HomeMy WebLinkAboutCUP 42G; Carlsbad Raceway; Conditional Use Permit (CUP) (7)MEMORANDUM *-- DATE : June 13, 1979 TO : Planning Commission FROM : Planning Department SUBJECT: CUP-42G; CARLSBAD RACEWAY/SKATEPARK: 14 ACRE RECREATIONAL FACILITY The Planning Department has received an application for a Condi- tional Use Permit in order to allow further development of an existing 14 acre recreation area (CUP-42G). Staff is requesting Commission direction regarding the processing of this application, that is, should the application be accepted and tentatively scheduled for a Planning Commission hearing. Therefore, the Planning Commission should not discuss the merits of the project, but rather whether or not the application should be processed. The subject 14 acre site is now currently operating under CUP'S 42D, 42E, and 42F. CUP-42D (Carlsbad Raceway) applies to the entire 150 acre raceway property, of which the 14 acre site is a part. at which time an annual review period will be established. All CUPS affecting this property expire on April 25, 1982, Staff's request regarding the processing of CUP-42G is in response to a Minute Motion made upon approval of CUP-42F (water slide addition to the subject 14 acre facility). that staff shall assist in the preparation of a conceptual Master Plan for the entire skateboard park and raceway property, prior to anv future entitlements. This motion stated Thus, while it appears that the current CUP application may be premature in lieu of a Master Plan for the entire raceway property, the applicant has indicated the reasons for submittal (see attached letter from Joe Sandy to the City, dated May 31, 1979). Generally, the applicant has stated that before a Master Plan for the entire 150 acre site can be prepared, the "expended investment in the existing 14 acre recreation park must be in operation". The applicant believes that this operation would then fund the overall Master Development Plan. In effect, the proposed CUP would therefore be considered one portion of the required Master Plan. Another issue which raises a question regarding the processing of the subject proposal concerns Condition No. 13, also of CUP-42F. Specifically, this condition stipulates that: "The owners of the subject property shall work with city staff to prepare a plan for improved access to the Carlsbad Raceway property. Memorandum - CUP-42G June 13, 1979 Page Two The plan shall be approved by the City Engineer prior to proces- sing any other application for the raceway property covered by CUP-42D". Again, it appears that the proposed project may be premature since a traffic access plan has not yet been prepared. However the applicant has indicated in the attached letter that they will work with the City on a general traffic study as part of the overall Master Plan. RECOMMENDATION Staff requests Commission direction regarding the processing of the subject application, CUP-42G. That is, should the applica- tion be processed in lieu of a Master Plan and traffic access study covering the entire 150 acre property (the CUP thereby considered an initial stage in the preparation of the required master plan), or should the application be rejected until the Specific Plans are prepared?
