Description/Explanation: KinderCare Learning Centers Inc. proposes to build a 9,897 square foot single story child care facility with approximately 33,000 square feet of fenced playground area and 40 parking spaces on the 1.79 acre parcel at the northeast corner of the intersection of Hidden Valley Road and Plum Tree Lane. The hours of operation will be 6:30 a.m. until 6:30 p.m. Monday through Friday. This site is currently zoned for child care and we are complying with all of the planning and zoning regulations pf the City of Carlsbad (building height, setbacks, parking, etc.) and are requesting no variances for special conditions. KinderCare is the largest child care provider in the world with over 1,150 centers. RECOMMENDATION That the Planning Commission ADOPT Planing Commission Resolutions No. 4711, 4712, 4713 and 4714, APPROVING a Mitigated Negative Declaration, Mitigation Monitoring and Reporting Program, SDP 99-14, CUP 99-21, and CDP 99-34, based on the findings and subject to the conditions contained therein. II. INTRODUCTION The applicant is requesting Planning Commission approval of a Site Development Plan, Conditional Use Permit, and Coastal Development Pennit to allow finish grading and the constmction of a 9,897 square foot day care center on a 1.79 acre parcel located on the northeast comer of Hidden Valley Road and Plum Tree Road in the RD-M-Q zone, within the Zone 20 Specific Plan (SP 203), and the Coastal Overlay Resource Protecfion Zone and Mello II Local Coastal Program (LCP) segment boundaries. Findings required to approve the Site Development Plan, Conditional Use Permit, and Coastal Development Pennit can be made, and the project is consistent with the General Plan, the Zone 20 Specific Plan, relevant LCP policies, and relevant zoning regulations of the Carlsbad Municipal Code. III. PROJECT DESCRIPTION AND BACKGROUND The subject site, approved in 1996 as Planning Area "E" of the Sambi Seaside Heights Subdivision (CT 92-02), is located on a vacant, pre-graded infill lot at the northeast comer of Hidden Valley Road and Plum Tree Road. The site is also located within the Mello II Segment of the Local Coastal Program. The northeast boundary of the site is adjacent to a finger canyon, with existing residential development to the north and east beyond the canyon. A vacant parcel planned for residential development is located to the south and Poinsettia Park is located across Hidden Valley Road to the west. The adjacent finger canyon is a coastal, deed-restricted area containing biological habitat which was dedicated in conjunction with the Sambi Seaside Heights subdivision. The open space buffer restricts development, such as buildings or combustible stmctures, but permits encroachments such as parking and landscape areas. The proposed development does not disturb any slope or habitat areas. Grading for the site will consist primarily of finish-grading the pad and will require 850 cubic yards of cut, 1,200 cubic yards of fiU, and 350 cubic yards of import. The building pad will be elevated approximately 1.5 feet above existing grade so that water will flow away from the foundation. Similarly, the parking lot area will be raised 1.5 feet or less to provide positive drainage into an underground private piping system which will connect into the existing public storm drain system. The proposed project will consist of a 9,897 square foot day care center and will include all the required play areas, on-site circulation, parking, and landscaping. The site will be accessed by a 24 foot wide driveway located on Plum Tree Road which will provide access to 42 parking spaces. The rectangular-shaped building contains administrative offices, kitchen, reception area, and classrooms for children ranging from infants to school age. Each classroom area will have its own exit to the playground area and will include large windows to provide natural light into the building. The main entrance will feature large columns supporting an arched entry element with a clay tile roof The single-story stmcture will have an overall height of 23'-3" and features a beige stucco exterior with a sea green accent tile on the columns, and a red clay tile hip roof Mechanical equipment will be concealed within the roof stmcture or located behind screen walls adjacent to the building. The 13,800 square feet of outdoor play area, located on three sides of the building, will be enclosed by a decorative wrought iron fence on the west and south sides, and a 6 foot high vinyl clad green chain link fence along the northeast boundary. The applicant has indicated that the playground contains nearly three times the State requirement in playground area (75 square feet per child). The facility proposes licensure for a total of 184 children, and will be staffed by 18 employees. The proposed hours of operation for the day care center are 6:30 AM to 6:30 PM Monday through Friday. The site was reserved as a community facility site as part of CT 92-02, and as required by SP 203. The Zoning Ordinance states that a day care center is a permitted use in the RD-M zone, subject to administrative approval of a Child Day Care Pennit. However, the Specific Plan requires