HomeMy WebLinkAboutCUP 64; Eugene Chappee; Conditional Use Permit (CUP) (22)MEMORANDUM TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: CUP-64 CHAPPEE'S AUTO WRECKING Last October the Planning Commission received a letter from Norman Vetter, attorney for Eugene Chappee, requesting that an original condition of CUP 64 requiring installation of a fire hydrant be revised to require instead a future improve- ment agreement for installation of a hydrant. The Planning staff has consulted with the Fire Department and the City Engineer in an attempt to resolve the fire hydrant requirement for Mr. Chappee's auto wrecking yard. The Fire Department maintains that although two hydrants have been in- stalled, there is still a need for four additional hydrants to adequately serve the Ponto area:, The Fire Department has re- commended that the most equitable means for providing the fire mains and hydrants would be through creation of an improvement district. However, the City Engineer has pointed out that an improvement district must first be agreed to by the affect- ed residents, making it an unlikely eventuality. Also, Ponto is not presently served by a dedicated road system. Because future development in Ponto is to be residential, it is likely that the road system (and water system) will be substantially different than the present. Because of this, the only practical solution to the need for fire hydrants at this time appears to be through the use of a future improvement agreement. Staff is therefore recommending that CUP-64 be brought back to public hearing on February- 11, 1975 to amend condition #2 re- quiring a fire hydrant to instead require a future improvement agreement for the installation of a hydrant. Staff has prepared a Resolution of Intention to this effect. Also, Staff believes that in bringing the CUP back to public hearing, the entire project should be reviewed to ensure that all conditions of the original CUP have been met. Staff believes that conditions #3 and #4 (see attached resolution) in particular should be reviewed. Staff recommends that the Planning Commission approve Resolution of Intention #lll to reopen the public hearing for CUP 64. A complete staff report will be prepared prior to the hearing.
