1597.40. (a)· It is the intent, of the.
Leg isla ture tha t family day ca·re homes for
children must be situated in normal residential
surroundings so as to give chlldren the home
environment which is conducive. to heal thy and ...
safe development. It is the publ ic pol icy of
this state to prov ide children in a family day
care home the same ho~e environment as provided
in a traditional home setting.
The Legislature declares this policy to be of
statewide concern with the purpose of occupying
the field to the exclusion of municipal zO!,)ing.,
building arrl fire codes aoo regulations gov.erning
the use of occupancy of family day care homes' for
children, except as specifically provided for in· .
this chapter, and to prohibi t any restrictions'
relating to the use of single-family res idenctls,
for family day care homes for child~en e~c~pt as
provided by this chapter. .
(b) Every prov ision in a wr i tten instrument,
entered into relating to real property which
purports to forbid or restrict the conveyance,
encunbrance, leasing, or mortgag ing of such re'al
property for use or occupancy as a family day
care ho~e for children, is void and eV~I~
restriction or prohibition in any such written
instrument as to the use or occupancy of the'
property as a family day care home for childr~n
is void.
(c) Every restr iction or proh i·bi tion entered
into, whether by way of covenant, corrlltion upon
use or -occupancy, or upon transfer of title to
real property, which restricts or prohibits
directly', or iOO irectly limits, the acquisi tion,
use, or occupancy of such property fora family
day care home for children IS void. ,

1597.45. All of the following shall apply tQ'-
small family day care homes: .
(a) The use of single-family. residence as a
small family day care heme shall ·be considered a

Specific Requirements
1. Two copies of a site plan showing:
It -
a. Existing house and distance to property lines
b. Drop-off and pick-up locations
c. Play area, with dimensions
d. Adjacent buildings with detail of room use
(see sample attached)
2. Location map showing subject property and the location of any
large family (7-12 children) day care centers closer then 1,2'00
lineal feet on the same street. I f there are no large family day
care centers within 1,200 feet on the same street, a written
statement must be submitted in lieu of a map.
3. 300 Foot Radius Map
A map to scale showing each lot within 300 feet of the exteri.or
boundaries of the subject property. Each of these lots shall
. be consecutively numbered and correspond with the Assessor's
Parcel Numbers and property owner's list.
4. Property Owner's List
A typewritten list of the names and addresses of all property
owners and occupants within a 300 foot radius of subject property
(including the applicant and/or owner). The list shall -include
the San Diego County Assessor's Parcel Number from the latest
assessment rolls, referenced to the numbers on the plat map.
5. One set of mailing labels of the property owner's and occupants
within the 300 foot radius of subject property for any address
other than single family residence, apartment or suite number
must be included. Do not type Assessor's Parcel Number on labels.
Include a check to cover cost of postage.
