HomeMy WebLinkAboutCUP 42J; Carlsbad Raceway; Conditional Use Permit (CUP) (14)MEMORANDUM DATE : January 10, 1983 TO : Frank Aleshire, City Manager FROM : Marty Orenyak, Director of Building and Planning SUBJECT: CARLSBAD RACEWAY REPORT UPDATE One old CUP (CUP-15) and seven amendments (CUP-42(A)-(G)) regulate recreational activities on the raceway site. None of these documents contain a condition regulating the level of noise. A finding for approval for CUP-15, however, does state "that because of this topography some of the noises and nuisances which may result may be minimized or confined within this area". In addition, a finding of CUP-42(A) states, "that this use in terms of potential noise factors would be no more objectionable than racing on the lagoon, or railway trains, or the use of the airport." CUP-42(D) contains a condition that reads, "Major drag races (those where competitors use fuel burning blown engines) shall be limited to one event per month and conducted between the hours of 9:00 a.m. and 1O:OO p.m. of the same day." No other conditions relate to noise regulation. While the several files on the raceway contain copies of numerous complaints over the years, the only recent complaint is that of Mrs. Frahm. She brought our attention to the problem in June, 1982. She has kept in pretty close contact with us since that time. Mr. Ray Sacco, of the County Noise Control Office, monitored the noise levels from June 11 to June 14. His results did not conclude that a significant problem exists and he felt that a case could not be made for a violation of the County Noise Ordinance. He did say that further monitoring would be necessary to reach a definite conclusion. The Land Use Planning Staff monitored the raceway this last Saturday (January 8th). Those results are being compiled as this time. These are the only documented noise monitoring of the site to date. The attached memo contains a response to the December 26th letter from Mrs. Frahm.
