Conditional Use Permit No. 64
This letter is written on behalf of Mr. Eugene Chappee. As you are aware, Mr. Chappee was granted a conditional use permit for the operation of an auto wrecking yard in January 1973. One of the conditions
of that permit was that a water main and one fire hydrant
be installed by Mr. Chappee at a location satisfactory to
the City Fire Chief. Since the issuance of that permit, one and possibly two fire hydrants have been installed by others in the immediate area of Mr. Chappee's place of business. It has been suggested that,by reason of the installation of those hydrants, the installation of yet another hydrant by Mr. Chappee is not necessary, at least
at this particular time. The thought has occurred to us that it might be appropriate to modify the condition requiring present installation of a fire hydrant by making the installation of that hydrant the subject of a future improvement agreement between the City of Carlsbad and
Mr. Chappee. In other words, Mr. Chappee would formally agree with the City to install the hydrant at such time as the City determines that a need for the hydrant has arisen.
As a further condition of the use permit issued to Mr. Chappee, he has already entered into a future street improve-
ment agreement with the City. We would suggest that a similar agreement be entered into between the City and Mr. Chappee relating to installation of the fire hydrant. This would relieve Mr. Chappee of the very heavy financial burden of installing a water main and fire hydrant until the need for such a hydrant has actually arisen.