approval of a conditional use permit prior to the development of any community facility site and the Qualified Overlay ("Q") designation requires approval of a site development plan. ANALYSIS The recommendafion of approval for this project was developed by analyzing the project's consistency with the applicable policies and regulations listed above. The following analysis section discusses compliance with each of the regulations/policies utilizing both text and tables. A. General Plan The following Table 1 identifies General Plan goals and objectives relevant to the proposed project and indicates the compliance of the proposal. Yes B/C-1 /C-2 SP 203 / Conditional Uses/"Q" Overlay Zone In accordance with SP 203, a conditional use permit is required prior to development of any community facility site. The site's zoning designation of RD-M-Q also requires approval of a site development plan. The four findings for both the site development plan and conditional use permit are nearly identical. The required findings with justification for each are summarized in this section. 1. That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the General Plan, and is not detrimental to existing uses specifically permitted in the zone in which the proposed use is located. The General Plan encourages the establishment of day care centers in safe and convenient locations throughout the community to accommodate the growing demand for childcare in the community caused by demographic, economic, and social forces. The subject site was reserved as a community facility site as part of the CT 92-02 subdivision, consistent with the policies of SP 203. The development of a day care center on this site will provide a needed service for the community on a site which is conveniently located near residential development. The project also will serve as a buffer between residential uses and Poinsettia Park located to the west. The proposed architectural design will be compatible in design, color, and materials with the surrounding residential neighborhood. 2. That the site for the intended use is adequate in size and shape to accommodate the use. The 1.79 acre site will be adequate in size to accommodate the 9,897 square foot day care center. The single story stmcture will be located outside of the 60 foot open space easement fi-om habitat, and all necessary setbacks, play areas, landscaping, circulation aisles, and parking areas will be provided. The project will accommodate 184 children and will provide 42 parking spaces whereas 37 spaces are required. Nearly three times the State requirement in playground area (75 square feet per child) will be provided within the children's playground area. That all the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained. All setbacks required by the RD-M zone will be exceeded, combustible structures will be located outside ofthe 60 foot open space buffer, and all amenities required by the Child Care Ordinance, Chapter 21.83 of the Carlsbad Municipal Code will be provided and are discussed in Section C-3/C-4 below. 4. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. Traffic generated for the proposed use was previously addressed in the Conditional Negative Declaration prepared for CT 92-02, and in EIR 90-03 prepared for SP 203. The proposed day care use is consistent with the community facility designation for this site which was required as part of CT 92-02. A Traffic Impact Analysis was prepared for this project using SANDAG traffic generation rates for day care centers. The project will generate about 920 daily trips (460 in and 460 out) with 80 inbound/80 outbound trips during the AM peak hour and 85 inbound/85 outbound during the PM peak hour. The report concluded that this amount of traffic, much of which will be drawn from the immediate area, will not significantly impact the levels of service of Hidden Valley Road; that the key intersections of Plum Tree Road, Palomar Airport Road, and Camino De Las Ondes would not be reduced to unacceptable levels by the proposed development; and additional roadway improvements are unnecessary. Therefore, the required circulation improvements identified for CT 92-02 will still be adequate to accommodate the vehicle trips generated by this project. C-3/C-4 RD-M Zone/Child Care Ordinance As discussed previously, a proposed day care center use in the RD-M zone requires administrative approval of a Child Day Care Permit. Although SP 203 supersedes this allowance and requires approval of a conditional use permit, the project still requires evaluation with respect to the development standards set forth by the Child Care Ordinance. The proposed project complies with all of the development standards of the Child Care Ordinance as outlined in the following discussion. The project is conditioned to provide proof of licensing prior to occupancy. The fenced outdoor play areas are located adjacent to the stmcture and all play areas are visible and accessible from inside the facility. The day care center is designed with multiple windows to allow maximum natural lighting and visibility. A total of 42 spaces are provided and parking spaces for loading and unloading children