Dear Mr. Pollard:
Allen Meacham of this department has explained to me the problems you expressed to him in your phone conversation during the week of July 12-16, 1976. I have. also reviewed the letter you wrote the City Manager, explaining your problems in removing the the trailer present on the site.
tn tiiitiii the requirements of the Cnnditionai Use Permit you must remove the trailer. It is normally possible for an applicant to apply for an amendment to a Conditional Use Permit. However, in yo$ case - applying for such an amendnrent would put continued operation of the Kennels in jeopardy in that the trailer is already illegal. Trailers are not permitted as a watchman's unit in the residential zones. A review of a previously approved CUP would require compliance to all applicable zoning ordinances.
A Conditional Use Permitk grants an applicant the right to operate - a business subject to certain conditions. If the conditions are not met, the applicant loses the r*ight to operate his business.
As I indicated in my letter of July 14, 1976, it is therefore requzsted you comply with the provisions of Planning Ccmmission Reso- lution Number 730, Condition 12, by August 23, 1976. If the situation is not rectified by that date, the matter will be referred to the City Attorney .for necessary action.
