HomeMy WebLinkAboutCUP 60; Gaycrest Kennels; Conditional Use Permit (CUP) (8)MEMORANDUM March 26, 1976 TO: CITY ATTORNEY FROM: ASSISTANT PLANNING DIRECTOR RE: CUP 60 - GAYCREST KENNELS As a part of the Department's CUP Update and Enforcement Program, the Building Department recently contacted Mr. Mitchell L. Pollard, the applicant, regarding bring- ing his Kennel into conformance with the conditions of the approving Planning Commission Resolution. Specifi- cally, he was required to remove an existing trailer from the site within a year of the CUP'S approval (Condition 12 of Resolution 730, attached). Mr. Pollard contacted the Planning Department regarding possible solutions to the problem. Before pursuing any of them, he asked to meet with you. The balance of this memorandum outlines the background of the CUP. BACKGROUND : The Conditional.Use Permit was applied for September 17, 1971. At that time the project site, in the Ponto Area, was zoned "MI'. Kennels.were then, as they are now, al- lowed by CUP in all zones except residentia.1. Since then., the area has been rezoned to "RD-MI'. The Kennel existed on the site at the time of annexation to the City. The CUP apparently resulted from the appli- cant's desire to build a resid'ence on the site. From reading the Staff Report and Resolution, it appears the City interpreted the residence as a caretaker's dwelling, despite the fact that such a use is (and was then) per- mitted on the same lot on which a factory is located. The file includes a letter from the applicant dated February 9, 1972, explaining that it is necessary to have a caretaker on the premises for insurance purposes, and that the trailer was, at that time,. necessory to house the caretaker. This is apparently still the case. Staff suggested to Mr. Pollard that he has two reasonable alternatives for retaining the trailer: (1) apply for an amendment to the CUP to delete Condition 12; (2) apply for a new Conditional Use Permit to allow the temporary use of the trailer as permitted in Section 21.42.010 (55). .-. ... Staff also stated that it was doubtful that Staff would support either application since the first would, in effect, condone a nonconforming use;" and the second is allowed only in all zones except residential.
