day. Three hundred trips per day, some of which would be vehicles leaving the business park at the end of the day anyway, would not cause significant traffic problems, in terms of actual numbers, on the surrounding street system. Therefore, staff is able to make this finding also. In summary, the proposed Federal Express kiosk will provide a desirable service to the businesses located in the industrial area; the kiosk operation will work adequately onsite; modifications will be minimal to the existing property, and no incompatibilities will occur with surrounding properties; and, finally, traffic generation can be handled by nearby streets. Staff recommends approval of CUP-300. IV. ENVIRONMENTAL REVIEW The proposed project is categorically exempt from environmental review, per section 15303, Class 3(c). There are unusual onsite circulation problems and I have no problem with the way they have been solved, except for the driveway only 130 feet from El Camino Real. Following are my reasons for objecting to the proposed driveway. 1) It is not needed. The daily generation of 747 trips (324 vehicles) can easily be accommodated through a single driveway. 2) Faraday Avenue at the location is projected to carry 19,000 daily vehicles at General Plan buildout. Such a volume, with left turn movements for El Camino Real, this project, Cablevision, and Palmer Way will tax the ability of Faraday to carry such traffic efficiently. We must eliminate side friction (driveways) wherever possible. 3) The intersection of Faraday Avenue and El Camino Real is projected to carry 98,000 daily vehicles at General Plan buildout. Sight-distance between the driveway and the intersection is poor. Vehicles turning easterly off of El Camino Real onto Faraday Avenue will be subjected to rear-end collision risk, even if the driveway could be enforced as an entrance only. 4) Under the proposed parking layout, drivers are faced with a "left" or "right" decision immediately upon entering the driveway from the street. That's bad traffic engineering. Traffic can be predicted to back into the street. 5) Angle stalls off of a parking aisle should all be angled the same way. The present design would be confusing, and would promote wrongway movements- 6) There are virtually no disbenefits to the businesses as a result of closing the driveway and angling all the parking the same way; i.e., a westbound aisle, away from the main single (easterly) driveway. No parking spaces are lost and out-of-direction movement would be neglig ible.
