Klukas SUBJECT: CONVERSATION WITH JANET LEE FRAHM mo This morning I called Ms. Frahm to summarize our progress on the Carlsbad Raceway Report with her and to ask her attendance at a meeting with Mayor Casler, you, Michael Holzmiller, and myself. I mentioned that the Mayor was available on Tuesday, January 18, or Wednesday, January 19 and that we would want the meeting no later than this due to the time constraint of the January 26th Planning Commission Meeting. She replied that she would be unable to attend on these days and suggested that the report be postponed until the next Planning Commission Meeting, which is February 9th. I told her I would re-contact her about her proposed agenda change, but that it would give us more time for our meeting, maybe the week of January 24th. I reported to Ms. Frahm that my noise monitoring last Saturday, January 8th, did not conclude that the Raceway was creating excessive noise. She added that the Raceway was uncharacter- istically quiet that night. She further stated that she no longer believed that noise monitoring of the Raceway was necessary, as there is no set maximum sound level, above which they would be in violation. Her suggestion was that I enter the Raceway as a paying customer the next several weeks to see if they are running "fuel-burning blown engines" more than once per month, which would violate a condition of approval for the CUP. This last weekend I did enter the Raceway and spoke to two race car drivers. They told me that they were driving "fuel-burning blown engines", although I have received conflicting information as to exactly what a "fuel-burning blown engine" really is. I feel that Ms. Frahm is correct in the fact that the excessive noise problem is going to be difficult to substantiate. Since I have been working on this project, I have been unable to verify that the problem exists. Since she now requests a change in tactics, if we decide to accomodate her, it will be necessary to allow me at least a couple more weeks to go into the Raceway on Saturday nights and check the engines. Since, to date, the report shows nothing conclusive on the matter, and since Ms. Frahm asked that it be postponed, I recommend that the Planning Commission report be put on the February 9th agenda, and that we set our meeting for the week of January 24th.