are located near the entrance of the building. Mello II Segment of the Local Coastal Program The project, as proposed is consistent with all development and resource preservation policies of the Mello II Local Coastal Program and its implementing ordinances. Chapters 21.201, 21.202, and 21.203 ofthe Carlsbad Municipal Code. The property carries the same land use designation as the City's General Plan and zoning. Therefore, the proposed use is allowed upon Planning Commission approval of a coastal development permit pursuant to Chapter 21.201. The site is located in the Coastal Agricultural Overlay Zone; however, pursuant to Chapter 21.202, agricultural mitigation fees have already been paid for the site prior to approval of a grading pennit for CT 92-02. The intent ofthe Coastal Resource Protection Overlay policies and zoning (Chapter 21.203) is to provide additional protective regulations for steep slopes and slopes with endangered species or native vegetation. The proposed development is consistent with all of the requirements in that the project is located on a previously graded lot outside of coastal deed-restricted open space (dedicated as part of CT 92-02). A portion of a 60 foot open space easement buffering biological habitat is located along the northeast side of the site. Parking and playground uses are proposed within the easement and are permitted uses. No combustible stmctures are proposed within the open space easement. No steep slopes or natural vegetation exist on site. The applicable regulations of Chapter 21.203 focus on deterring soil erosion and sedimentation through the provision of adequate drainage facilities. The site was previously graded and contains a temporary desilting basin near the southwest comer. The project will provide an underground private piping system which will connect into the existing public storm drain system. Additionally, the project will be required to comply with NPDES standards to reduce surface pollutants to an acceptable level prior to discharge into the storm drain. A grading permit will not be required for the project, however, the project is conditioned to comply with the City's erosion control standards during site preparation and project constmction. E. Growth Management The proposed project is located within Local Facilities Management Zone 20 in the southwest quadrant of the City. The impacts on public facilities created by the project, and its compliance with the adopted performance standards, are summarized in the table below. ENVIRONMENTAL REVIEW The initial study (EIA-Part II) prepared in conjunction with this project detennined that the project would not have a significant impact on the environment. Prior to mass grading of the Sambi Seaside Heights subdivision, the property was used for agricultural purposes. Soil samples have been collected and analyzed for the presence of pesticide constituents. Based on the information provided, no pesticide-impacted soils were discovered on the property; however, no borings were taken within the children's play area. Therefore, a mitigation measure is included in the Mitigation Monitoring and Reporting Program requiring additional Phase II soils testing within these areas, prior to commencement of grading work for the project. Should any hazardous materials be detected in the near-surface soils, mitigation measures will be required to remediate any potentially significant public health impacts to a level of insignificance. The project falls within the scope of the City's MEIR for the City of Carlsbad General Plan Update (EIR 93-01) certified in September, 1994, in which a Statement of Overriding Considerations was adopted for cumulative impacts to air quality and traffic. A Traffic Impact Analysis was prepared for the project using SANDAG traffic generation rates for day care facilities. The report concluded that the 920 ADT generated by the project, much of which will be drawn from the immediate area, will not significantly impact the key intersections and street segments in the project area. Therefore, the required circulation improvements identified for CT 92-02 will still be adequate to accommodate the vehicle trips generated by this project. The project site has been previously disturbed and graded, and the proposed stmcture does not encroach into the 60 foot buffer from biological habitat. Development of a community facility use was anticipated for this site and all the support utilities and service infrastmcture have been constmcted. The City has received its annual Growth Management Traffic Monitoring Report. The Report has recorded an unanticipated intersection "level of service" (LOS) failure at Palomar Airport Road (PAR) and El Camino Real (ECR) during both the am and pm peak hours. A mitigation measure has been identified which, if implemented, will bring the peak hours LOS into the acceptable range. This project has been conditioned to pay its fair share of the intersection "short-term improvements" thereby, guaranteeing mitigation to a level of insignificance. In consideration of the foregoing, on November 19, 1999, the Planning Director issued a Mitigated Negative Declaration for the proposed project.
