Dear Mr. Darnell :
Your letter of January 13, 1972 regarding the South Coast Asphalt facility has been referred by our City Council to me for reply. Enclosed is a copy of Resolution No. 737 setting forth conditions of approval. You will note there is no time limit on the condi- tional use permit. Our City Attorney has reviewed their condi- tional use permit and determined South Coast Asphalt is operating within its provisions.
A study committee is presently working on a noise ordinance based on the League of California Cities "Quiet Cities" report. While we expect ordinance consideration reasonably soon, it is obvious we must adapt the ordinance to fit local conditions and needs.
The extraction of rock and mineral products is a necessary activity in any area. For obvious reasons such an activity would not be ap- proved. near existing residential areas. However, in 1961, when South Coast Asphalt received their conditional use permit, there was little, if any, residential land use in the area. Since that time the City of Oceanside has permitted residential subdivisions near the pl ant.
I can sympathize with your concern. However, in all fairness it must be pointed out that residential development in the area was permitted and individuals purchased residential property in full knowledge of the existence of the South Coast Asphalt operation. They have a legal right to conduct their operations as long as they remain within the limitations of the conditional use permit.
