Planning 'Comniission FROM: City Manager SUBJECT: Staff Report concerning the Application of Carlsbad Raceway Corporation requesting an Extension of the ori inal Conditional Use Permit for a period of Ten (107 Years, and an Amendment to said Conditional Use Permit to permit the Sale of Beer at all events except drag races; subject items to be considered by the Planning Commission on June 10, 1969. APPLICANT: CARLSBAD RACEWAY CORPORATION REPORT SUBMITTED BY THE FOLLOWING DEPARTMENTS: Engineering Department Planning Department City Manager Police Chief Section I - GENERAL 1. The original Conditional Use Permit was granted on October 22, 1963 and is due to expire on October 22, 1973. 2. Item 3 of the original Conditional Use Permit prohibited the sale or possession of alcoholic beverages on the premises. 3. The Planning Commission, on August 23, 1966, denied the request of Carlsbad Raceway Corporation to allow the sale of beer for the following reasons: A. That it is not in the best interests of the community. 6. That no evidence was presented indicating there is a demand for this request. Section I1 - RECOMMENDATION 1. Due to a period of indecision concerning the potential and future Lises of Palomar Airport, it is impossible for Staff to make any determination pertaining to land use in the areas which may be affected by landing patterns of what might be a major airport facility. Until a determination of the future use of Palomar Airport has been made by the County, Staff must recommend against subject application for the following reasons: I/ I ... . .. .. . ... -I . - . - - - - . . . - . -. ... -. -. The present status concerning Palomar Airport; 2. The sale of beer should not be permitted because: a. Persons under 21 years of age are employed at the snack b ars. b. The consumption of beer by participating drivers is not compatible with racing. c. Storage of beer on the premises would become a target for burg1 ary. d. Once the beer were sold, it would be difficult to prevent it's consumption by minors. e. The sale of beer would require additional super- vision by the Police Department.
