CHILD DAY CARE PERMIT

SUBJECT: DC 98-01 - DISCOVERY ISLE CHILD DAY CARE CENTER
The City has completed a review of the application for a Child Day Care Permit for development
located east of Paseo Del Norte between Encinas Creek and Palomar Airport Road.
It is the Planning Director’s determination that the project is consistent with the City’s Child Day
Care regulations (Chapter 21.83) and with all other applicable City ordinances and policies. The
Planning Director, therefore, approves this request based on the following:
Findinm: -
1. All licenses and permits required by state law for operation of a child day care facility
will be obtained by the operator of the day care facility prior to occupancy.
2. The project is subject to and consistent with the zoning standards and regulations
specified by Specific Plan 184, the R-P zone (Chapter 21.18) and all other applicable
sections of the Carlsbad Municipal Code.
3. Indoor/outdoor areas will be adjacent to the center, accessible through the center,
enclosed by a minimum 5’ high fence, and will not be located adjacent to residentially
zoned property.
4. Outdoor play space will be viewable from within the facility through windows located on
all elevations of the child care center.
5. The child care facility will provide a direct source of natural light in that nine foot high
windows are located along all elevations of the facility to maximize the ability for
children to see outdoors.

6. Parking will be provided at one space/employee and one spacehen children. Pedestrian
sidewalks and adequate on-site loading and unloading will be provided around the
perimeter of the facility.
7. The Planning Department has reviewed, analyzed and considered the environmental
impacts identified for this project and found no substantial evidence the project will have
a significant effect on the environment. The Planning Director issued a Negative
Declaration on August 1, 1998 and no public comment was received during the public
review period.
8. All findings of Planning Commission Resolutions No. 4367 and 4368 approving SDP 98-
02 and CDP 98-1 1 for Discovery Isle Child Day Care Center are incorporated herein by
reference.

Approval is granted for DC 98-01 as shown on Exhibits "A" - "E", dated September 2,
1998, on file in the Planning Department and incorporated herein by reference.
Development shall occur substantially as shown unless otherwise noted in these
conditions.
DC 98-01 is subject to all conditions contained in Planning Commission Resolutions No.
4367 for SDP 98-01 and 4368 for CDP 98-11 for the Discovery Isle Child Day Care
Center.
The Developer shall obtain and maintain in good standing all licenses, permits, and/or
approvals required by state law to operate as a Child Day Care Center, and shall file proof
of same with the Planning Director prior to issuance of the Certificate of Occupancy and,
thereafter filing proof of any extensions or modifications to the permit.
In accordance with Section 21.83.080(F) of the Carlsbad Municipal Code, the total
number of employees and children occupying this facility shall not exceed a demand for
40 parking spaces. The parking standard for a child day care center is 1 space/employee
and 1 space/lO students.
A crosswalk delineated by enhanced pavement shall be provided between the landscaped
parking island and child day care center to ensure safe pedestrian access across the
parking aisle to an entrance to the facility.
