James Hageman Planning Director City of Carlsbad 1200 Elm Avenue Carlsbad, CA 92008 Dear Mr. Hageman: For the last eight months, Sparks, Inc. has been involved in completing Phase I of a building plan which was submitted and approved by the City of Carlsbad. Because of changes in construction supervision, we were not aware of the requirement to have an automated sprinkling system and a landscaping plan completed before we could occupy the facilities we have just built. We have just been told by Mr. Abrams of the Planning Department that he could not grant us occupancy because of the provision of Resolution No. 1213, Conditional Use Permit No. 42E which requires a landscaping plan, installation of land- scaping, and an automated sprinkling system. As a result of my discussions with Mr. Abrams, he suggested that I write to you requesting that you grant us an occupancy permit based on the understanding that we would complete the landscaping and the installation of the automated sprinkling system within the next 120 days. Further, we are willing to post a bond in the amount of $3,000 to insure our performance if you would grant our request to permit us occupancy. As you are probably aware, we have been using temporary restroom facilities which do not have running water and that present a reasonable health hazard. It would be a shame to deny the use of these new facilities to our skaters over such a small technicality. We would appreciate your understanding help in this matter. @.
