HomeMy WebLinkAboutCUP 60; Gaycrest Kennels; Conditional Use Permit (CUP) (9)\( r MEMORANDUM i I'Ld c L March 31, 1976 Planning Director FROM : sy -- \?::> SUBJECT : CUP 60 - RESOLUTION NO. 730 GAYCREST KENNELS Mr. Pollard, who represell'ed himself as the operator of the above-referenced business, met with me in that regard on March 30, 1976 and Mr. Pollard has encountered some personal difficulties which have complicated the operation of his business and prevented his compliance with Condition 12 of his permit which requires the removal of a trailer located on the premises. The trailer is presently being utilized as the residence of an employee. I explained to E4r. Pollard that the terms of his CUP, and Planning Commission Resolution No.. 730, were clear and unequivocal and that he was obligated forthwith to remove the trailer. His only alternative is to apply for an amendment to the conditional use permit to modify or remove Condition 12. He was directed to the Planning Dzpertm~~t for informitic? ir_ that _recJard. I indica\te+i further that he had another problem arising out of the provisions 01 Section 5.24.145 of the Municipal Code. That section prohibits the location of a trailer outside an authorized trailer park except in two limited circumstances; a property owner may store an unoccupied trailer on his property or a trailer may be parked and utilized as a watchman's unit if the City Manager approves, provided the trailer is not a primary place of residence and meets applicable building and health code requirements. Assuming Mr. Pollard was able to secure Planning Commission approval for modification of Condition 12, he would still not be able to keep the trailer as it is presently being used. In order to obtain a City Manager's permit, he would have to demonstrate that it was being used in accord with the ordinance solely as a night watchman's unit and not as a primary place of residence. In the event Mr. Pollard does not take steps within a reason- - able time to bring his operation into accord with our ordinance and the terms of his conditional use permit, it would be appropri- ate to instigate enforcement action.
