3) That all of the yards, setbacks, walls, fences, landscaping, and other
features necessary to adjust the requested use to existing or permitted
future uses in the neighborhood will be provided and maintained; and
4) That the street system serving the proposed use is adequate to properly
handle all traffic generaged by the proposed use. (Ord. .9252, Section

CONDITIONS OF APPROVAL
1. This CUP is granted for the activity, dates and location
described in the application (CM CUP 79-2) and as shown
on Exhibit "A" dated July 31, 1979. The use shall be
located substantially as shown on this plan, except as
indicated elsewhere herein.
2. Approval is granted for the days August 16th through
August 20th, inclusive,. 1979. The approval is granted
for operation during the hours 5-10 P.M. August 16th and
17th, and 1-10 P.M. August 18th and 19th.
3. Prior to commencement of the use, all aspects of the project
shall be approved by the Police and Fire Departments to
insure public safety. Any requirements of those departments
shall be complied with prior to commencement of the use. It
shall be the responsibility of the operator of the use to
secure the approvals required herein.
4. Prior to commencement of the use, a precise plan of carnival
facilities operations and parking shall be approved by. the
City Engineer to insure efficient traffic circulation through-
out the shopping center parking lot and City streets. It
shall be the responsibility of the operator of the use to
secure the approval required herein.
5. Amusement rides shall have a Certificate of Approval by
the Department of Industrial Safety and shall'-be inspected
by. the Fire Marshal prior to opening.
6. An unobstructed firelane not less than 14 feet in width
will be maintained to service the carnival tents and amuse-
ments. Exists from the site will be maintained at all times.
7. A minimum of four portable sanitary stations will be pro-
vided for use by carnival patrons.
8. No signs or advertising of any type whatsoever shall be
erected or installed until plans for such have been
approved by the City of Carlsbad.
9. A Certificate of Liability Insurance in an amount of not
less than $1,000,000 Personal Injury and $500,000 Property
Damage shall be approved by the City Manager prior to
commencement of the use.
10. The dismantling of all equipment and restoration of .the
site and roadway shall be accomplished by noon, August 20,
1979.

12) By law a Conditional Use Permit may be approved only if certain facts
are found to exist. Please read these required facts carefully and ex-
plain how the proposed project meets each of these facts. Use additional
sheets if necessary:

elements and objectives of the General Plan, and is not detrimental to

As the proposal has been presented to me, I hereby find that the following facts
apply to the subject request:
1) That the requested use is necessary or desirable for the development
of the community, is essentially in harmony with the various elements
and objectives of the General Plan,-and is not detrimental to existing
uses or to uses. specifically permitted in the zone in which the proposed
use is to be located;

accommodate the use;

11. Prior to commencement of the use, the applicant shall
obtain a Special Events Business License from the City
Clerk.
12. During the event "Temporary No Parking" signs shall be
placed on both east and west sides of El Camino Real from
Marron Road to the Elm Avenue extension.
13. No dumping of wastes generated by the use will be permitted
in City storm drains.
14. The applicant will provide litter/trash recepticles on site.
15. Watering of the site will be conducted as a dust control
measure.
16. Water service will be provided through a construction meter
installed on the fire hydrant located on the site.
