I HAVE BEEN EMPLOYED BY MR. GARY NESSIM TO REVIEW HIS PROPOSED
ADDITION AND ALTERATION TO HIS EXISTING RESIDENCE AT 2986 HIGHLAND DRIVE, WITH RESPECT TO THE PROPOSED BUILDING HEIGHT AND
THE EXISTING CITY REGULATIONS AND YOUR LETTER OF JANUARY 6, 1989.
TO GET A MORE ACCURATE DETERMINATION OF THE EXISTING FINISH
GRADES THAN SUPPLIED BY AN ARIEL TOPOGRAPHIC MAP WE HAD B. B. DEWIT, A LOCAL LAND SURVEYOR, PREPARE AN ACCURATE TOPOGRAPHIC
MAP. (PLEASE REFER TO THE ENCLOSED COPY.)
WE HAVE PREPARED FROM THIS MAP A SITE PLAN DEPICTING THE EXISTING
GRADE AND THE REVISED GRADES, AS REQUIRED TO CONSTRUCT THE
PROPOSED ADDITION AND ALTERATION-. (SEE ENCLOSED SITE PLAN.)
WE HAVE ALSO PREPARED A SITE SECTION TO ILLUSTRATE THE EXISTING
AND PROPOSED GRADING.
WITH THE NEW INFORMATION THAT HAS BEEN MADE AVAILABLE TO us BY
THE SURVEY AND WITH REVIEWING THE CITY ORDINANCE ON BUILDING
HEIGHT (21.04.0651, I FEEL THAT MR. NESSIM'S PROPOSED PROJECT
PROVIDED HE RECEIVES A DISCRETIONARY PERMIT APPROVAL FOR HIS
DEVELOPMENT OR ALTERATIONS BY THE PLANNING COMMISSION OR CITY
SHOULD FALL INTO DEFINITION (2) OF THE EXISTING REGULATION)

COUNCIL, AS STATED IN THE ORDINANCE. "IN THAT CASE! EXISTING
GRADE SHALL MEAN THE GRADE AFTER THE PROPERTY IS DEVELOPED OR
IMPROVED IN ACCORDANCE WITH THE GRADING PLANS FOR THE APPROVED DISCRETIONARY PERMIT." PLEASE NOTE THAT AS PER THE ATTACHED
DRAWINGS) THE DEVELOPMENT WILL NOT CREATE "FINISHED GRADE HIGHER
IN ELEVATION THAN EXITING GRADE AS DEFINED. I
YOUR CONCURRENCE OF OUR INTERPRETATION OF MR. NESSIM'S DESIGN OF
HIS PROJECT WOULD BE APPRECIATED.
