Dear Mr. Sloan:
This letter is written in reference to your proposed
skatepark development to be located on a portion of this Company's 150' wide electric transmission line right of way described as a Portion of SWt - NE+ Section 18, T12S R-3-W, in the County of San Diego, State of California.
While the proposed improvements within this Company's right of way constitutes an encroachment, we have determined after investigation that said encroachment may be permitted under certain conditions hereinafter set forth. Therefore, San Diego Gas & Electric Company hereby grants you revocable permission to use that portion of the above described right of way for the improvements of a skatepark as shown on Exhibit "A", attached hereto and by this reference made a part hereof. following terms and conditions:
If in the event the improvements interfer with the operation and maintenance of SDG&E's existing or future facilities, you, your successors and assigns agree to relocate the improvements at no cost or expense to SDG&E.
No other encroachment shall be permitted on this Company's right of way without the express written consent of SDG&E.
You, your successors and assigns agree, to the extent authorized by law, to assume all risks of loss, damage and/or injury to person or per- sons and/or property by reason of the condition or incidental to the use of the said right of way and will hold, save and indemnify SDG&E, its officers, agents, servants, and employees free and harmless from and indemnified against any and allbss, damage, injury, cost of defense, attorney fees, witness fees, including expert

This letter of permission shall not in any way alter, modify, or terminate any of SDG8cE's prior rights in the area and that you, your successors and assigns shall not be considered as acquiring hereunder any permanent interest of any kind or nature in the right of way, or otherwise.
The provisions of this letter of permission are conditional upon the right of SDG&E to revoke said permission herein granted and to commence or resume the use of the property hereinabove referred to whenever in theinterests of its patrons or consumers it shall appear necessary or desirable so to do, as provided by General Order 69-B of the Public Utilities Commission of the State of California.
