HomeMy WebLinkAboutCUP 85B; Pilgrim Congregational Church; Conditional Use Permit (CUP) (59)r- Dear Planning Commission members: 94 [&p.,- After our Public Hearing on July 2 on this matter, we have met with Mr. & Mrs. Vallely and have mutually agreed on a complete list of additions and deletions to attenuate noise from the Pilgrim Children’s Center and to improve our neighborhood relationship. On July 10, 1997 we had a constructive meeting with Ms. Hysong of the Planning department who was to include many of our agreed upon items into conditions for our use permit. Mr. & Mrs. Vallely will be out of town on Wednesday July 16th and will not be able to attend the next planning Commission meeting. Both Pilgrim Children’s Center and the Vallely’s have agreed on the following conditions for our use permit and would support the adoption of the use permit with these inclusions. However, in the event any other unnecessary additional conditions are imposed by other parties, Pilgrim Children’s center may oppose the entire agreement and The Vallelly’s would respectfully request a continuance of the matter to another date so that they may be in attendance. The following items were worked out in a friendly & mutually respectful manner and we believe will effectively attenuate the noise level from Pilgrim Children’s Center. 1. Pilgrim Children’s Center will construct a wood fence along the property line of the Vallely property. The fence will be the same height and continuos as the wood fence already in place on the property line between the Pilgrim Children’s Center and the next door neighbors of the Vallely’s, The Fence will be of solid construction and will be approximately 8’ in height. 2. The Vallely’s will plant a non flowering hedge on their side of the wood fence for further sound & sight attenuation. The hedge plants will be planted approximately 2’ apart and will be planted along the entire fence line. 3. All cleaning & maintenance crews will be finished with their tasks and off the Pilgrim Children’s Center property no later than 9:OOPM weekdays. 4. Lights on the back wall of the Children’s Center & side wall of the Church will either be moved or attenuated so that they are not shining directly into the Vallely property. 5. Bell ringing announcing the recesses will be reduced and the location of the bell ringing will be moved to the opposite side of the building from the Vallely’s. 6. Use of the exterior property of the Pilgrim Children’s Center will be limited to the hours of the Pre-school during weekdays and will not be used past 6:oOPM on holidays and weekends. 7. A No- Smoking rule will be implemented on the area of the property behind the Children’s Center classroom. 8. Any noise problems noticed will be reported within 48 hours of the occurrence to the Facilities Coordinator of Pilgrim Church at (760) 729-1 562. 9. Pilgrim will remove two pine trees along the fence line with the Vallely’s property line. 10. All work will be completed no later than October 15, 1997. Sincerely , Agreed & Accepted by 7.IIeq7 s K.
